BEREFT, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AWARD OF CONTRACT FOR THE TRAFFIC SIGNAL INSTALLATION/ INTERCONNECT SYSTEM AT PORTOLA PARKWAY/ALLEN/CITRUS RANCH PARK (CIP NO. 4026); THE TRAFFIC SIGNAL MODIFICATION/ UPGRADE AT IRVINE BOULEVARD AND PROSPECT AVENUE (CIP NO. 4052); AND THE TRAFFIC SIGNAL INSTALLATION/INTERCONNECT SYSTEM AT TUSTIN RANCH ROAD AND GREENWAY DRIVE/ADAMS DRIVE (CIP NO. 4075) SUMMARY Bids for the Traffic Signal Installation/Interconnect System at Portola Parkway/Allen/Citrus Ranch Park (CIP No. 4026); the Traffic Signal Modification/Upgrade at Irvine Boulevard and Prospect Avenue (CIP No. 4052); and the Traffic Signal Installation/Interconnect System at Tustin Ranch Road and Greenway Drive/Adams Drive (CIP No. 4075) have been received and a construction contract is ready to be awarded to the lowest responsive/responsible bidder. RECOMMENDATION In consideration for the Traffic Signal Installation/Interconnect System at Portola Parkway/Allen/Citrus Ranch Park (CIP No. 4026); the Traffic Signal Modification/Upgrade at Irvine Boulevard and Prospect Avenue (CIP No. 4052); and the Traffic Signal Installation/Interconnect System at Tustin Ranch Road and Greenway Drive/Adams Drive (CIP No. 4075), it is recommended that the City Council: 1. Find the bid of Pro Tech Engineering Corporation to be non-responsive; and 2. Award the construction contract to KDC, Inc. DBA Dynalectric, the lowest responsive/responsible bidder, in the amount of $633,835.00, and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. FISCAL IMPACT The Fiscal Year 2008-2009 Capital Improvement Program (CIP) Budget provides $300,000 in Re- Assessment District 95-1 Funds for the Traffic Signal Installation/Interconnect System at Portola Parkway/Allen/Citrus Ranch Park (CIP No. 4026). The bid amount for this portion of work is $177,016. Secondly, the CIP Budget provides $280,000 in federal Community Development Block Grant (CDBG) funds for the Traffic Signal Modification/Upgrade at Irvine Boulevard and Prospect Avenue (CIP No. 4052). The bid amount for this portion of work is $231,941. Lastly, the CIP Budget provides $265,000 in Measure M Turnback funds for the Traffic Signal Installation/Interconnect System at Tustin Ranch Road and Greenway Drive/Adams Drive (CIP No. 4075). The bid amount for this portion of work is $224,878. Award of Contract for the Traffic Signal Installation/Interconnect System at Portola Parkway/ Allen/Citrus Ranch Park (CIP No. 4026); the Traffic Signal Modification/Upgrade at Irvine Boulevard and Prospect Avenue (CIP No. 4052); and the Traffic Signal Installation/Interconnect System at Tustin Ranch Road and Greenway Drive/Adams Drive (CIP No. 4075) January 20, 2009 Page 2 BACKGROUND Formal bids were publicly opened on December 23, 2008 by the City Clerk's office. Also, the contractor did not submit a signed receipt of Addendum No. 1 as required by the Addendum instructions. Accordingly, it is recommended that the City Council find the bid of Pro Tech Engineering Corporation to be non-responsive and award the contract for the Traffic Signal Installation/Interconnect System at Portola Parkway/Allen/Citrus Ranch Park (CIP No. 4026); the Traffic Signal Modification/Upgrade at Irvine Boulevard and Prospect Avenue (CIP No. 4052); and the Traffic Signal Installation/Interconnect System at Tustin Ranch Road and Greenway Drive/Adams Drive (CIP No. 4075) to KDC, Inc., DBA Dynalectric, the lowest responsive/responsible bidder. The references and the State Contractor's Licenses for KDC, Inc., DBA Dynalectric have been checked and are appropriate for the subject project. Their bid is approximately 20% below the engineer's estimate of $797,200, primarily due to the weak economic climate, resulting in highly competitive bids. /~---~1 Tim D.
