HomeMy WebLinkAboutCC RES 618RESOLUTION NO. 618 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNIN~ HABITED TERRITORY DESCRIBED HEREIN' AND DESIG- NATED "NEWPORT AVENUE ANNEXATION TO THE CITY OF TUSTIN" AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE I~ RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, porceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all ths. t uninhabited ter- ritory situate in the County of Orange, State of California, he re- by designated as "NEWPORT AVE~ ANNEXATION ~.0 THE CITY OF TUSTIN", and described hereinafter. That the City Council hereby finds a~d determines that all of said territory is uninhabited within the meaning of Govern- ment Code Section 35303, on the date of the adoption of this Re- solution, and that said territory is contiguous to the City of Tustin. ST!,N, , · Those portions of blocks 7, 8, 9, 10, and 11 of Irvine's Subdivision in the County of Orange, State of California, as said subdivision is shown on a map recorded in Book 1, page 88 of Mis- cellaneous Record Maps in the office of the county recorder of said county, described as follows Beginning at a point in the boundary line of the City of Tustin as establ'ished by the South Tustin Avenue annexation, CI~Y~ of Tustin Ordinance No. 136, said point being distant South 50' E East 320.00 feet fromm the northwesterly line of said block 11; thence south 50" East 340.00 feet along said City of Tustin boundary line to a poi~.t in a line that is parallel with and dis- tant South 50" East 660.00 feet from said northwesterly line of block 11; thence leaving said Cit~ of Tustin boundary line South 40e West 4060 feet; more or less, along said parallel line to an intersection with the southwesterly line of lot 81, said block 10; thence South 50~ East 1320 feet along said southwesterly line and the southerwesterly line of lot 82, said block 10 to a point in a line that is parallel with and d~'t'i~tant southea$.~erly 1980 feet measured at right angles from the northwesterly line of s~ld block 10; thence South 40e West 7260 feet, more or ~less, along said parallel l~ne to a point in a line that is parallel with and distant southwesterly 660.00 feet from the southwesterly line of said block 9; thence North 50° West 1320 feet more or less, to a point in a line that is parallel with and distant southeasterly 660 feet mea- sured at right angles from the northwesterly line of said block 8; thence South 40° West 5340 feet, more or less, along said parallel line to a Point lying South 40° West 710feet from the southwesterly line of said block 8; thence North 68° 478 00" West 640 feetm more or less, ~. (basis of hearinE being North 40° East for the northwest- erly line of block 7 of Irvine's Subdivision ) to an angle point in the boundary line of the City of Sosta Mesa as estiblished by City of Costa Mema Ordinance No. 302; said angle point lying in a line that is parallel with and distant southwesterly 30 feet measured at right angles from the northwe~sterly line of block 7 and lying also in a line that is. parallel with and ~istant West 50 feet measured at right, angles from the South prolongation of the centerline of Main Street, 83 feet wide; thence North 98.93 feet, more or less, along the last mentioned parallel line being also the boundary line of the City' of Costa Mesa as per said Ordinance No. 302 to a point which bears West 83 feet from an angle point in the boundary line of the City of Santa Aha as established by City of Santa Ana Ordinance No. NS-320, said angle point lying in said parallel line that is parallel with and distant southeasterly .30 feet measured at right angles from said northwesterly line of block 7, said angle point being .also the most southerly corner in the boundary line established by said Ordinance No. 320; thence leaving the boundary line of the City.of Costa Mesa as established by said Ordinance No. 302 East 83 feet to said angle point in the boundary line of the City of Santa Aha as established by said Ordinance No. NS-320; thence North 40° East 6060 122. feet, more or less, along last mentioned parallel line's,, also being the boundary line of the City of Santa Aha as establish- ed by said Ordinance No. NS'320' to an intersection with the southwesterly line of lot 116, said block 9; thence leaving said boundary line of the City of Santa Ana as Established by said Ordinance No. NS-320 South 50° East 1290 f'eet, more or less, along said southwesterly line to the most southerly corner of said lot ll6; thence North 50° West 1290 feet, more or less, along the. northeasterly line of said lot 116 t0 an intersection with a line that is parallel with and ~lstant southeasterly 30 feet measured at right angles from the nor- thwesterly line of said block 9; thence North 40° East 2793.45 feet, more or less, along said parallel li..ne to an angle point in the boundary line of that certain l~nd described in a deed to the State of California recorded February 15, 1962 in Book 6009; page 427 of Official Records of Orange County, C~.lif- ornai; thence