BE IT RESOL\~D BY TH[i CITY COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provis~ons of the Annexation of Uninhabited Territory Act of 1939, proceedings hKve~,.been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of ~0range, State of California, hereby designated as "BRYAN AVENUE ANNEXATION TO THE CITY OF TUSTIN" and described hereinafter That the City Council hereby finds and deter- mines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the dste of the adoption of this Resolution, and that said territory is contiguous to the City of Tustin. LEGAL DESCRIPTION FOR BRYAN AVENUE ANNEXATION TO THE CITY 0F TUSTIN Beginning at a point on the existing boun- dary line of the Bryan-Red Hill Anne×ation to the City of Tustin as per Ordinance No. 172 passed ~and adopt- ed by the Tustin City Coun. cil on June 4, 1962, said point being on a line parallel to and 40 feet South- westerly of as measured at right angles to the sur- veyed centerline of Bryan Avenue, said point also being on the Southwesterly prolongation of the South- easterly line of Tract No. 1737, as shown on a map thereof recorded in Book 49, Page 43 of Miscellaneous maps, Records of Orange County , California; Thence, leaving Said Bryan-Red Hill Annex- O ation boundary line N. 39 54'37" E. along said South- westerly prolongation and along said SoutheaSterly line of said Tract No. 1737 and along the Northeasterly prolongation thereof, a distance of 1,360.98 feet, to a point on the Southwesterly line of Tract No. 385° ',~ as shown on a map thereof recorded in Book 142, Pages ~'~4 and 45 of Miscellaneous Maps, Records of Orange County, California; Thence, S. 50°00,12" E., along said Southwester- ly line, a distance of 330.18 feet to the most Southerly corner' of said Tract No. 3858, said corner al so being the most Westerly corner of Tract No. 2474 as shown on a map thereof recorded in Book 85, pages 1,2, and 3 of Miscellaneous Maps, Records of Orange County, California; Thence, S..50o00,20'' E.~ along the Southwester- ly line of said Tract N'o. 2474 and the Southeasterly prolongation thereof, a distance of 682.88 feet, to a point on the Northeasterly prolongation of the North- westerly line of Lot 42 of Tract No. 2916, as shown on a map thereof reco~ded in Book 95, pages 8 and 9 of Miscellaneous Maps, Records of Orange Cout~ty, California; Thence,. S. 39°55' 07" W., along said ~.'~ortheaster- ly prolongation, a~.o~:ig said l',!'orthwesterly line of Lot 4,2 and along the Northwesterly line of Lots 41, 40, 39, 38, 37,36, 35, and 34 of said Tract N'o. 29~.6, a distance of 771.80 feet to the most Westerly corner of said Lot 34;· Thence, S. 11"°41'05'' E. along Southwesterly line of Lots 34, 33, 32 and 31 of Said Tract No. 29~.6 a dis- tance of 268.85 feet to an angle point in the Southwest- erly line ~f said Lot 31, said angle point also being a point on the existing boundary line of said Bryan-Red Hill Annexat ion; Thence, following along said Bryan-Red Hill Anne×ation boundary the following courses and distances' N. 49o59'47" W., a distance of 233.21 feet, to an angle point; S. 39°55'25'' %~., a distance of 422.50 feet, to an angle point; N. 49o59,47'' W., a distance of 99.0.24 feet, to the point of beginning. 2. That~the City Council of the City of Tus- tin desires to annex said uninhabited territory of the City of Tustin for the following reasons' The territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the terri- tory proposed to be annexed; will provide an area for industrial development for the City of Tustin, and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm sewers and ~drainage facilities, both within the City and within the territory proposed to be annexed; and will pro- vide and facilitate proper overall planning and zoning of lands, and subdivisions of lands in said City and said uninhabited territory, in a manner .most conducive to the welfare of said City and said uninhabited terri- tory. 3. That the County Boundary Commission of Orange County, California, did, in session duly assem- bled,~on March 18th, 1963, approve the proposed annex- ation boundaries of said "BRYAN AVE~E ANNEXATION T0 THE CITY OF TUSTIN", as above described, and as submitted to said Commission by the Council of the City of Tustin. 4. That .May 6th, 1963, at the hour of 7'30 P.M., in the Council Chambers, City Hall, 145 W. Third Street, City of Tustin, County of Orange, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protests must be in writing, may be fil- ed at any time prior to the final adjournment of the hearing on protests, and shall state the name or names' of the owner or owners of property affected,~ and the st- reet address or other description of the property, suf- ficient to identify it on the last equalized assessment roll. 5. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oft- ncr than once a week, in The Tustin News, a newspaper of general circulat~i, on published in. said City of 5~stin, the City to which it is proposed to annex the afore - said territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, the County in which is l~cated the territory proposed to be annexed to the City of Ui~stin, said publication to be complete at least twenty (20) days prior t0 the date set for hearing. 6~' The City Clerk is further ~uthorized and directed to cause written notice of such proposed a~unex- ation to be mailed to each person to whom land within the territory proposed to be anne×ed is assessed in the~ last equalized County assessment ro-ll available on 'the date the above said proceedings were initiated, at the addresses shown .on said asses?;ment roll or known, to the Clerk, and to any person who has filed his name and add-' tess 'and the designation of the lands in whi-ch he has an interest, ei.ther legal or equitable, with the Clerk., such notice to be given not less than twenty (20). days before the first public hearing on the proposed annex- ation. 7. In the event any ]_and within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written, notice 'of such proposed annex- ation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the pro- posed annexat ion. 8. In the even~ there ts, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less then ten (10) days before the first public hearing upon such proposed anne xa t 1 on. 9. The City Clerk is directed to cause writ- ten notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
