SUBJECT: AWARD OF CONTRACT FOR THE NEWPORT AVENUE MEDIAN
MODIFICATIONS AT ANDREWS STREET AND MAIN STREET (CIP NO.
4072); THE ANNUAL MAJOR PAVEMENT MAINTENANCE PROJECT, FY
2008-2009 (CIP NO. 7001); AND THE ANNUAL SIDEWALK REPAIR
PROJECT, FY 2008-2009 (PROJECT NO. 402-6235)
SUMMARY
Bids for the Newport Avenue Median Modifications at Andrews Street and Main Street (CIP
No. 4072); the Annual Major Pavement Maintenance Project, FY 2008-2009 (CIP No. 7001);
and the Annual Sidewalk Repair Project, FY 2008-2009 (Project No. 402-6235) have been
received and a construction contract is ready to be awarded to the lowest
responsive/responsible bidder.
RECOMMENDATION
It is recommended that the City Council award the construction contract for the Newport
Avenue Median Modifications at Andrews Street and Main Street (CIP No. 4072); the Annual
Major Pavement Maintenance Project, FY 2008-2009 (CIP No. 7001); and the Annual
Sidewalk Repair Project, FY 2008-2009 (Project No. 402-6235) to Hardy & Harper, Inc., the
lowest responsive/responsible bidder, in the amount of $1,109,000.00, and authorize the
Mayor and the City Clerk to execute the contract documents on behalf of the City.
FISCAL IMPACT
The FY 2008-2009 Capital Improvement Program (CIP) Budget currently provides $159,000
for construction of the Newport Avenue Median Modifications at Andrews Street and Main
Street (CIP No. 4072), and $1,030,000 for construction of the Annual Major Pavement
Maintenance Project (CIP No. 7001). The Public Works Department/Engineering Division
Operating Budget currently provides $149,000 for construction of the Annual Sidewalk Repair
Project (Project No. 402-6235). The three projects are part of the City's on-going
Maintenance of Effort (MOE) obligation to maintain eligibility for Measure M funding. The bid
amounts for CIP Nos. 4072, 7001, and Project No. 402-6235 were $101,000.00,
$888,000.00, and $120,000.00, respectively, totaling $1,109,000.00.
BACKGROUND
Formal bids were publicly opened on January 13, 2009 by the City Clerk's office. There were
eleven (11) bids received and the results are summarized as follows in the order of least
dollar amount:

It is recommended that the City Council award the contract for the Newport Avenue Median
Modifications at Andrews Street and Main Street (CIP No. 4072); the Annual Major Pavement
Maintenance Project, FY 2008-2009 (CIP No. 7001); and the Annual Sidewalk Repair Project,
FY 2008-2009 (Project No. 402-6235) to Hardy & Harper, Inc., the lowest
responsive/responsible bidder. The references and the State Contractor's License for Hardy
& Harper, Inc. have been checked and are appropriate for the subject project. Their bid is
approximately 19% below the engineer's estimate of $1,365,781.90, primarily due to the
current weak economic climate, resulting in highly competitive bids.