along said State of California boundary line the following courses and distances; South 49° 20' 48" East 16.00 feet; North 40° 39' 12" East 95O~,00.feet; South 67° 34' 11" East 372.71 feet; South 58° 06' 37" East 328.17 feet; North 40° 39' 12" East 100.00 feet; · North 51° 02' 08" West 678.65 feet; North 40° 39' 12" East 1291.13 feet to an~ inter- section with the southwesterly line of lot 81, said block 10; thence North 49° 20' 48" West 16.00 feet along said State of California boundary line being also said southwesterly line of lot 81 to an intersection with the southeasterly right of way ~ine of Newport Avenue, 60.00 feet wide, as shown ~n a map recorded in Book 34, page 17 of Record of Surveys, said intersection being also on angle point in said State of California boundary line; thence leaving said State of Calif- ornia boundary line North 39° 48' 55" East 3510 feet, more or less, along said southwesterly right of way line to an intersection with the southerly right of way line of Edinger Street, 80.00 feet wide, as described in an Easement Deed to the County of Orange recorded September 7, 1960 in Book 5406~ page 473 of Official Records of Orange County , California thence North 84° 49' 02" East 28.28 feet along said southerly r~ght of way line; thence South 50° 10' 50" East 270 feet, more or less, along ~he southwesterly r~ght of way line of said Edinger Street to a point that is distmnt' southeaste~ly . 320 feet measured at right angles from the northwesterly line of s~id block 10 and South 40° Nast 530.00 feet from the point of beginning; thence North 40° East 530.00 feet paral- lel to said northwesterly line ~o ~he point of beginning. 2. That the City Council of the City of Tustin d~- sires to mZ~le~xsaid uninhabited territory to the City of Tustin for the following r~.asons: The territory is contiguous to the City of Tustln, and its proposed annexation will contri- ~ bute to and facilitate the orderly growth and developement of both the City and the territory proposed to be annexed; will provide an asea for industrial development for the City of Tustin, and will provide an adequate and broader tax ~ase for the City; will facilitate and contribute to the proper and orderly layout, desi~ and construction of streets, gut- ters, sidewalks, sanitary ~nd storm water sewers and dmainage facilities, both within the City and within the territory proposed to be annexed; hnd?~.will provide and facilitate pro- per overall planning and zoning of lands, and subdivision of , lands in said City and s~ld uninhabited territory, in a man- nermost conducive to t~h~ welfare of said City and said uninhab- ired territory. 3. Theft the County Boundary Commis~ion of Orange County, California, did, in session duly assembled, on Men- day, October 15, 1962, approve the proposed annexation bound- arie.s of said "NEWPORT AVENUE ANNEXATION TO THE CITY OF TUSTIN" as above described, an~ as submitted to said Commission by the Council of the City of Tustin. 4. That Tuesday, December 11, 1962, at the hour of 7:30 P.M., in the Council Chambers in the City H~ll 145 west Third St., Tustin, County of Orange, California, is ~124. hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the Clty~ef Tustin, and having any objections to the proposed annexation, may ap- pear before the Council of the City ef Tustin, and show c~use why such uninhabited territory should not be in writing, may be filed at any time prior to t'he final adJour~m~t of the hearing on protests, and shall state the mame~ or names of the owner or owners of property affected, and the street address or other description of the property, sufficient to identify~it on the last equalized assessment roll. 5- The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in the Tustin News, a newspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange ~aily News, a newspaper of general circulation published outside the City 0 of Tustin, but in the County of O~ange, California, the County in which is located the territory proposed to be annexed to the City of Tustin, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. ~he City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory prope~ed to be annexed is assessed in the last equalized county assessment~ roll avialable on the date the above said ~proceedings were in- itiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and a~- ress and the designation of the lands in which he has an in- terest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed .., to the Board of Supervisors of the county, such notice to , be'given not less than twenty (20) days before the first public hearing on the proposed annexation. 8, In the ~vent there is, upon the land proposed to be annexed, a structural improvement owned, being ac- quired' or leased by a county fire protection district, the said 8lerk is directed to cause written notice of such pro- posed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The. City Clerk is directed, to o~use written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
