A RESOLUTION DECLARING THAT PROCEEDINGS HAVE
BEEN INITIATED BY THE CITY COUNCIL OF THE CITY
OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UN-
INHABITED TERRITORY DESCRIBED HEREIN AND DESIG-
NATED "RED HILL ANNEXATION OF THE CITY OF
TUSTIN" AND GIVING NOTICE OF THE PROPOSED ANNEX~
ATION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN:
That, pursuant to the provisions of the Anne~-
ation of Uninhabited Territory Act of 1939, proceeding have
been initiated by the Council of the City of Tustin, on its
own motion, to annex to the City of Tustin all that unin-
habited territory situate in the County of 0rnage, State
of California, hereby designated as "RED HILL ANNEXATION
TO THE CITY OF TUSTIN" and described hereinafter

That the City Council hereby finds and determines that
all of said territory is ~uinhabited within the meaning of
Government Code Section 35303, on the date of the adoption
of this Resolution, and that said territory is contiguous
to t~e City of Tustin. '

Those portion of block 9,10,and 11, of Irvine's
Subdivision in the County of Orange, State of California,
as said subdivision is shown on a map recorded in Book 1,
page 88 of Miscellaneous Record Maps in the office of the ('j:o~.;
county recorded of said county described as follows:
Beginning at a point in the boundary line of the
City of Tustln as $.~tabllshed by the South Tustin Avenue
Annexation , City of Tustin Ordinance No. 136, said point
being distant South 50' East 660.00 feet from the northwest-
erly line of said block 11; thence South 50~ East 343.23
feet along sa~id City of Tustin boundary line; thence leaving
said City of Tustln blindary line South 40e Wear 150.00 feet
parallel to said northwesterly line .of block 11 to the point
of beginning in the boundary line of that certain parcel of
land conveyed to John M. Robert son in a deed recorded March
2, 1962 in Book 6025, page 580 of 0ffic~al Records of Orange

County, California; thence North 58~ 58' 41" Wes~t 40.73 feet
along said Robertson boundary line ; thence South 39~ 48' 55"
West 373.77 feet along said Robertson boundary line and the
Southwesterly prolongation thereof to an intersection with
the southwesterly riEht of way line of Edinger Street, 80.00
feet wide, as described in an Easement Deed to the County of
Orange recorded September 7, 1960 in Book 5406, page 473 of'
Official Records of Orange County, California; thence South

westerly roght of way line to an intersection with the south-
~'asterly line of lot 65, said block 10; thence South 40~' west
2240 feet, more or less, along said southeasterly line and the
southwesterly prolongation thereof to an intersection with the
southwesterly right of way of Valencia Avenue, ~i!'~60.00 feet
wide, as shown on map recorded in Book 3~, page 17 of Record
of Surveys; thence South 50 ~ 09' 55" East 1350.48 feet, more
or less, along said southwesterly right of way line and the
southwesterly prolongation thereof to an intersection with

the southeasterly right of way line of Red Hill Avenue, 60.00
feet wide, as shown on a map recorded in Book 12, page 43 of
Record of Surveys; thence South 40~ West 7890 feet, more
less, along said southeasterly right of wa'M line to an inter-
section with the sOUthwesterly line of said block 9; thence
North 50~ West 690 feet, more or less, along said southwesterly
line to a point in a line that is parallel with and distant
southeasterly 1980 feet measured at ~ight angles from the
northwesterly line of said block 9; thence Morth 40~ East
6600 feet, more or less, along said parallel line to an
intersection with the southwesterly line of lot ~82, said
block 10; thence Norb~',t 50" West 1320 feet, more or less, along
said southwesterly line and the s~uthwesterly llne of lot 81,
said block 10, to a point in a line that is parallel with and
distant southeasterly 660.00 feet measured at right angles from
the ~orthwesterly line of said block 10; thence North 40s
East 4060 feet, more or less, along said parallel line to the
point of beginning.

