HomeMy WebLinkAboutCC RES 653RESOLUTION NO. 653 A RESOLUTION DECLARING THAT PROCEEDING HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS RE~ VISED WEST MAIN STREET ANNEXATION TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEX~ ATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN 1. That, pursuant to the provisions of the Annex- ations of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion to annex to the City of Tustin all. that ".uninhabited territory situate in the County of Orange, State of California, hereby designated as " REVISED WEST MAIN STREET ANNEXATION" and described hereinafter. That the City Council' hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adoption of this Resolution, and that said territory is contiguous to the City of Tustin.. LEGAL DESCRIPTION FOR REVISED WEST MAIN STREET ANNEXATION TO THE CITY OF TUSTIN Beginning at an angle point in the existing boundary of the South Tustin Avenue Annexation to the City of Tustin as per Ordinance No. 136, passed and adopted by the Tustin City Council on July 5, 1960, said angle point being on the North line of Main Street (80'wide) being distant thereon S 89° 30' 25" W., 243.00 feet from the surveyed centerline of Tustin Avenue; Thence, following along said South Tustin Avenue Annexation boundary line, S. 0© /~1'01" W., a disgance of 928.93 feet to an angle point in the existing boundary of the John Jacob's Annexation to the City of Tustin as per Ordinance No. 181, passed 'and adopted by the Tustin City Council on August 6, 1962; Thence~ following' along said John Jacob's annex- ation boundary line, the fol.~owing courses and distances' N 49°~0'02'' W., a distance of 84.52 feet to an angle point; N 39°18'49'' M., a distance of 174.10 feet t~o an angle point; N 89°44'04'' W., a distance of 273.48 feet to an angle point; S 0°41'0l'' W.~, a distance of 296.79 feet to the N.E. corner of the Williams Street Annexation to the CitY of Tustin as per Ordinance No. 207, passed and adopted bY The Tustin City Council on March 11,1963; Thence, following along t~he boundary line of said William Street Annexation, N. 89°45'37"~,'a distance of 1,027.83 feet, more or less, to an angle point, said angle point being on the East line of Williams Street (66 feet wi de ); Thence, continuing along said Williams Street Annexation boundary, S 0°31'31" W., a distance of 45 feet, more or less to the East prolongation of the SoUth line of that certain parcel of land conveyed to George E. Meurs as per deed recorded in Book 1421, page 227, Official Records of Orange County, California; Thence, leav.ing said William Street Annexation boundary, and running along said East prolongation and along said South line, S. 88°33'15'' W., a distance of 863.76 feet to the Southwest corner of said Meurs property, said corner being a point on the East line of that certain parcel of land conveyed, to Esta E. Leihy as per deed recorded in Book ~499, page 388, Official Records of Orange County, California; Thence, S 0633'00" E., along said East line of said Leihy property, a distance of 100 feet more or less, to the Southeast corner of said Leihy property; Thence, S. 88°33'15'' W., along the South line of said Leihy property a.distance of 393,57 feet, to the south- west corner of said Leihy property; Thence, N. 0°33'00'' W., along the West line of said Leihy property, a distance of 247.08 feet to an angle .point in the existing City boundary of the City of Santa Ana as per Ordinance No. NS-583; Thence, following along said City of Santa Ana boun- ' dary, N. 0°06'00"W., a distance of 942.54 feet, to the North line of Main Street (80 feet wide), said North line also being on the South line of Prentice Park Territory Annexation to the City of Santa Ana as per Ordinance No. 1269; Thence, following along said South line of said Pren- tice Park Territory Annexation, N. 89°05'30'' E., a distance of 276.69 feet, to the Southeast corner of sa~d Prentice Park Ter- ritory ~nnexat~on, said corner also being the Southwest corner of the "East of Prentice Park Annex" to the City of Santa Ana as per Ordinance No. NS-297; Thence, following along the South line of said "East "N 89°05'30" E , a distance of 329 of Prentice Park Annex, . . feet, to the Southeast corner of said "East of Prentice Park Annex"; Thence, leaving the City boundary of Santa 'Ana and continuing N. 89°05'30'' E., along the North line of said Main Street, a distance of 2,~32 feet, more or less, to the point of beginning. 2. That the City Council of the City of Tustin de- sires to annex said uninhabited territory to· the City of Tus- tin for the following reasons; That the territory is conti- guous to the City of Tustin, and its propo'sed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; wi il provide an area for industrial development for the City of Tustin, and will provide an adequate and broader tax base for the City; will facilit&te and.' contribute to the proper and orderly layout, design and construction of street, gutters, sidewalks, sanitary and storm water sewers, and drainage facil- ities, both wi~t. hin the City' and wi thin the territory proposed to be annexed; and wi±~l provide and facilitate .proper overall planning and zoning of lands, and s.ubdivision of lands in said City and said uninhabited territory, in a' manner most condu- cive to the welfare of said City and said uninhabited territory. That the County Boundary Commission of Orange County, California, did, in session duly assembled, on April 15th, 1963, approve, the proposed annexation boundaries of the said WEST' MAIN STREET ANNEXATION TO THE CITY OF TUSTIN, as above described, and as submitted to said. Commission by the Council Of the City of Tustin. 4. That June 3rd., 1963, at the hour of 7'30 P.M., in the Council Chambers in the City Hall, in the City of Tustin, County of Orange, California, is hereby fi. xed as the time and place when, and where any person owning real property wi thin the uninhabited territory above described and. proposed to 'be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited ter- ritory should not be so annexed to said City of Tustin. Such protests must be in writing, and may be filad.'at any time prior to the final adjournment of the hearing on pro- tests, and shall state the name or names of the owners of property affected, and the street address or other descrip- tion of the property, sufficient to identify it on the last equalized assessment roll. 5. The City Clerk of the City of Tustin is hereby authorized and direct.~d to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in the Tustin News, a ~ewspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange Daily News, a newspaper of general circulation pub- lished outside the City of Tustin, but in the County of Orange, California, the County in which is located the territory pro- posed to be annexed to the City of Tustin, said. publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and direct- ed to cause written notice of suoh proposed annexation to be mai,led to each person to whom land within the territory pro- posed to be annexed is assessed ~n the last equalized county assessment roll available on the date the abOve said proceed~', ings were initiated, at the addresses shown on said assessment roll or known to~.the Clerk, and to any ~erson who has filed his name and address and the designation of the lands' in which he has an interest, either legal or equitable, with th.e Clerk .. su~h~notice to be given not less than twenty (20) ~days be- fore the first public hearing on the proposed a~nexation~ ?. In the event any land within the territory pro- posed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board .of Supervisors of the county', such _ notice to be given not less than twenty (20) days b'efore the first public hearing on the proposed annexation. ,~ 8. In t~'~e event thereis, upon the land porposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proi?,osed annex- ation to be mailed to the governing body of such district, such notice to be sent not less than ten (lO) days before the first public hearing upon such propo'sed annexation. · 9. .The City Clerk is directed, to cause Written notice to be given to such other persons as may be legally · entitled thereto, in the' manner required.
