A RESOLUTION DECLARING THAT PROCEEDINGS HAVE
BEEN INITIATED BY THE CITY COUNCIL OF THE CITY
OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED
TERRITORY DESCRIBED HEREIN AND DESIGNATED AS
WARNER-SYCAMORE ANNEXATION TO THE CITY OF TUSTIN,
AND GIVING NOTICE OF THE PROPOSED ANNEXATION
BE IT RESOLVED BY THE COUNCIL OF· THE CITY OF TUSTIN:
That, pursuant to the provisions of the Annexation of
uninhabited territory Act of 1939, proceedings have been initiated by
the Council of the City of Tustin, 'on its own .mo~ion, to annex to the
City of Tustin all that uninhabited territory, situate in the County
of Orange, State of California, hereby designated as "WARNER-SYCAMORE
ANNEXATION TO THE CITY OF TUSTIN" and described hereinafter.
That the City Council hereby finds and determines that all of
said territory is uninhabited, within the meaning of Government Code
Section 35303, on the date of the adoption of this Resolution, and that
said territory is contiguous to the City of Tustin.
C Commencing at an angle point in the existing boundary of the South
Tustin Avenue Annexation to the City of Tustin asper Ordinance No. 136,
said angle point being theintersection of the Northwest line of Lot 63,
Block ll, Irvine's Subdivision as shown on a map thereof recorded in
Book l, page 88, Miscellaneous Maps, Records of Orange gounty, California,
with a point on a line which is 100 feet Northeast of as measured at
right angles to the centerline of the Atchison, Topeka and Santa Fe
Railroad right of way;
Thence, N 40°00'00" E, along said South Tustin Avenue Annexation
boundary, a distance of 210 feet, to an angle point in said boundary,
said angle point also being an angle point in the e~isting boundary ~f
the Pannell Annexation to the City of Tustin as per Ordinance No. 166,
said angle point also being a point on the Northwest line of said Lot 63;
Thence, N 40o00'00'' E, along said Pannell Annexation boundary,
a distance of 285.00 feet, to an angle point in said boundary;
Thence, departing from the existing boundary of the City of Tustin,
N. 40000'00,' ~, along said Northwest line of Lot 63, a distance of
725.47 feet, to the most Northerly corner of said Lot 63;
Thence, S 49o59'23'' E, along the Northeast line of said Lot 63,
a distance of 330.20 feet, to the most Southerly corner of Tract No.
3965 as shown on a map thereof recorded in Book 161, pages 36 and 37,
Miscellaneous MapsA Records of Orange County, California;
Thence, N 39~59"33'' E, along the Southeast line of said Tract No.
'3965~ a distance of 660.17 feet, to the most Easterly corner of said
Tract No. 3965, said corner also being on the Northeast line of the
Southwest one-half of Lot 50 of said Block ll;
= Thence, S 50o00'56'' E, along said Northeast line of said South-
west one-half, a d'istance of 330 feet, to the center of said Lot 50;
Thence,. S, 39o59'33'' W, along the Southeast line of the Westerly
one-quarter of said Lot 50, a distance of 660 feet, more or less, to
the Southwest line_of said Lot 50;
Thence, S 49W59'23'' E, along the Southwest line of said Lot 50,
a distance of 660 feet, mo~e or less, to the most Southerly corner of
said lot 50, said corner also being the most Easterly corner of said
Lot 63;
Thence, S 40o02'59'' W, along the Southeast line of said Lot 63,
a distance of 1,270.33 feet, to a point on the Northeasterly right of
way line of the Atchison, Topeka and Santa Fe Railroad (100 feet wide);
THence, N 50°10'50'' W, along said right of way line, a distance
of 755.76 feet, to the Northeasterly prolongation of th~ Northwest line
of that certain parcel of land conveyed to Mullin Lumber Company by deed
recorded in Book 4909, page 154 of Official Records of Orange County,
California;
Thence, S 39°49'10'' W, along said Northeasterly prolongation and
along said Northwest line and along the Southwesterly prolongation