2. That the Cl'ty Council of the City of .Tustln
desires to annex said uninhabited territor~ to the City
of Tustln for the following reasons: The territory is con-
tlguous to the City of Tu~tln, and its proposed annexation
will contribute to and facilltat.e the orderly growth and de-
velopement of both the City mhd the territory proposed to
be annexed; will provide an~.area for industrial dewelopment
for the City of Tustin, and will provide an' adequate and
broader tax base for the City; will facilitate and contri-
bute to the proper and orderly layout, desing and construc-
tlon of streets,, gutters, ~ldewalks, s~nitar y and storm
water sewers and drainage facilitate proper overall pl. anning
and zoning of lands, and subdivision of lands in said City
and said uninhabited territory's, in a manner most conducive
to. the welfare of said City and said uninhabited territory.
3. That the County B~undary Commission of Orange
County, California, did, in session duly assembled, on Mort-
day, October 15,1962, approve the proposed, annexation boun-
darles of said "RED HILL ANNEXAEION OF THE CITY OF TUSTIN",
as' a~ove described, an~ as submitted to said Commission by
the Council of the City of Tustln.
4. That Tuesday, December 11,1962, at the hour
of 7:~0 P.M., in the Council Chambers in the City Hall, 145
West Third St., in the City of Tustln, County of Orange, Cafif-
ornia, is hereby fixed, as the time and place when and where
any person owning real property within the uninhabited terri-
tory above described and proposed to be annexed to the City
of Tustln, and having any abJ'ections to the proposed annexa-
tion, may appear before the Council of the City of Tmstin, and
show cause why such uninhabited territory should ~ot be so
annexed to said Cit.y of Tustin. Such protests m~mt. be in
writing, may be filed at any prior to the final adJourmment
of the hearing on protests, and shall state the name or names
of the owner or owners of proD~rty affected, and the .street
address or other description of the property, sufficient to
identify it on the last ~**qualized assessment roll.

5. The City Clerk ~f the City of Tustin is hereby
authorized and directed to cause' a ¢~p~. o.f this Reso~tion to
be published at least twice, but not oftener than once a week,
in ~he Tustin News, a newspaper .of general circulation pub-
lished in said City of Tustin, the City to which it' is pro-
posed to annex the aforesaid territory, and also in the Orange
Daily News, a newspaper of general circulation publihsed out-
side the City of Tustin, but in the County of Orange, Calif-
ornia, the County ~n which is located the territory proposed
to be annexed to the City of Tustin, said publication to be
complete at least twenty (.20) days prior to the date set for
hearing.
6. The City Clerk is further a~horized and direct-
ed to cause written notice of such proposed annexation to be
mailed to each person to whom land within the territory pro-
posed to be annexed is assessed in the last equalized county
assessment .roll available on the date .the above said proceed-
ings were initiated, at the addressem sho..wn on: .~aid assessment
roll or known to the Clerk, and to any person who has filed
his name and address and the designation of. the lands in which
he has an interest,
either legal or equitable,
with the Clerk,
such notice to be. given not less than twenty (20) days be-
fore the first public hearing on the proposed annexation.
7'. In the event any land within the territory pro-
posed to be annexed is owned by a county, the City Clerk is
directed to cause written notice of such proposed annexation
to be mailed to the Board of Supervisors of the county , such
notice to be given not less than twenty (20) days be.fore the
first public hearing on 'the proposed annexation.
8. In the event there is, upon the land proposed to
be annexed,, a structural improv.ement owned, being acquired or
leased by a county fire protection district, the said Clerk is
directed to cause written notice of. such proposed annexation
to be mailed to the governing body of such district, such
uotice to be sent not less than ten (10) days before the first~
public hearing upon such proposed aunexation.

9- The City Clerk is directed to cause written
notice to be given to such other person~ as may be legally
entitled thereto, in the manner required by law.
