A RESOLUTION DECLARING THAT PROCEEDINGS
HAVE BEEN INITIATED BY THE CITY COUNCIL
OF THE CITY OF TUSTIN TO ANNEX TO SAID
CITY CERTAIN UNINHABITED TERRITORY DES-
CRIBED HEREIN AND DESIGNATED "FOURTH
STREET ANNEXATION TO THE CITY OF TUSTIN'
AND GIVING NOTICE OF THE PROPOSED ANNEX-
ATION.
BE :IT RESOLVED BY TtTE CITY COUNCIL OF THE
CITY OF TUi~TIN'
1. That, pursuant to the provisions of the
Annexation of Uninhabited Territory Act of 1939, pro-
ceedings have been initiated by the Council of the City
of Tustin, on its own motion, to annex to the C2ty of
Tustin all that un2nhabited territory situate t~n the
County of Orange, State of California, :hereby designa-
ted as "FOURTH STREET ANNE~TION TO THE CITY OF TUSTIN",
and described hereinafter.
That the City Council hereby finds and de~er-
mines that all of said territory is uninhabited within
the meaning of Ooverment Code Section 35303, on the
date of the adoption of this Resolution, and that said
territory is contiguous to the City of Tustin.
LEGAL DESCRIPTION FOR
FOURTH STREET ANNEXATION
TO THE CITY OY.~ TU[STIN
Beginning at an angle point in the existing
boundary line of the Marvin E. Lawrence Annexation to
the City of Tu~tin as per Ordinance No. 173, passed
and adopted by the Tustin City Council on June 4, 1962,
said angle point also being the Southeast corner of Lot
I of Tract No. 4171, as shown on a map thereof record-
ed in Book 150, pages 20 and 21, Miscellaneous Maps,
Records of Orange County, California, said angle point
also being on a line parallel to and 40 feet Westerly
of, as measured at r~ght angles to, the surveyed center-
line of Prospect Avenue;
Thence, leaving said Marvin E. Lawrence Annex-
ation boundary line, S. 0°14, 10" E., along said varal-
lel line, a distance of 601.51 feet, to a line parallel
and 50 feet Southerly of, as measured at r~ght angles
to, the Westerly protongation of the surveyed centerline
of Fourth Street running Easterly from Prospect Avenue;
Thence, N. 89°02'17" E., along s&[d parallel
,line, a distance of 739.09 feet, to a tangent curve, con-
cave Southwesterly, and having a radius of 1,1J0 feet,
said curve being parallel to and 50 feet Southerly of,
as measured radially, to the surveyed centerline of Four-
th Street;
Thence, Southwesterly, along said curve, through
a central angle of 13°37'36" ~
, a distance of 773.50 feet,

to a tangent reverse curve concave Northeasterly and hay-
lng a radiu.s of 1,250 feet, said curve beiu~ p~.~rallel to

surveyed centerline of Fourth Street;

line of Holt Avenue;
Thence, continuing along a line parallel to
and ~0 feet Southerly of, as measured at right angles ~o,
the surveyed 'centerline of Fourth .5treet S. 89°20'19'' E.,
a distance of 649.~ feet, to the North~..~.:est line of Ir-
vine's Subdivision as shown on a map thereof recorded in
Book i, page 88, Mi,scellan.eous Maps, ,Records of Orange
County, California;
Thence, S. ~0°58'~..5" W. along said Northwest
line, a distance of i??.50 feet to the Easterly prolonga-
t~on of the North line marked "Leighy" of the Vanderlip
and Rowan Tract as shown on a map thereof recorded in
BookS', pa[[e 160 of M[soel].aneous Records of Los Ange~les
County, Ca.'l..[fornia, said Easterly prolongation also being
on the existing 'boundary line of the Eas~side Annex-
-atlon to the City of Y~istin as per Ordinance No. 111,
passed and adopted by the Tustin City Council on June
17, 1957;
Thence, following along said Eastside Annex-
ation boundary line the following courses and distances'
S. 89014'40'' W., a distance of 1390 feet, more or
less, to an a~gle point;
S. 0°12'00" W., a distance of 737.25 feet, more or
less, to an angle pbint;
S. 89°46,20'' W,,' a distance ~of 1459.65 feet, more
or less, to an angle point, said angle point also
being the Northeast corner of Lot 1, ~Block 42 of
a part of Tustin as shown on a map thereof re-
corded in Book 13, page 81 of Miscellaneous Re-
cords of Los Angeles County, California, said
angle point also being an angle point in the boun-
dary line of the Claus Annexation to the City of
~stin as per Ordinance No. 101, passed and adopt-
ed by the Tustin City Council on May 28, 1956;
Thence, S. 89°46'20'' W., along the North line
of said Claus Annexation, a distance of 167.50 feet to an
angle point in said Claus Annexation, said angle point
also be~.ng on the surveyed centerline of Prospect Ave-
hue (formerly "E" Street), said angle point also being
on the original'boundary line of the City of Tustin;
Thence, following along the original bound-
ary line of the City of Tustin, the following courses
and distances'
N. 0°14'10'' W., a distance of 33 feet,
to an
angle point;
N.89°46'20'' E., a distance of 25.4 feet to an
angle point

a distance of 784.39 feet to an
angle point;
S. 89°07'50" W., s. distance of 616.17 feet, to~
an angle point;
S. 89°~6'30'' W.~ a distance of 603.86 feet, to an
angle point; said angle point also being the ~iorth-
west corner' of Tract No. 338, as shown on a map there-
of recorded in Book 14, page 51, Miscellaneour Maps,
Records of Orange County, California; said angle

