HomeMy WebLinkAboutCC RES 660RESOLUTION NO. 660 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS PANKEY ANNEXATION NO. 2 TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provisions of the Annexation of Unin- habited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tus%in, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of Orange, State of California, hereby designated as "PANKEY ANNEXATION NO.2" and described hereinafter. That the City Council hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adoption of this Resolution, and that said territory is contiguous' to the City of Tustin. LEGAL DESCRIPTION FOR PANKEY ANNEXATION NO.2 TO CITY OF TUSTIN Beginning at the intersection of the Southeasterly line of th~ Northwesterly one-quarter of Lot 31, Block 12, of Irvine's Subdivision as shown on a map thereof recorded in Book 1, page 88, Miscellaneous Maps, 'Records of Orange County, California, with the Southwesterly line of the Northeasterly one-half of said Lot 31, said intersection being on the boundary line of the High School Annexation to the City of Tustin adopted in accordance with a Resolution by the Orange County Board of Supervisors, dated June 19, 1957, said intersection also being an angle point in the boundary line of High School Annexation No. 2 adopted in accordance with a Resolution by the Orange County Board of Supervisors dazed January 22, 19~8; Thence, following along the boundary line of said High School Annexation No. 2 S. ~9°21'0~'' E. along the Southwesterly line of the Northeasterly one-half of said Lot 31, a distance of 661.~0 feet, more or less, %o the most Southerly corner of said High School Annexation No. 2, · . said corner also being the most Westerly corner of the First Southern Baptist Church of Tustin Annexation %o the City of Tustin in accordance with Ordinance No. 169 passed and adopted by the Tustin City Council on February 19, 1962; Thence, .following along the Southwesterly line of said First Southern Baptist Church Annexation S ~9°21'0~'' E along the Southwest line of the Northeast one-half of said Lot 31, a distance of 280.72 feet to the intersection of a line parallel to and 50 fae% Northwesterly of as measured at r±ght angles to the surveyed cen%erline of Red Hill Avenue; Thence, S. ~0°~0'06'' W. along said parallel line, a distance of 271.88 feet, to the existing boundary line of Pankey Annexation to the City of Tustin in accordance with Ordinance No. 99, passed and adopted by the Tus%in City Council on May 23, 1956, said boundary line being on a curve, concave Southwesterly, and having a radius of 528 feet; Thence, following along the boundary line of said Pankey Annexa- %ion, Northwesterly along said curve through a central angel of 28°23'~?'' , an arc distance of 261.68 feet to a line tangent at the end of said curve; Thence, following along the boundary line of said Pankey Annexa- tion N 78°15'12'' W, a distance of 173.83 feet to the beginning of a tangent curve concave Northeasterly and having a radius of 772 feet; Thence, following along the boundary line of said Pankey Annexa- tion Northwesterly along said curve through a central angle of 17°00'00"~ an arc distance of 229.06 feet to a line tangent at the end of said curve. Thence, following along the boundary line of said Pankey Annexa- tion N 61°15'12'' W, a distance of 331.86 feet to the intersection of the Southeasterly line of the Northwesterly one-quarter of said Lot 31, said .. Southeasterly line also being on the boundary line of said High School Annexation; Thence, following along the boundary line o£ said High School Annexation, N. ~0°38'03" E along said Southeasterly line, a distance of ~69.79 feet to the point of beginning. 2. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin for the following reasons' That the territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development o£ both the City and the territory proposed to be annexed; will provide an area for industrial development for the City of Tustin~ and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of streets~ gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both-within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited ±.erri- tory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Orange County, California, did, in session duly assembled, on August 27, 1962, approve the proposed annexation boundaries of the said PANKEY ANNEXATION NO. 2 TO THE CITY OF TUSTIN, as above described, and as submitted to said Commission by the Council of the City of Tustin. That July 15, 1963, at the hour of 7'30 P.M., in the Council Chambers in the City Hall~ City of Tustin, County of Orang~, State of California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said Ci~%y of Tustin. Such protests must be in writ- lng, and may be filed at any time prior to the final adjournment of the hearing on protests, and Shall state the name or names of the owner or owners of.property affected, and the street address or other description of the property, sufficient to identify it on the last equalized assess- ment roll. 5. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be pub- lished at least twice, but not oftener than once a week, in The Tustin News, a newspaper of general circulation published in said City of Tustin~ the City to which it is proposed to annex the aforesaid territory, and' also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, the County in which is located the territory proposed to be annexed to the City of Tus%in, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person %o whom land within the territory proposed to be ~nnexed is assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment. roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest~ either legal or equitable~ with the Clerk~ such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire pro- tection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body o£ such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto~ in the manner required by law.
