HomeMy WebLinkAboutCC RES 658RESOLUTION NO. 658 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ABANDONING THE RED HILL ANNEXATION TO THE CITY OF TUSTIN. WHEREAS, on October 15, 1962, the City Council di.d pass and adopt Resolution No. 617, initiating proceedings to annex certain ~ninhabited territory to the City of Tustin, designated as the "RED HILL ANNEXATION TO THE CITY OF TUSTIN, CALIFORNIA," and setting a protest hearing on December 11, 1962, and WHEREAS, said protest hearing was continued from time to time, and is presently set for June 3, 1963, each and all at the specific written request of all of the owners of pro- perty wi thin said territory, and WHEREAS, all of the owners of property within said ter- ritory have requested that these said annexation proceedings be abandoned; and W~.IEREAS, no oral or written ~protests to said annex- ation have been received, or filed, and WHEREAS, it appears that said annexation proceeding is invalid, void and/or voidable by reasoh of annexation proceedings having been commenced on.~part of this same territory prior to the commencement of this annexation proceeding,' and other' defects, and WHEREAS, part of this said territory was the subject of an annexation proceeding by the City of Santa Aha, and the sub- ject of a legal action between the City of Santa Ana and the Ir- vine Company, one of the owners thereof, and WHEREAS, the City of Santa Ana, the Irvine Co. and the City of Tustin have entered into an agreement providing, inter alia, that this said annexation proceeding wi. ll be abandoned, and WHEREAS, it is desired that new proceedings be commenc- ed for the anne.xation of that part of this territpry lying north- erly of the center line o.¢ Warner Avenue, so that this last men- tioned territory may be annexed by annexation proceedings which have no legal or procedural impediments or defects; NOW, Tt.tEi.~EFORE, BE IT RESOLVED that the prrceedings to annex the territory known as the RED HILL ANNEXATION TO THE CITY OF TUSTIN, t~le territory of' which is described as' · f' · r' T PROPOSED RED HILL ANN:E.XA.~.ION TO HE CITY OF TUSTIN Those portions of blocks 9, 10 and 11 of Irvine's Subdivision in the County of Orange, State of California, as said subdivision is shown on a map recorded in Book l, page 88 of Miscellaneous Record Maps .in the office of the county recorder of said county described as follows; Beginning at a ~.oint in the boundary line of the City of Tustin as established by the South Tustin Avenue Annex- ... ation, City of Tustin Ordinance No. 136, said Point being dis~ rant South 50° East 660.00 feet from the northwesterly line of said block 11; thence South 50o East 3/,3.23 feet along said City of Tustin boundary line; thence leaving said City of Tus- tin boundary line South 40© West 150.00 feet parallel to said northwesterly line of block l i to the point of beginning in the boundary line of that certain parcel of ]..and conveyed to · John M. Robertson in a deed recorded March 2, 1962 in book 6025, page 580 of Official Records of Orange County, California; thence North )8°58' 41" West 40.73 feet along said Hobertson boundary line; thence South 39048'55'' West 3?3.?? feet along said Robertson boundary line and the southwesterly prolonga- tion thereof to an intersection with the southwesterly right of way line of Edinger Street, 80.00 feet wide, as descri, bed in an Ease,ent Deed to the County of Orange recorded September 7, 1960 in Book 5406, page 473 of Official Records of Orange O County, California; thence South 50 10' 50" East 357 feet, more or less, along said southwesterly right of way line to an inter- section with the southeasterly line of lot 65, said block 10; thence South 40° West 2240 feet, more or less, along said southeasterly line and the southwesterly i~p'ro, lo'.n,gat'io':n .th~e~e~ of to an intersection with the southwesterly right of way of Valencia Avenue, 60.00 feet wide, as shown on a map recbrded in Book 34, page 17 of Record of Surveys; thence South 50°09'55'' East 1350.48 feet, more or less, along said southwesterly right of way line and the southeasterly prolongation thereof to an intersection with the southeasterly right of way line of Red Hill Avenue, 60.00 feet wide, as shown on a map recorded in Book 12, page 4} of Record of Surveys; thence South 40°West 7890 feet, more or less, along said southeasterly r~ght of way line to an intersection with the southwesterly line of . said block 9; thence North 50° West 690 feet, more or less, along said southwesterly~ line to a point in a line parallel with and distant southeasterly 1930 feet measured at right angles from the northwesterly line of said block 9; thence North 40° East 6600 feet, more or less, along said parallel line to an intersection with the southwesterly line of lot 32, said block 10; thence North .50° West 1320 feet, more or less, along said southwesterly line and the southwesterly line of ~ot 81, said block 10, to a point in a line that is parall- el with and dis tantsoutheasterly 660.00 feet measured at right angles from the northwesterly line of said block ~0; thence North 40° .East 4060 feet, more or less, along said parallel line to the poi. nt of beginning. be and the same hereby is abandoned.