~na, on the existing boundary of the
Yorba Street Annexation to the City of Tustin as
per Ordinance No.. 135, passed and adopted by the
Tustin City Gouncil on May 9, 1960;
Thence, following along said Yorba Str.?.et annex-
ation boundary line, N. 0°10'35'' E., a distance of 722.12
feet to the W'esterly prolongation of the South line of
said Tract No. 4171, said Wester]...y prolongation also
being on the existing boundary of said i'.iarvin E. Law-
rence Annexation Line;
Thence, N. 89030'00'' E. along said Marvin E.
Lawrence boundary line, a distance of 1, i79.22 feet to
the point of beginning.
2. That .the City Council of the City of Tus-
tin desires to annex said uninhabited territory to the
City of Tustin for the following- rea. sons' The territory
is contiguous to the City of Tustin, and its proposed
annexation will contribute to and facilitate the orderly
growth and development of both the City and the territory
proposed to be annexed; will provide an area for indust-
rial development for the City of Tustin, and will pro-
vide an adequate and brsader tax base for the City;
will facilitate and contribute to the proper and orderly
layout, design and construction of streets, gutters,
sidewalk, sanitary and storm water sewers and drainage
facitities, both within the City and within the terri-
tory proposed to be annexed; and will provide and fac-
ilitate proper overall planning and zoning of lands,
and. subdivision of lands in said City and said unin-
habited territory, in a manner most conducive to the
welfare of said. City and said uninhabit'ed' territory.
3. Tha2 ~he County Boundary Commission of
Orange County, California, did, ira. session duly asembled,
on March 11th, 1963, approve, the proposed annexation

boundaries of said "FOURTH STREET A~NE~.~A~ION TO THE CITY
OF TUSTIN", as above described , and as submitted to said
Commission by the Council of the City of T6~tin.
4. That May 6th, 1963, at the hour of 7'3~
P.M., in the Council Chambers, City Hall, 145 W. Third
Street, City of Tustin, County of Orange, California, is
hereby fixed as the time and place when and where any per-
son owning real property within the ~ninhabited territory
above described and proposed to be annexed to the City of
Tustin, and hav~ng any objections to the proposed annex-
ation, may appear before the Council of the City of Tus-
tin, and show cause why such uninhabited territory should
not be so annexed to said City of Tustin, Such protests
must be in writing, may be filed at any time prior to the
final adjournment of the. hearing on protests, and shall
state the name or names of the owner"or owners of pro-
perty affected, and the street addre~s or other descript-
ion of the property, sufficient ot identify it on the last
equalized assessment roll.
5. The City Clerk of the City of ~stin is
hereby authorized and directed to cause a copy of this
Resolution to be published at least twice, but ·not often-
er than once a week, in The Tustin News, a newspaper of
general circulation published in said City of Tustin,
the City to which it is proposed to annex the aforesaid
territory, and also in the Orange Daily News, a news-
paper of general cirmulation published outside.the ~ity
of Tustin, but in the County of Orange, California, the
County in which is located the territory proposed to be
annexed to the City of Tustin, said publication to be
complete at t~ast'twenty (20) dsys prior to the date set
for hearing.
6. The City Clerk is further authorized and
directed to cause written notice of such proposed annex-
ation to be mailed to each person to ~hom land ~within the
territory proposed to be annexed is assessed in the last
equalized County assessment roll available on the date
the above said proceedings were initiated, at the add-
resses shown on said assessment roll or known to the Clerk,
and to any-person who has f~led his name and address and
the designation of the lands i~ which he has am interest,
either legal or equitable, with the Clerk, such notice~to
be given not less than twenty (20) days before the First
public hearing on the proposed anmexatiOno
7. In the event any land within the territory
proposed to be annexed is owned by a county, the City Clerk
is directed to cause written notice of such proposed annex-
ation to be maiiled to the Board of Supervisors of the Court-
ty, such notice to be given not less than twenty (20) days
before the first public hearing on the proposed anuexatlon.
8. In the event there is, upon the land proposed
to be annexed, a structural improvement owned, being ac-
quired or leased by a County Fire Protection District,
the said Clerk is directed to cause written.notice of such
· proposed annexation to be mailed to the governing body of
such district, such notice to be~sent not less than ten
(10) days before the first public hearing upon~such pro-
posed annexation.
9. The City Clerk is directed to cause written
notice to be given, to such o~t-her persons as may be legally
entitled thereto, in the manner required by law.
PASSED AND ADOPTED at the meeting of the City
Council of the City of Tustin, held on the 18th. day of
March, 1963.
