A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ABANDONING THE NEWPORT
AVENUE ANNEXATION TO THE CITY OF TUSTIN.·
WHEREAS, on October 15, 1962, the City Council did pass
and adopt Resolution No. 618, initiating proceedings to annex certain
uninhabited territory to the City of Tustin, designated as the "NEWPORT
AVENUE ANNEXATION TO THE CITY OF TUSTIN, CALIFORNIA," and setting, a
protest hearing on December 11, 1962, and
WHEREAS, said protest hearing was continued from time to
time, and is presently set for June 3, 1963, each and all at the
specific written request of all of the owners of property within
said territory, and
WHEREAS, all of the owners of property within said territory
have requested that these said annexation proceedings be abandoned;
and
WHEREAS, no oral or Written protests to said annexation
have been received or filed, and
WHEREAS, it appears that said annexation proceeding is
invalid, void and/or voidable by reason of annexation proceedings
having been commenced on part of this same territory prior to the
commencement of this annexation proceeding, and other defects, and
WHEREAS, part of this said territory was the subject of
an annexation proceeding by the City of Santa Ana, and the subject
of a legal action between the City of Santa Ana and the Irvine Company,
one of the owners thereof, and
WHEREAS, the City of Santa Ana, the Irvine Company and the
City of Tustin have entered into an agreement providing~ inter alia,
that this said annexation proceeding will be abandoned, and
WHEREAS, it is desired that new proceedings be commenced
for the annexation, of that part of this territory lying northerly of
the center line of Warner Avenue, so that this last mentioned territory
may be annexed by annexation proceedings which have no legal or
procedural impediments or defects;
NOW, THEREFORE, BE IT RESOLVED that the proceedings to annex
the territory known as the NEWPORT AVENUE ANNEXATION TO THE CITY OF TUSTIN,
the territory of which is described as:
PROPOSED NEWPORT AVENUE ANNEXATION TO THE CITY OF TUSTIN
Those portions of blocks ?, 8, 9, 10 and 11 of Irvine's
Subdivision in the County of Orange, State of California, as said sub-
division is shown on a map recorded in Book 1, page 88 of Miscellaneous
Record Maps in the office of the county recorder of said county, described
as follows:

Beginning at a point in the boundary line of the City of Tus%in
as established by the South Tustin Avenue Annexation, City of Tus%in
Ordinance No. 136, said point being distant South 50° East 320.00 feet
from the northwesterly line of said block 11;. thence South 50° East 340.00
feet along said City of Tustin boundary line to a point in a line that is
parallel with and distant South 50° East 660.00 feet from said northwester-
ly line of block 11, thence leaving said City of Tustin boundary line
South 40° West 4060 feet, more or less, along said parallel line to an
intersection with the southwesterly line of lot 81, said block 10; thence
South 50° East 1320 feet along said southwesterly line and the southwest-
erly line of lot 82, said block 10 to a point in a line that is parallel
with and distant southeasterly 1980 feet measured at right angles from
the northwesterly line of said block 10; thence South 40° West 7260 feet,
more or less, along said' parallel line %o a point in a Iine that is

parallel with and distant southwesterly 660.00 feet from the southwesterly
line of said block 9; thence North 50° West 1320 feet, more' or less, to a
point in a line that is parallel with and distant southeasterly 660 feet
measured at right angles from the northwesterly line of said block 8, thence
South 40° West 5340 feet, more or less, along said parallel line to a
point lying South 40° West ?10 feet from the southwesterly line of said
block 8; thence North 68° ~?' 00" West 6~0 feet, more or less, (basis of
bearing being North 40° East for the northwesterly line' of block ? of
Irvine's Subdivision) to an angle point in the boundary line of. the City of
Costa Mesa as established by City of Costa Mesa Ordinance No. 302; said
angle point lying in a line that is parallel with and distant southeasterly
30 feet measured at right angles from the northwesterly.line of block
and lying also in a line that is parallel with and distant West 50 feet
measured at right angles from the South prolongation of the centerline of
Main Street, 83 feet wide; thence North 98.93 feet, more or 'less, along
the last mentioned parallel line being also the boundary line of the City
of Costa Mesa as per said Ordinance No. 302 to a point which bears
West 83 feet from an angle point in the boundary line of the City of
Santa Ana Ordinance No. NS-320, said angle point lying in said parallel
line that is parallel with and distant southeasterly 30 feet measured at
right angles from said northwesterly line of block 7, said angle point being
also the most southerly corner in the boundary line established by said
Ordinance No. NS-320; thence leaving the boundary line of the City of
Costa Mesa as established by said.Ordinance No. 302 East 83 f~eet to said'
angle point in the boundary line of the City of Santa Ana as established
by said Ordinance No. NS-320; thence North ~0° East 6060 feet, more or less,
along last mentioned parallel line, also being the boundary line of the
City of Santa Ana as established by said Ordinance No. NS-320 to an inter-
section'with the southwesterly line of lot 116, said block 9; thence
leaving said boundary line of the City of Santa Ana as established by

said Ord±nance No. NS-3£0 South 50 East 1290 feet, more or less, along
said southwesterly line to the most southerly corner of said lot 116; themce
North ~0° East 1320 feet, more or less, along.the southeasterly line of
said lot 116 to the most easterly corner of said lot 116; thence North 50°
West 1290 feet, more or less, along the northeasterly line of said lot 116
to an intersection with a line that is parallel with and distant south-
easterly 30 feet measured at right angles from the northwesterly line of
said block 9; thence North ~0° East 2793.~ feet, more or less, along
said parallel line to an angle point in the boundarY line of that certain
land described in a deed to the State of California recorded February 15, 1962
in Book 6009, page ~27 of Official Records of Orange County, California;
thence along said State of California boundary line the following courses
and distances:

North ~0° 39' 12" East 9~0.00 feet;
South 67° 3~' 11" East 372.71 feet;
South 58° 06' 37" East 328.17 feet;

North ~0° 39' l£"East 1291.13 feet to an intersection with the
southwesterly line of lot 81, said block 10; thence North ~9° 20' ~8"
West 16.00 feet along said State of California boundary line being also
said southwesterly line of lot 81 to an intersection with the south-
easterly right of way line of Newport Avenue, 60.00 feet wide, as shown
on a map recorded in Book 3~, page 17 of Record of Surveys, said inter-
section being also an angle point in said State of California boundary
line; thence leaving said State of California boundary line North 39° ~8' 55"
East 3510 feet, more or less, along said southeasterly right of way line to
an intersection with the southerly right of way l~ne of Edinger Street,
80.00 feet wide, as described in an Easement Deed to the County of Orange
recorded September 7, 1960 in Book 5~06, page ~73 of Official Records of
Orange County, California; thence North ~o /~9' 02" East 28.28 feet along
said southerly righ% of way line; thence South 50° 10' 50" East 270 feet,
more or less, along the southwesterly right of way line of said Edinger
Street to a point that is distant southeasterly 320 feet measured at right

PASSED AND ADOPTED at a special meeting of the City Council of
the City of Tustin, California, held on May 28, 1963.
