HomeMy WebLinkAboutCC RES 677RESOLUTION NO. 677 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "FOURTH AND NEWPORT ANNEXATION TO THE CITY OF TUSTIN AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE couNcIL OF THE CITY OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initi- ated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory s~tuate in the County of Orange, State of California, hereby designated as "FOURTH AND NEWPORT ANNEXATION TO THE CITY OF TUSTIN" AND described hereinafter. That the City Council hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code · Section 35303, on the date of the adoption of this Resolution, and that said territory is contiguous to the City of Tustin. Commencing at a point on the existing boundary of the Fourth Street Annexation to the City of Tustin asper Ordinance No. 216, said point being the intersectionof a line parallel to and 50 feet southerly of the surveyed centerl~ne of FourthStreet with theWesterly right of way line of the Orange County Flood Control District's E1 Modena- Irvine Channel, said Westerly right of way line being parallel to and 238.36 feet Easterly of the surveyed centerline of Holt Avenue; Thence, departing from the existing City Boundary of the City of Tustin, N 0°12'21" W, along said Westerly right of way line, a distance of 680 feet, more or less, to the Southerly line of Lot l0 of the Vanderlip and Rowan Tract as shown on a map thereof recorded in Book 5, page 160 of Miscellaneous Records of Los Angeles County, California; Thence, S 89o54'20" E along said South line, a distance of 465.96 feet to the Southeast corner of said Lot 10; Thence, N 0 04'00" E, along the East line of said Lot 10, a distance of 570 feet, more or less, to the Southwest corner of lot 26 of the Vanderlip and Rowan Tract as shown on a map thereof recorded in Book 17, page 73 of Miscellaneous Records of Los Angeles County, California; Thence, "East" along the South line of said Lot 26 and along the South line of Lots 27 and 28 of said Vanderli~ and Rowan Tract, a distance of 950 feet, more or less to a point on a line parallel to and 50 feet Northwest of as.~measured at right angles to the Northwest line of Lot 331 of Block 13 of Irvine's Subdivision as shown on a map thereof recorded in Book l, page 88, Miscellaneous Maps, Records of Orange Countyo, California; Thence, S 39 45' W, along said parallel line, a distance of 365 feet, more or less, to the Northwest prolongation of the Southwest line of Was Street (4_0 feet wide); Thence, $ 50°15' E, along said Norti~west prolongation and along ~ said Southwest line, a distance of '710.55 feet, to the Southeast line of the Northwes~ one-half of said Lot 331; Thence, S 39~45' W, along said Southeast line, a distance of 273.00 feet, to the most Northerly corner of that certain parcel of land conveyed to Ralph Schenk as described in a deed recorded in Book 6104, page 239, Official Records of 'Orange County, California; "~2 Thence, S 50°15' E, along the Northeast line of said Schenk property, a distance of 165.00 feet, to the most Easterly corner of said Schenk property; Thence, S 39o45' W, along the Southeast line of said Schenk property, a distance of 200.00 feet, to the most Northerly corner of that certain parcel of land conveyed to O. A. Simmons as described in a deed recorded in Book 6326, page 620, Official Records of Orange County, California; Thence, S 50°15' E, along the Northeast line of said Simmons property, a distance of 165.00 feet, to the most Easterly corner of said Simmons property°; Thence, S 39 45' W, ~long the Southeast line of said Simmons property, a distance of 167 feet, to the Southwest line of said Lot 331. Thence, N 50°15' W, along said Southwest line, a distance of 186.40 feet, to Northwest line of the Southeast 516.40 feet of the Northeast one-half of Lot l, Block 12 of the Irvine Subdivision as s~hown on a map thereof recorded in Book l, page 88 of Miscellaneous Maps, Records of Orange County, California; ~ Thence, S 39°45' W, along said Northwest line a distance of 660 feet to ~he Southwest line of the Northeast one-half of said Lot l; Thence, N 50°15' w, along said Southwest line, a distance of 595.13 feet, to the most Southerly corner of the Southwest 67.91 ~feet of the North~-est205 feet of the Northeast one-half of said Lot l; Thence, N 39o45' E, along the Southeast line of said Southwest 67.91 feet, a distance of 67.91 feet, to the most Easterly corner of Said Southwest 67.91 feet; Thence, N 50°15' W, along the Northeast line of said Southwest 67.91 feet, a distance of 205 feet, to the Northwest line of said Lot l, said line beingthe existing boundary of the Fourth Street ~nnexation to the City of Tustin as per Ordinance No. 216; Thence, N 40o38'45'' E, along said Fourth Street Annexation boundary a distance of 15 feet, more or less, to an angle point in said Fourth Street Annexation boundary, said angle point being on a line parallel to and 50 feet southerly of the surveyed centerline of Fourth Street; Thence, N 89°20'19'' W, along said Fourth Street Annexation boundary and also being along said parallel line, a distance of 411.19 feet to the point of beginnin§. 2. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin for the following reasons; The territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed ..to be annexed; will provide an area for industrial development for the City of Tustin, and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and .'storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in Said uninhabited territory, and in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Orange County, California, did, in session duly assemble, on September 30, 1963, ap.~.rove the proposed annexation boundaries of said "FOURTH AND Nk~6PORT ANNEXATION TO THE CITY OF TUSTIN", as above described, and as submitted to said Commission by the Council of the City of Tustin. 4. That November 18th, 1963, at the hour of 7:30 P.M., in the Council Chambers, in the Tustin Area Youth Center, 600 West Sixth St. in the City of Tustin, County of Orange, California, is hereby fixed as the time and place when and where any person owning real prop- erty within the uninha~oited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to saidCity of Tustin. Such protests must be in writing, and may be filed at any time prior to the final adjournment of the hearing on protests, and shall state the name or names of the owner or owners of property affected, and the street address or other description of the property, sufficient to indentify'it on the last equalized assessment roll. 5. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in the Tustin News, a newspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, the County in which is located the territory proposed to be annexed to the City of Tustin, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed~to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the laxt equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or 9quitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. ?. In the event any land within the territory proposed to be annexed is owned by the county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a County fire protection district, the said Clerk is directed to cause written notice of such proposed anne~tion to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first 'public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by Law.
