HomeMy WebLinkAboutCC RES 633RESOLUTION NO. 633 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "FIRST STREET ANNEX- - ATION TO THE CITY OF TUSTIN" AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY 0P TUSTiN' 1. That, pursuant to the prow'~.sioN, s of the AnneX- ation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Cou~'~¢il of the City of Tustin, on its own motion, to annex to the County of Orange, State of Calif- ornia, hereby designated as "FIRST STREET AN}~XATION 0P TN~E CiTY 0P TUSTiN" and described hereinafte~ Beginning at an angle point in the existing city boundary of the City of Tustin, as per Bryan- Red Hill annexation annexed in accordance with Ordinance No. 172, dated June 4,1962, said angle }point b~eing the center of Lot 16, Block 12 of Irx~ine's Subdivision ss shown on a Map thereof recorded in Book l, Page 88, Miscellaneous Naps, Records of Orange County , california; Thence, leaving said existing City Boundary, N. 39°59'20'' E. along the Northwest line of the Eas~ one-quarter of sa~.d L0tl6, a dis.tahoe of 660 feet, more or less, ~o the most northerly corner of said East one-quarter; o Thence S. ~0 00'40" E. along the Northeast line o£said East one-quarter, a distance of 660 feet, more or ].ess, to the most Easterly corner of said East one-quarter, said cor~er also being a point on said City of Tusti~ Boundary linde; Thence, following along said City Boundary line S. 39°~9'20" W., a distance of 660 feet, 'more or less, to am angle point; Thence, continuing along said City Boundary 177 line N. 50o00,23'' W., a distance of 660.86 feet to the point of beginning. That the City Council hereby finds and deter- mi~es t~h~t ~ll of said territory is uniuh~bited within the meaning of Goverment Code Section 35303, on the date of the ~doption of this Resolution, and that said territory ~s contiguous to the City of Tustin. 2. That the City Council of the City of Tustin desires to annex saiduninhabited territory to the City of Tustin for the following reasons' The Territory is contiguous to the City of Tustin, and its proposed annex- ation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will provide an area for in- dustrial development for the City of Tu~tin, and will provide an adequate and broader ta× base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both~.within the City and within the ter- ritory proposed to be annexed; and will provide and -~'. facilitate proper overa]i.], planning and zoning of lands, and subdivisions of lands in said City and said umin- habited territory, in a manner most conducive to the welfare of said City and said ~ninhabited territory. 3. That the County Boundary Commission of Orange County, California, d~id,, in session duly assem- bled, on January 7th,1963, approve the proposed annex- at ion boundaries of said "FIRST STREET Ak~XATION OF THE CITY OF TUSTIN" 0 ~ as above described, and as sub- mitred to said Commission by the Council of the City of Tustin. That Monday February 18th,1963, at the hour of ~'30 P.M., in the Council Chambers of Orange, California, is hereby fixed as the time and place when and where any person owni~ ~ real property within the Uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation~ may appear before the Council. of the City of Tustin, and.. show Cause why such uninhabited territory should not be so annexed to said City of TuStin. Such pro~ests must be in writing, may be filed at any t~rn, e prio~~ to the final adjournment of the hearing on protests, and shall state the name or names of the owner or owners · of property affected, and the street address or other des- cription of the property, sufficient to ~identify it on the last equalized assessment roll. 5. The City Clerk of the City of Tustin is here- by authorized and directed to cause a copy of this Resol- ution to be published at least twice, but not oftener than once a week, i~ The T. ustf~.u News, a newspaper of general cir- culation published in said City of Tustim, the City to which it is proposed to annex the aforesaid territory, and · z ~,1 cir also in the Orange Daily News, a newspaper of ge~e~a - cu!ation published out side the City of Tustin, but in the County of Orange, California, the County in which is located the territory proposed to be annexed to the City of Tustin, said .pub!ications to be complete at least twenty (20) days prior to the date set for heari)~g.. 6. The City Clerk is further authorized and di- rected to cause written notice of such proposed annexation to be mailed to each person to whom land within the terr- itory proposed to be annexed is assessed in tl~e last equal- ized county assessme~t roll available on the date the above said proceeding were initiated, at the addre~.~ses shown on said assessment ro'll'or known to the Clerk, and to any person who has :filed his name and address and the designation, of tb.e lands in which he bas am ~nterest, either legal or equitable, with the Clerk,-~:s~ch notice to be given not less than twenty (20) days before the first public hearing on the proposed 7. In the event any ]_and within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written ~.otice of such proposed 179 annexation to be mailed to the Boar~ of Supervisors of the county, st~ch notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land pro- posed to be annexed, a structural improvement owned, being acquired or ].eased by a county fire protection district, the said. Clerk is directed to cause written notice of such proposed a~nexation to be mailed to the gover.~iu~. ~ body~ of s~ch. district, such notice to be sent not less than ten (10) days be fore the £irst public he~,rin~ upon such ~a~oposed anne-~ ~ation 9. The City Clerk is directed to csuse writ- ten notice to be given to such other per~ons ~s may be legally entitled thereto, in the manner required by law.
