HomeMy WebLinkAboutCC RES 654RESOLUTION NO. 656 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL 0F THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS WEST MAIN STREET ANNEXATION TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provisions of the Annexat- ion of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion to annex to the City of Tustin all that uninhabited ~ territory situate in the County of Orange, State of California, hereby designated as "WEST MAIN STREET ANNEXATION" and des- cribed hereinafter. ~ That the City Council hereby finds and determines that all of said ter'~itory is uninhabited within the meaning of .Government Code Section 35303, on the date of the adoption of this Resolution, and that said territory is cont~iguous to the City of Tustin, LEGAL DESCRIPTION FOR WEST MAIN STREET ANNEXATION TO THE CITY OF TUSTIN Beginning at an angle point in the existing boun- dary of the South Tustin Avenue Annexation to the City of Tus- tin as per Ordinance No.136 pas~ed and adopted by. the Tustin City Council on July 5, 1960, said. angle point being on the North line of Main Street (80'wide) being distant thereon S 89030'25'' W., 243.00 feet from the surveyed centerline of Tustin Avenue; Thence, following along said South Tustin Avenue An- nexation boundary line, S. 0°41'01" E., a distance of 928.93 feet to an angle point in the existing boundary of the John Jacob's Annexation to the City of Tustin as per Ordinance No. 181, passed and adopted by the Tus,t. in~:~C~i~'ty,Council on August 6, 1962; Thence, following along said John Jacob's Annexation boundary line, the following courses and distances' N 49°10'02" W., a distance of 84.52 feet to an angle point; N 39°18'49'' W., a distance of 174.10 feet to an angle point; N 89o44'04'' W., a distance of 273.48 feet to an angle point; S 0°41'01'' W., a distance of 296.79 feet to ~.the N.E.corner of the Williams Street Annexation to the City of Tustin as per Ordinance No. 207, passed and adopted by the Tustin ., City Council on March 11, 1963; Thence, following along the boundary line of said Wi]..liams Street Annexation, N 89°45'37'' W., a distance of 027.83 feet, more or less, to an angle point, said angle poi'nt, said angle point being on the East line of Williams Street (66 feet wide); Thence, continuing along said Williams Street Annex- ation 'boundary, S 0°31'31"" W., a distance of 45 feet, more or less to the East prolongation of the South line of that certain parcel of land conveyed to George E. Meurs as per deed recorded in Book 1421, page 227, Official Records of Orange County, California; Thence, leaving said William Street Annexation boundary, and running along said. East prolongation and along said South line, S 88°33'15'' W., a distance of 863.76 feet to the Southwest corner of said Meurs property, said corner being a point on the East line of that certain parcel of land conveyed to Esta E. Leihy as per deed recorded in Book 1499, .. page 388, Official Records of Orange County, California; Thence, S 0~33'.00" E., along said East line of said Leihy property, a distance of 100 feet more or less, to the Southeast corner of said Leiht property; Thence, S 88°33'15'' W., along the South line of said Leihy property, a distance of 393.57 feet, to the Southwest co'rner of said Leihy property; Thence, N 0°33'00'' W., along the West line of said Leihy property, a distance of 247.08 feet to an angle point in ., the existing City Boundary of the City of Santa Ana as per 0rd- inance No. NS-583; · Thence, following along said City of Santa Aha boundary, N. 0°06'00" W., a distance of 942 .'54 feet, to the North line of Main Street (80 feet wide), said North line also being on the South line of Prentice Park Territory' Annex- at ion to the City of Santa Ana as per Ordinance No. ~269; Thence, following along said South 'Yine of said Prentice Park Territory Annexation, N. 89005'30'' E., a distance of 2?6.69 feet, to the Southeast corner of said Prentice Park Territory Annexation, said corner also being the Southwest corner of the "East of Prentice Park Annex" to the City of Santa Aha as per OrdYnance No. NS-297; Thence, following along the South line of said "East "N 89005'30'' E., a distance of 329 of Prentice Park Annex, . feet, to the Southeast corner of said "East of Prentice Park Anne x"; Thence, leaving the City boundary of Santa Aha and continuing N. 89005'30" E., along the North line of said Main Street, a distance ~of 349.4 feet, to the West line of Lot "C" of the Stafford and Tustin Tract as shown on a map thereof re- corded in Book 2, Pages 618 and 6~9 of Miscellaneous Records of Los Angeles County, California; Thence, N. 0029'35'' W., along said West line, a dis- tance of 49~0 feet more or'".less:, to the Northeast right of way line of the Santa Aha Freeway, said line being on a curve concave Northeasterly and having a radius of ~,920 feet, said curve hav- ing a radial bearing of N. 4~007'~36'' E., at said point of inter- section; Thence, Southeasterly ~following along said curve through a central angle of ~2°46'00'', an arc distance of 427.82 feet, to the end of said curve, said point having a radial bearing of N. 28021'36" E. ' Thence, conti, nuing 'along ,..the Northeast line of said Santa Aha Freeway, S. 68°41'-16'' E., a distance of 591.54 feet to an angle point; Thence, S. 86°36'~5''' E., a distance of 412.25 feet to the North line of said Main Street (80 feet wide); Thence, N. 89030'25'' E., along said' North line of said Main Street, a distance of 457 feet to the point of beginning. 2. That the City Council of the City of Tustin de- sires to annex said uninhabi~ted territory to the City of Tustin for the following reasons' That the territory is contiguous tO the City of Tustin, and its proposed annexation will 'contrib- ute to and. facilitate 'the orderly growth and development of both the City and the territory proposed to be annexed; will provide an area for industrial development for the City of Tustin., and will provide an adequate and broader tax base for the City; will facilitate and. contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage fa~ cilities, both within the City and within the territory pro- posed '~to be annexed; and wi i1 provide and fac ilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conUucive to the welfare of said City and said uninhabited territory. That the County Boundary Commission of Orange County, California, did, in session duly assembled, on April 8th, 1963, approve the proposed annexation boundaries of the said WEST MAIN STREET ANNEXA~.ION TO THE CITY OF TUSTIN, as above described, and as submitted to said Commission by the Council of the City of Tustin. 4. That J~ne i?th, 1963, at the hour of 7'30 P.M. in the Council Chmabers in the City Hall, in the City of Tustin, County of Orange, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before th~ Council of the City of .Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such pro- tests must be in writing, and may be filed at any time prior to the final adjournment of the hearing on protests, and shall state the name or names of the owner or owners of property affected, and the street address or other description of the property, sufficient to identify it on the iast equalized assessment roll. 5- The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to . be published at least twice, but not oftener than once a week in ~he Tustin News~ a newspaper of general c~rculation pub- lished in said City of Tustin, the City. to which it is proposed to annex the aforesaid territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California , .. the County in which is located the territory proposed, to be annex- ed to the City of Tustin, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mail- ed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the above said proceedings were in- i tiated, at the addresses shown on said assessment roll or known to the Clerk, and to any pers'on who has filed' his name' and address and the des£gnation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory pro- posed to b$ annexed is owned by a county, the City Clerk is· directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the Coun'ty, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land porposed to be annexed, a structural improvement owned, being acquired or leased, by a county fire protection district, th~ said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such no- t ice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written no-. rice to be given to such other' persons as may be legally en' titled thereto, in the manner required by law.
