HomeMy WebLinkAboutCC RES 580RESOLUTION NO. 580 RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "MC FADDEN-NEWPORT ANNEXATION", AND GIVING NOTICE OF THE PROPOSED ANNEXATION" BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN: 1. That, 'pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin, all that un- inhabited territory situate in the County of Orange, State of California, hereby designated as "McFADDEN-NEWPORT ANNEXATION" and described as follows: Beginning at an angle point in the bounda, ry line of the SOUTH TUSTIN AVENUE ANNEXATION as described in Ordinance No. 1~6, passed and adopted by the City Council of ~ustin on July 6~, 1960, said angle point ~ears S. 89 ~0'%9" E. ~%$. feet from the northwest corner of the southwest one quarter (l/l+) of Lot "M" as shown on a map of "Stafford and Tustin Tract," recorded in Boo~ 2, pages 618 and 619, Miscellaneous Records of Los Angeles County, California, said north- west corner also being an angle point in the boundary line of said SOUTH TUSTIN AVENUE ANNEXATION; Thence, departing from said city boundary, S. 89°~0'59'' E. along the said north line of the southwest one quarter (1/$) of said Lot "M", a distance of ~1~.26 feet to the west line of Tract No. ~2%0, as shown on a map thereof recorded in Boo~ l%l, pages 1% and 16 of Miscellaneous Maps~ Records of Orange County, California; Thence, N. 0°$~'$7'' E. along the west line of said Tract No. $2~0, a distance of %~0.5~ feet to the north~ west corner of said Tract No. ~2%0; Thence, S. 89°29'~3'' E. along the north line of said Tract No. ~2%0, a distance of 80~.9% feet to the north- east corner of said Tract No. $2%0; Thence, S. O°$~'$0'' W. along the east line of said Tract No. ~250, and the southerly prolongation thereof, a distance of 1,116.92 feet to a line parallel to and ~0 feet southerly of, as measured at right angles to, the surveyed centerline of McFadden Street; Thence, S. 89°~1'32" E. along said parallel line and the easterly prolongation thereof, a distance of 6~0.72 feet to a line parallel to and %0 feet south- easterly of, as .measured at right angles to, the surveyed centerline of Newport Avenue, sixty feet wide; O Thence, N. $0 38'32" E. along said parallel line, a dis- tance of 60.89 feet to the northeast line of the southwest one half (1/2) of Lot $8 of Plot l, Ranchos Santiago De Santa Aha and San Joaquin as shown on a map thereof recorded in Book ~, page 7 of Miscellaneous Records of Los Angeles, California~ also shown on Ma'p of Irvine's Subdivision, recorded in Miscellaneous Maps, Book l, page 8.8, records of Orange County~ California; Thence, S. ~9°21'28" E. along said northeast line, a distance of 1270.0 feet to the easterly corner of said southwest one half (1/2) of Lot $8; Thence, S. $0°38'32'' W. along the southeast line of said southwest one half (1/2), a distance of 620.0 feet to a line parallel to and ~0 feet northeasterly of, as measured at right angles to, the surveyed center line of Walnut Avenue, sixty feet wide; Thence, N. $9°21'28'' W. along said parallel line and northwesterly prolongation thereof, a distance of 1,370.0 feet to a line parallel to and 50 feet northwesterly of, as measured at right angles to~ the surveyed center line of Newport Avenue, sixty feet wide; O Thence, $. ~0 38'32" W. along said parallel line, a distance of 930.5~ feet to a point in the boundary line of said SOUTH TUSTIN AVENUE ANNEXATION; Thence, westerly and northerly following along the boundary line of said SOUTH TUSTIN AVENUE ANNEXATION the following courses and distances: Thence~ N. ~l°O0'O0'' W., ~7.?0 feet to angle point in said boundary; Thence, N. 89°$1'32,, W., 76.52 feet to angle, point in said boundary; Thence, N. l°09'l~'' E., 805.0 feet to angle point in said boundary; Thence, N. 89°$1'32" W. ~ll.8 feet to angle point 'in said boundary; Thence, N. O°~l'O1'' E., 580.5~ feet to angle 'point in said boundary~ and the point of beginning. 2. That the Council of the City of Tustin desires to annex said uninha, bited territory to the City of Tustin for the follow- ing reasons: The territory is contiguous to the City of Tustin~ and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, guttam, sidewal~s, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and faci- litate pro'per overall planning and zoning of lands, and sub- divisions of lands in said City and said uninhabited terri- tory, in a manner most conducive to the welfare of said City and said uninhabited territory. That if said territory is annexed it shall become part of the Tustin School District. That the County Boundary Commission of Orange County, California, did in session duly assembled on November 6, 1961, ap~rove the pro'.posed annexation boundaries of said "McFADDEN-NEWPORT ANNEXATION" as above described. That Monday, March %, 1962, at the hour of 7:30 o'cloc~ P.M., in the Council Chambers, City Hall, 155 West Third Street, Tustin, California, is hereby fixed as the time' and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protest must be in' writing,, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the names or name of the owne~.s or owner of pro'perty affected, and the descri'ption and area of such property, in general terms. 6. Th.e City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Tustin News, a newspaper of general circulation published in said Gity of Tustin, the city to which it is proposed to annex the aforesaid terri- tory~ and also in the Orange Daily News, Orange~ California~ a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, the county in which is located the territory proposed to be annexed to the City of Tustin, said publication to be completed at least twenty (20) days 'prior to the date set for hearing. ?. The City C ler~ is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated~ at the addresses shown on said assessment roll or ~nown to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hear- ing on the proposed annexation. 8. In the event any land within the territory proposed to he annexed is owned by a county~ the City Cler~ is directed to cause written notice of such proposed annexa- tion to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 9. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire 'protection district, the said Cler~ is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district~ such nGtice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Cler~ is directed to cause written notice to be given to such other persons as may be legally entitied' there.to, in the manner required by law.
