HomeMy WebLinkAboutCC RES 700RESOLUTION NO. 700 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS MALENA DRIVE ANNEXATION TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY oF TUSTIN: 1. That, pursuant' to the prov~isions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the ~City of Tustin all that uninhabited territory situate in the County of Orange, State of Cali~fornia, hereby designated as "MALENA DRIVE ANNEXATION" and described hereinafter. That the City Council hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adoption of this Resolution, and that said territory is contibuous to the City of Tustin. Legal Dexcription for the proposed Malena Drive Annexation to the City of Tustin, Calif. Commencing at an angle point in the existing City Boundary of the City of Tustin as per Torba Street Annexation No. 2 annexed in accordance with Ordinance No. 139 passed and adopted by the Tustin City Council on September 6, 1960, said angle point being the Southeast corner of Tract No. 3465 as shown on a map thereof recorded in Book 120, pages 14 and 15, Miscellaneous Maps, Records of Orange County, California, said angle point also being the Northeast co~ner of Tract "No. 5167 as shown on a m~p thereof recorded in Book 188, pages 39 and 40, Miscellan~.ous Maps, Records of Orange County, California; Thence, departing from said City boundary, S 0o04' 03" E, along the East line of said Tract No. 5167, a distance of 657.07 feet, to the Southeast corner of said.Tract No. 5167; Thence, S 89°20'22" W, along the South line of said Tract No. 5167, a distance of 330.90 feet, to the Southwest corner of said Tract No. 5167; Thence, N 0o02'00'' W, along the West line of said Tract No. 5167, a distance of 661.94 feet, to the Northwest corner of said Tract No. 5167, said corner being on said existing City boundary of the City of Tustin; Thence, following along said existing City boundary, S 89°49'01'' E, along the North line of said Tract no. 5167, a distance of 330.49 feet, to the point of beginning. 2. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin for the following reasons: That the territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will provide an a~ea for industrial development for the City of Tustin, and will provide an adequate and broader tax base for the 8ity; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper over- all planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Orange County, California, did, in sesseion duly assembled, on January 27, 1964, approve the proposed annexation boundaries of the said MALENA DRIVE ANNEXATION to the City of Tustin, as above described, and as submitted to said Commission by the Council of the City of Tustin. 4. That April 20, 1964, at the hour of 7:30 P.M., in the Council Chambers, in the Tustin Area Youth Center of Tustin, County of Orange, State of California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and ha~ing any objections to the proposed anne~- ation, may apoear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protests must be in writing, and may be filed at any time prior to the final adjournmant of the hearing on protests, and shall state the name or names of the owner or owners of property affected, and the street address or other description of the property, sufficient to i~entify it on the last equalized assessment roll. 5. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least ~wice, but not oftener than once a weed, in the Tustin News, a newspaper of general circulation published in said City of Tustin, the 8ity to which it is proposed to annex the afore- said territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tust.~n, but in the County of Orange, California, the County in which is located the territory proposed to be annexed to the City of Tustin, said publication to be completed at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person wo whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any oerson who has filed his name and address and the designa- tion of the lands in which he has an interest, either legal ~r equit- able, with the Clerk, such notice to be given not less ~than twenty (20) clays before the first public hearing on the proposed annexation. 7. In the event any land within the territory pro- posed to be annexed is woned by a county, the City Clerk is diredted to cause written notice of such proposed annexation to be maile dto the Board of Supervisors of the "County, such notice to be given not less~ than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed, a structural improvmen~ owned, being acquired or leased by a county fire protection district, the said~Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notic~ to.be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk iS directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