thereof, a distance of 480.00 feet, to the Southwest line of Edinger
Street (80 feet wide);
Thence, S 50°10'50'' E, along said Southwest line of Edinger Street,
a distance 755.76 feet to the Southeast line of Lot 66, Block l0
Irvine's Subdivision as shown on a map thereof recorded in Book l,
page 88, Miscellaneous Maps, Records of Orange County, California;
Thence , S 40°02'59" W, along said Southeast line of said Lot
66, a distnace of 530 feet, more or less, to the Northeast line of the
Southwesterly 351.10 feet of said Lot 66;
Thence, N 50°10' 50" W, along said Northeast line of said
Southwest 351.10 feet, a distance of 1,320 feet, more or less, to the
Northwest line of said Lot 66;
Thence, S 40o00'00'' W, along said Northwest line of said Lot 66
and aleng the Northwest line of Lot 79 of said Block 10, a distance of
1,680, feet, more or less, to the most Westerly corner of said Lot 79;
Thence, S 50o09'55'' E, alohg the Southwest line of said Lot
79, a distance of 1,290.48 feet, more or less, to the Northwest line
of Red Hill Avenue (60feet wide);
Thence, S 40o00'00'' W, along W~&d Northwest line of Red Hill
Avenue, a distnace of 2,640 feet, more or less, to the Southwest line
of Lot 95 of said Block 10;
Thence, N 49o20'48'' W, along said Southwest line of said Lot 95
and along the Southwest line of Lot 96 of said Block 10, a distance of
1,890 feet, more er less, to an intersection of the boundary line of
that certain parcel of land conveyed to the State of California ms des-
cribed in a deed recorded in Book 6009, page 427, Official Records of
Orange County;
Thence, following along said State of California boundary line
the following courses and ~istances:
S 40°39'12'' W, a distnace of 50.00 feet, toaan angle point;
N 58o06'37'' W, a distance of 328.17 feet, to an angle point;
N 67°34'11'' W, a distnace of 372.71 feet, to an angle point,
said angle point being on a line parallel to and 46.00 feet Southeasterly
of as measured at right angles to the Southwesterly prolongation of the
Northwest line of said Lot 96;
Thence, N 40°39'12'' E, along said parallel line, a distance of
1,511 feet, more or less, to the Southwest line of.Lot 81 of said
Block l0;
Thence, N 49o20'48'' W, along said Southwest line of said Lot 81,
a distance of 16.00 feet, to the Southeast line pf Newport Avenue
(60.00 feet wide);
Thence, N 39o48'55'' E, along said Southeast line of Newport
AVenue, a distance of 3,510 feet, more or less, to the Southwest line
of Edinger Street (80. feet wide) as described in an easement Deed to
the County of Orange recorded in Book ~5406, page 473, Official
Records of Orange C~ounty, California; ·
Thence, N 84~49'02'' E, along said Southwe$~ line of Edinger Street,
a distance of 28.~8 feet, to an angle point;
Thence, S 50°10'50'' E, along said Southwest line of Edinger
Street, a distance of 1,286.80 feet, to a point which is 1,336.80
feet Southeast of as measured at right angles to the Northwest line
of Lot 65 of said Block 10;
Thence, N 39°49'10'' E, perpandicular to the centerline of
Edinger Street, a distmnce of 80.00 feet, to the intersection of a
nontangent curve concave Southeasterly and having a radius of 412.85
feet, a radial to said point bears S 39°18'56'' E;
Thence, Easterly along said curve through a central angle of
55°22'06'', an arc distance of 398.96 feet, to a point in the Southwest
right of way line of the Atchison, Topeka and Santa Fe Railroad
(lO0.00 feet wide);
Thence, N 39°49'10'' E, perpendicular to the centerline of said
right of way, a distance of 100.O0 feet, to the Northeast right of way
line of said Railroad;
Thence, N 50°10'50" ~, along said Northeast right of way line,
a distance ~f 255.88 feet, more or less, to the Northwest line of said
Lot 63;
Thence, N 40o00'00'' E, along said Northwest line of said Lot
63, a distmnce of 50.00 feet, to the pc~t of beginning.
