HomeMy WebLinkAboutCC RES 577 RESOLUTION NO. 577 RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRI- TORY DESCRIBED HEREIN AND DESIGNATED "FIRST SOUTHERN BAPTIST CHURCH OF TUSTIN ANNEXATION" TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been in- itiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin, all that uninhabited territory situate in the County of Orange, State of California~, hereby designated as 'FIRST SOUTHERN BAPTIST CHURCH OF TUSTIN ANNEXATION', and described as follows' Commencing at an angle point in the High School Annexation No. 2 to the City of~ Tustin in accordance with Resolution by the Orange County Board of Supervisors, dated January 2, 1958, said angle point being the intersection of the north- westerly line of the southeasterly one-quarter ~(1/4) of no~rtheasterly one-half (1/2) of Lot ~31, Block 12 of Irvine's Subdivision as shown on a map thereof recorded in Book l, page 88, Miscellaneous Maps, Records of Orange County, California, with a line parallel to and 30 feet southwesterly of, as measured at right angles to, the surveyed centerline of 'San Juan Street; o Thence, S. 50 07'00" E. along said parallel line, a distance of 290.'71 feet, to a line parallel to and 40 feet north- westerly of, as measured at right angles to, the surveyed centerline of Red Hill Avenue; Thence, S. 39°51'25~ W. along said parallel line, a distance of 630.60 feet, to the southwest line of the southeasterly one-quarter (1/4) of northeasterly one-half (1/2) of said Lot 31; Thence, N. 50°06'42~ W. along said southwesterly line, a distance of 290.72 feet, to the most westerly corner of the southeasterly one-quarter (1/4) of the northeasterly one-half (1/2) of said Lot 31, said corner also being an angle point in said High School Annexation No. 2; Thence, N. 39°51'25~ E. along said High School Annexation No. 2 boundary line, a distance of 630.72 feet to the point of beginning. 2. That the Council Of the City.of Tustin desires to annex said Uninhabited territory to the City of Tus6in for the following reasons' The territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That if said territory is annexed, it shall become part of the Tustin School District. 4. That the County Boundary Commission of Orange County, California, did, in session duly assembled on November 20, 1961, approve the proposed annexation boundaries of said "FIRST SOUTHERN BAPTIST CHURCH OF TUSTIN ANNEXATION~, as above described. ~ 5. That Monday, February 5th, 1962, at the hour of 7' 30 o'clock P.M.~, in the Council Chambers, City Hall, 145 West Third Street, Tustin, ~California, is hereby fixed as the time and place when and where any person ~ . owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexa2 tion, may ~appear before the Council .of the City of Tustin, and show cause why suc~ uninhabited territory should not be so annexed to said City of Tustin. Such protest must be in writing, may be filed at any .time bef:.ore the hour set for hearing objections~ to the proposed annexation, and~ shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms. 6. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in the Tustin News, a news- paper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange Daily News, Orange, California, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, th& county in which is located the territory proposed to be annexed to the City of Tustin, said publication to be complete at least twenty (20) days prior to the date set for hearing. 7. The City Clerk is further authorized and ~ directed to cause~ written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filedhis name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before 'the first public hearing on the proposed annexation. 8. In the event any land within the territory proposed to be annexed is owned by a county, the City.Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20)days before the first public hearing on the proposed annexat ion. 9. In the event there is, upon the land proposed to be annexed, a structural i.mprovement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Clerk is directed to cause written notice to be given to such other persons as may be legally .4. entitled thereto, in the manner required by law.
