RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN
INITIATED BY THE COUNCIL OF THE CITY OF TUSTIN
TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRI-
TORY DESCRIBED HEREIN AND DESIGNATED "B. F.
BESWICK SCHOOL ANNEXATION" TO THE CITY OF TUSTIN,
AND GIVING 'NOTICE OF THE PROPOSED ANNEXATION
BE IT RESOLVED BY THE ~COUNCIL OF THE CITY OF TUSTIN:
1. That, pursuant to the ·provisions of the Annexation
of Uninhabited Territory Act of 1939, proceedings have been in-
itiated by the Council of the City of Tustin, on its own motion,
·
to annex to the City of Tustin all that uninhabited territory
situate in the County of Orange, State of California, hereby
designated as "B. F. BESWICK SCHOOL ANNEXATION", and described
as follows'
Beginning at the most southerly corner of Lot 53 as
shown on a map of Tract No. 2747, recorded in Book
82, pages 19 and 20, of Miscellaneous Maps, Records
of Orange County, California, said southerly corner
also being an angle point in the boundary line of
Pankey Annexation to the City of Tustin as per Or-
dinance No. 99 passed and adopted April 23, 1956:
Thence, following along said Pankey Annexation boundary
the following courses and distances as per said Ordinance
No. 9~: ~N- 39°50'44~ E. 67.00 feet to angle point; thence,
S.~50 09'30" E. 20.00 feet to angle point; thence, N.
39~50' 44" E. 941.78 feet to easterly corner of Lot 39,
said Tract No. 2747, said corner also being an angle
point in said Pankey Annexation boundary line;
Thence, continuing easterly following said Pankey
boundary line, along a curve concave to the southwest
(a radial line passing through said corner of Lot 39,
bears S. 25°09'37~ W.) havin~ a radius of 4880.0 feet
through a central angle of2~26'19" an arc distance of
207.66 feet to beginning of a tangent curve concave to
the southwest, having a radius of 1972.00 feet, through
a central angle of 11°21'23", an arc distance of 390.86
feet to a point;
Thence, tangent S. 51°00'00" E. 123.00~ feet to a tangent
curve concave southwesterly; thence, southwesterly along
said curve having a radius of 472.00 feet, through a
central angle of 3°29'51" and arc distance'of 28.81 feet
to the most easterly.corner of Tract No. 4251, as shown
on a map thereof recorded in Book 152, pages 13 and 14,
Miscellaneous Maps, Records of Orange, County, California;
Thence · departing from said Pankey Annexation boundary ~
line, ~. 39°51'27" W. along southeasterly line of said
Tract No. 4251 and the southwesterly prolongation thereof,
a distance of 1,169.16 feet, .to the southwesterl~ line
of MStchell Avenue (66 feet wide); thence, S 50o09'30"
E., along said southwest line of Mitchell Avenue, a
distance of 330.45 feet to the intersection of the
southeasterly line of the northwesterly one-half (1/2)
of the easterly one-quarter (1/4) of Lot 47 of Block ll
of Irvine Sub-division as shown on a map thereof recorded in
Book l, page 88, Miscellaneous Maps, Records of Orange County,
California; thence, S. 39o49'22" W. along said southeasterly
line, a distance of 627.60 feet, to the southerly corner of
the northwest one-half (1/2) of the easterly one-quarter (1/4)
of said Lot 47; thence, N. 50o09'30~ W. along the southwesterly
line of the norSheasterly one-half (1/2) of said Lot 47, a
distance of 660.76 feet, to the westerly corner of the south-
easterly one-half (1/2) of the northerly one-quarter (1/4) of
said Lot 47; thence, N. 39o50'54~ E. along the northwesterly
line of said southeasterly one-half (1/2) and its northeasterly
prolongation, a distance of 693.60 feet, to the northeasterly
line of Mitchell Avenue, as shown on said Tract No. 4251;
thence, N. 50°09'30~ W. along said northeasterly line of
Mitchell Avenue, a distance of 430.55 feet to the point
of beginning. ·
2. That the Council of the City of Tustin desires
to annex said uninhabited territory .~ to the City of Tustin for
the following reasons' The territory is contiguous to the City
of Tustin, and its proposed annexation will contribute to.and
facilitate the orderly growth and development of both the City
and the territory ~proposed to be annexed; will facilitate and
contribute to the proper and orderly layout, design and con-
struction of streets, gutters, sidewalks, sanitary and storm
water sewers and drainage facilities, both within the City and
within the territory proposed to be annexed; 'and will provide
and f~acilitate proper overall planning and zoning of lands,
and subdivision of lands in said. City and said uninhabited
territory, in a manner most conducive to the welfare of ~said
City and said uninhabited territory.
3. That if said territory is annexed, it shall be-

come part of the Tustin~School District.
4. That the County Boundary Commission of Orange
County, California, did, in session duly assembled on , ~
November 20th, 1961,.approve.the proposed annexation boundaries

as the time and place where and when any person owning real
property within the uninhabited territory above described an~.
proposed to be annexed to 'the City of Tustin, and having any
objections to the proposed annexation, may appear before the
Council of the City of Tustin, and show cause why such unin-
habited territory should not be so annexed to said City ~of
Tustin. Such protest must be in writing, may be filed at any
time before the hour set for hearing objections to the proposed
annexation, and shall state the name or names of the owner
or owners of property affected, and the description and area of
such property, in general terms.
6. The City Clerk of the City of Tustin is hereby
authorized and directed to cause a copy of. this Resolution to be
published at least .twice, but not oftener than once a week, in the
Tustin News, a newspaper of general circulation published in said
City of Tustin, the City to which it .is proposed to annex the
aforesaid territory, and also in the Orange Daily News, Orange,
California, a newspaper of general circulation published outside
the City of Tustin, but in the County of' Orange, California, the
county in which is located the territory proposed to be annexed
to the City of Tustin, said publication to be complete ~at least
twenty (20) days prior to the date set for hearing.
7. The City. Clerk is further authorized and directed
.to cause written notice of such proposed annexation to be
mailed to each person to whom land within the territory proposed
to be annexed is assessed in the last equalized county assessment
roll available on the date the above said proceedings were in-
it iated, at the addresses shown on said assessment roll or
known to the Clerk, and to any person who has filed his name
and address and the designation of the lands in which he has
an interest, either legal or equitable', with the Clerk, such
notice to be given not less than twenty(20) days before the
first public hearing on the proposed annexation.
8. In the event any land within the territory
proposed to be annexed is owned by a county, the City Clerk
is directed to cause written notice of such proposed annexation
~o be mailed to the Board of Supervisors of the County, such
notice to be given not less than twenty (20) days before the
first public hearing on the proposed annexation.
9. In the event there is, ~uPon the land proposed to
be annexed, a structural improvement owned, being acquired or
leased by a county fire protect'ion district, the said Clerk~ls
directed to cause written notice of such proposed annexation
to be mailed to the governing body of such district, such
notice to be sent not less t~an ten ~(10) days before the first
public hearing upon such proposed annexation.
10. The City Clerk is directed to cause written
notice to be given to such other persons as may be legally
entitled there$o, in the manner required by law.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, held on the 18th day of
December, 1961.
