HomeMy WebLinkAboutCC RES 647RESOLUTION NO. 647 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DES- CRIBED HEREIN AND DESIGNATED "WATSON ANNEXATION TO THE CITY OF TUSTIN" AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY TITE CITY COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provisions of the Annexation of Uninhabited Terri.~ory Act. of 1939, pro- ceedings have been initiated by the Council of the City of ~I~stin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of Orange, State of C~.:.~lifornia, hereby designated as "WATSON ANNEXATION TO THE CITY 0F TUSTIN", and des- cribed hereinafter. That the City Council hereby finds and deter- mines that all of said territory is uninhabited within the meaning of Goverment Code Section 35303, on the date of the adoption of this Resolution, and that said ter- ritory is contiguous to the City of ~i~stin. LEGAL DESCRIPTION FOR WATSON ANNEXATION TO T~-~ CITY OF TUSTIN Beginning at a point on the original City Boundary of the City of Tustin, said point being on the surveyed centerline of Yroba Street, distant there- on N. 0°10'30'' W., 356 feet from the surveyed ~enterline of First Street, said point also being an angle point in the boundary line of the Andrew R. Morris Annexation to the City of Tustin as per Ordinance No. 103, passed and adopted by the Tustin City Council on October 1, 1956: Thence, following along said Andrew R. Morris Annexation boundary line, the following, courses and distances ' S. 89°51'45'' W., a distance of 178.00 feet, to an angle poini; N. 0°10'50'' W., a distance of 101.60 feet, ~o am angle point; N. 89°52'45'' W., a distance of 430.20 feet, to an angle point; N. 0°14'45'' W., a distance of 80.46 feet, to an angle point, said angle point also being an angle point in the existing City boundary line of the City of Santa Ana, as per City of Santa Ana Ordinance No. 379; Thence, leaving said Andrew R. Morris Annex- ation boundary line and following along said City boun- dary of the City of Santa Ana, N. 0°14'45'' ~g., a dis- tance of 206 feet, more or less, to the North line of the parcel of land conveyed to Norman E. Watson et al as per deed recorded in Book .5235, Page 378, Official Records of Orange County, California; Thence, leaving said City boundary of the City of Santa Ana, N. 89°52,45'' E., along said North line of Watson property, a distance of 588 feet, more or less, to a point of the West line of Yorba Street (40 feet wide) said point also being an angle point in the Yorb~ Street 3mnexation to 'the City of 2h~stin as per Ordinance No. 135, passed and adoPted by the Tustin City Council on May 9, 1960; Thence, following along s~id Yorba Street Annexation boundary line, N. 89°46,30,, E., a distance of 20.00 feet, to th'e surveyed centerline of Yorba Street, said centerline also being au angle point in the original City boundary of the City of Tustin; Thence, following along said original City boundary S. 0°10,30,, E., a distance of 376.40 feet to the point of beginning. 2. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin for the following reasons' The territory is contiguous to the City of Tustin, and its proposed annexation will contrubute to and facilitate , the orderly growth and development of both the City and the territory proposed ~o be annexed; w~ll provide an area for industrial development for the City of Tustin~ and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of street~, gutters, sidewalks, sanitary and storm water sewers and drainage fa. oi].ities~ both within the City and within the territory proposed to be a~nexed; and will provide and facilitate proper overall planni~ng and zoning of lands, and subdivision of lands in said. City and said uninhabit- , ed territory, in a manner most conducive to the welfare ., of said C~ty and said uninhabited territory. That the County Boundary Commi~slon of Orange County,. California, did, in session duly assem- bled, on March 18th, 1963, approve the proposed annex- ation boundaries of said "WATSON ANA~EXATION TO T~E CITY OF TUSTIlXI", as above described, and as subrr~itted to s~id Commission by the Council of the City of Tustin. 4. That May 6th, 1963, at the hour of 7:30 P.M., in the Council Chambers, City Hall, 145 W. Thiixt Street, City of ~I~stin, County of Orange, Ca!i£ornia, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory abo~ve described and proposed to be annexed to the City of Tustin, and having any objections to the pro- posed, annexation, may appear be fore the CoUncil of the City of Tustin, and show cause why such ~ninhabited territory should not be so annexed to said City of Tus- tin. Such protests must be in writing., may be filed at · ~ any time prior to the final adjourmment of the hearing . on protests, and shall state the name. or names of the owner, or owners of property affected, and th~ street ad- dress o'r other description of the property, sufficient to identify it on the last equalized assessment roll. The C~ty Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a~'.'wee~k,.~in The Tustin News, a news- paper of genersl circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, the County in which is located the terri- tory proposed to be annexed to the City of Tustin, said publication to be complete at least twenty (20) days prior to the date set for ~earing. 6. The City Clerk is further authorized and directed to cause written not ice of such proposed annexation to be mailed' to each person to whom land within the territory proposed to be annexed is ass'essed in the last equalized County assessment roll availa- hle on the date the above said proceedings were init ia- ted, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexat ion. 7. In the event any land within the terri- tory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Sup- ervisors of the county, such not ice ~0 be given not less than' twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land pro- posed to be annex~sd, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10)days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed '1';o cause written notice to be given to such other persons as may be legally ~..ntilted thereto, in the manner re- q. uired by law.
