HomeMy WebLinkAboutCC RES 607RESOLUTION NO. 607 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 2808 OF THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931, DIVISION 4 OF STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, the City CoUncil of the City of Tustin, California, has re- ceived a communication from the Health Officer of the County of Orange, who is also the Health Officer of the City of Tustin, which communication is in words and figures as follows' "Honorable City Council of the City of Tustin 145 West Third Street Tustin, California 6-25-62 Gentlemen' "As Health Officer of the City of Tustin and of the · County of Orange, I hereby recommend that proceedings be instituted at once by the City of Tustin for the con- struction of sanitary sewers in the area hereinafter described, which said area is located both within the City of Tustin and within the County of Orange, adjacent to the City territory; "AREA l' That certain area bounded on the north by Fourth Street; on the west by the Newport Freeway; on the south by the ~Santa Ana Freeway; and on the east by the Newport Avenue; and "AREA 2' That certain area bounded on the west by Newport Avenue; on the south by Mitchell Avenue; on the north by Bryan Avenue; and on the east by Red Hill Avenue. "All of the said area which is now developed or rapidly developing is entirely serviced by cesspools and septic tanks. 'This recommendation is made as a measure necessary for the protection of public health and is also made pur- suant to Section 2808 of the Streets and Highways Code of the State of California. ~We have made an investigation of the sanitary con- dictions in this area of the City and County territory, and we have found that the residents therein have been and are experiencing difficulties with their individual sewage dis- posal systems. WHEREAS, the said City Council has duly considered the said communication and has received information from the Engineer of Work and the City Engineer with reference to the proposed sewer improve- ment referred to in said communication; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORN'IA, does hereby RESOLVE, DECLARE, FIND, DETERMINE AND ORDER as follows' Section.l: That the improvements referred to in said communication above quoted are the construction of sanitary sewers in streets, rights-of-way and easements iu,the proposed assessment district to be known as :TUSTIN CITY SEWER ASSESSMENT . DISTRICT NO. 1. ~ Se...ct ion 2- That the said City Council does hereby find and determine that the acquisition of easements and rights-of-way necessary for and the construction of said sanitary sewers and all incidental work in connection therewith, and each of them, is necessary as a health measure and such necessity for such acquisition and construction is hereby found to exist. Section ~' That the City Clerk is hereby authorized and instructed to spread the contents of said original com- munication from the County Health Officer, and the ex-officio City Health Officer, upon the minutes of this meeting of the said City Council at which this resolution is adopted. ,Seot. ion 4' That this resolution is adopted pursuant to the provisions of Section 2808~of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931,~ Division 4 of the Streets and Highways Code of the State of California, and the said City Council, in adopting the same, intends to meet each and every conditiOn and to make each and · every finding necessary on its part in order to permit the proceedings for said sewer improvements to go forward to completYon ~without further reference to or application of the provisions of said Division 4 of the Streets and Highways Code. 1962.