2. That the City Council of the City of Tustin desires
to annex said uninhabited territory to the City of Tustin for the
following reasons: That the territory is contiguous to the City of
Tustin, and its proposed annexation will contribute to and facilitate
the orderly growth and development of both the City and the territory
proposed to be annexed; will provide an area for industrial development
for the City of Tustin, and will provide an adequate and broader tax
base for the City; Will facilitate and contribute to the proper
and orderly layout, design and construction of streets, gutters,
sidewalks, sanitary and storm water sewers and d~ainage facilities,
both within the City and within the territory proposed to be annexed;
and will provide and facilitate proper overall planning and zoning
of lands, and subdivision of lands in said City and said uninhabited
territory, in a manner most conducive to the welfare of said City and
said uninhabited territory.
3- That the County Boundary Co~nission of Orange County,
California, did, in session duly assembled, on September 23, 1963,
approve the proposed annexation boundaries of the said WARNER-
SYCAMORE ANNEXATION TO THE CITY OF TUSTIN, as above described, and
as submitted to said Commission by the Council of the City of Tustin.
4. That November 18, 1963, at the hour of 7:30 P. M., in
the Council Chambers in the Tustin Area Youth Center, 600 West
Sixth Street, City of Tustin, County of Orange, California, is
hereby fixed as the time and place when and where any person owning
real property within the uninhabited territory above described and
proposed to be annexed to the City of Tustin, and having any objections
to the proposed annexation, may a pear before the Council of the City
of Tustin and show cause why such uninha ited territory should not
be so annexed to said City of Tustin. Such protests must be in
writing, and may be filed a.t any time prior to the final adjourment of
the hearing on protests, and shall state the name or names of the
owner or owners of property affected, and the street address or other
description of the property sufficient to identify it on the last
equalized assessment roll.
5. The City Clerk of the City of Tustin is hereby authorized
and directed to cause a copy of this Resolution to be published at
least twice, but~inot oftener than once a week, in the Tustin News,
a newspaper of general circulation published in said City' of Tustin,
the City to which it is proposed to annex the afore-said territory, and
also in the Orange Daily News, a-.newspaper of general circulation
published outside the City of Tustin, but in the County of Orange,
California, the County in which is located the territory proposed to
be annexed to the City of Tustin, said publication to be completed at
least twenty (20) days prior to the date set for hearing.
The City Clerk is further authorized and directed to cause
written notice of such proposed annexation to be mailed to each
person wo whom land within the territory proposed to be annexed is
assessed in the last equalized County assessment roll available on
the date the above said proceedings were initiated, at the addresses
shown on said assessment roll or known to the Clerk, and to any
person who has filed his name and address and the designation of the
lands in which he has an interest, either legal or equitable, with
the Olerk, such notice to be given not less than twenty (20) days
before the first public hearing on the proposed annexation.
7. In the event any land within the territory proposed to be
annexed is owned by a county, the City Clerk is directed to cause
written notice of such proposed annexation to be maile to the
Board of Supervisors of the County, such notice to be given not less
that twenty (20) days before the first pu'blic hearing on the proposed
a~mexation.
8. In the event there is, upon the land proposed to be annexed,
a structural improvem2nt woned, being acquired or leased by a county
fire protection district, the said Clerk is directed to cause written
notice of such proposed annexation to be mailed to the governing body
of such district, such notice to be sent not less that ten (10) days
before the first public hearing upon such proposed annexation.
9. The City Clerk is directed to cause written notice to be
given to such other persons as may be legally entitled thereto,
in the manner required by law.
PASSED AND ADOPTED at a meeting of the City Council of the
City Of Tustin, held on the 23rd day of September, 1963.
