HomeMy WebLinkAboutCC RES 606 RESOLUTION NO. 606 RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN, AND DESIGNATED "JOHN JACOBS ANNEXATION" TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the · County of Orange, State of Californ~, hereby designed as "JOHN JACOBS ANNEXATION" and described as follows' Beginning at the Southwest corner of Lot F' of the Stafford and Tustin Tract as shown on a m~0 thereof recorded in Book 2, pages 618 and 619; Miscellaneous Records of Los Angeles County, California, said corner also being an angle point in the "South Tustin Avenue Annexation" as per Ordinance No. 136, passed and adopted by the Tustin City Council on July 5, 1960; Thence, leaving said "South Tustin Avenue AnnexatiOn" boundary and running N. 0°41'01~' E. along the West line of said Lot F, a distance of 660.23 feet to the North line of the South one-half of said Lot F; Thence, S. 89°44'04'' E. along said North line, a distance of 273.48 feet to the Southwest right of way l~.ne of the Santa Aha Freeway as established by instrument recorded on August 16, 1954 in Book 2793, page 423. of Official Records of Orange County, California; ~ Thence, S. 39°18'49~' E. along said Southwest line, a distance of 174.10 feet to an angle point in said South- west line, s~id point also being on the West right of way line of the Newport Freeway as recorded on May 12, 1961 in Book 5724, page 681 of O~icial Records of Orange County, California; O Thence, S. 49 10' 02" E. along said West line, a distance of 84.52 feet to a point on the West line of said ~South Tustin Avenue Annexation. ' Thence, following said "South Tustin Avenue Annexation~' boundary, the following courses and distances' S. 0°41'01' W., a distance of 471.07 feet to an angle point; Thence, N. 89°44'04" W. a distance of 450 feet to the point of beginning. 2. That the Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin for the following reasons' The terdtory is contiguous to the City of 78. Tustin, and its proposed annexation will contribute to and. facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and con- struction of streets, gutters, sidewalks,, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will .pro- vide and facilitate proper overall planning and zoning, of lands, and subdivision of lands in said City and said unin- habited territory in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That if said territory is annexed, it shall become part of the Tustin School District. 4. That the Boundary Commission of the County of Orange, State of California, did, in session duly assembled on May 21, 1962, approve the proposed annexation boundaries of said ~JOHN JACOBS ANNEXATION", as above des- cribed. 5. That MOnday, July 23rd., 1.962, at. the hour , of 7'30 o'clock, P.M., in the C;ouncil Chambers, City Hall, l~5 West Third Street', Tustin, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objeCtiOns to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protest must be in writing, may be filed at any time before the hOur set for hearing objections to the proposed annexation, and shall state the" names or name of the owner or owners of property affected, and the description and area of such property, in general terms. 6. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this [~esolution to be published at least twice, but not oftener than once a week, in the Tustin News, a newspaper of general . 79. circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, a. nd also in the Orange Daily News, Orange, California, a newspaper of general cir- culation published outside the City of Tustin, but in the County of'Orange, California, the County in which is located the ter'r'itory proposed to be annexed to the City of Tustin, said publication to be complete at least twenty {20) days prS. or to the date set for hearing. 7. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation, of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event any land within the territory pro- posed to be annexed is owned, by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such nc~ice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 9. In the event there is, upon the land. proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Clerk is directed to cause written notice to be given to such other persons as may be legally · 80. entitled thereto, in the manner required by law.
