HomeMy WebLinkAboutCC RES 634 RESOLUTION NO. 634 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING THE DECISION OF THE PLANNING COMMISSION GRANT- ING A VARIANCE ON THE APPLICATION OF J.W. HORNBEAK. The City Council of the City of Tustin, Calif- ornia, does resolve as follows' Section _!:_ The City Councll finds and deter- mines that a proper application for varlance was filed on behalf of J.W. Hornbeak for a service station om the property located at th'e southeast corner of Newport Ave- hue and Nission Road, Tustln, California. S.e.ction 2. The Planning Commission duly call- ed, notlced and held a publuc hearing on sa~d applicat- l on and granted the applicant variance subject %o stat~ ed conditions. Sectlon 3_':~ The Applicant filed an appeal from one of the conditlo~ns imposed by said grant of variance, to-wit, that a solid fence or wall be constructed along the southwesterly line of sa~d property, to a height of six feet (6'). Seotio~n 4:_ Tb.e City Councll duly cal!ed, no- riced and held a public hearing on said appeal. The Clty Council finds and deter- mimes that the decision of the Planning Commlsslon grant- lng a variance should be modified and amended to omit the requiremem~t of a fence or wall on ~he southwesterly property line of the subject property, insofar as it would lie within one hundred thirty-six feet (136') of the center line of Newport Avenue; and s,?id decision granting variance is hereby modified by the deletion of said wall recutrement within the aforedescribed area.
