DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UN- INHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "PANNELL ANNEXATION" TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. ' · ~BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN' 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the county of Orange, State of California, hereby designated as"PANNELL ANNEXATION"', and described as follows: Beginning at an angle point in the South Tustin Avenue Annexation to the City of Tustin, as per OrdinanCe No. 136, passed and adopted by the City Council of the City of Tustin, July 5, 1960, said angle point being in the southeasterly line of Lot 64, Block ll, as shown on a map of Irvine' s Subdivision, recorded in Book l, page 88, Miscellaneous Maps, Records of Orange County, California, said angle point bearing N. 40°00' E. 310 feet from the most southerly corner of said Lot 64 (said southerly corner also being a point in the center line of the Santa Fe Railroad 100 foot right of way); Thence, from said point of beginning N. 40°00' E. along said southeasterly line of Lot 64, a distance of 285.00 feet to the most easterly corner of land conveyed by Leila James Wharton, et al to Clarence Orin Pannell, by deed recorded in Book ll S0, page 99 of Official Records of Orange County, California; Thence, N. 50000' W. along a line parallel to the said southwesterly line of Lot 64 of Block ll, and its northwesterly prolongation a distance of 1350.00 feet more or less to boundary line of said South Tustin Avenue Annexation, said boundary also being north- westerly right of way line of Newport Avenue 60 feet wide; Thence, S. 40°00' W. along said South Tustin Avenue Annexation boundary line 285 feet to angle point in said boundary line; thence. S. 50°00' E. along said annexation boundary line, 1350.0 feet more or less to point of beginning. 397 2. That the Council of the City of Tustin desires to annex said.uninhabi.ted territory to the City of Tustin for the following reasons: The territory is contiguous , to the City of Tustin, and its proposed annexation will con- tribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, side- walks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall plan- ning and zoning of lands, and subdivisions of lands in said City and said uninhabited territory,~ in a manner most con- ducive to the welfare of said City and said uninhabited territory. 3. That if said territory is annexed, it shall become part of the Tustin School District. 4. That the County Boundary Commission of Orange County, California, did, in session duly assembled on November 20th, 1961, approve the proposed annexation boundaries o.f said ~PANNELL ANNEXATION", as above described. 5. That Monday, February 5, 1962, at the hour of, 7:30 O'clock P.M., in the Council Chambers, City Hall, 145 West Third Street, Tustin, California, ~ is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexod to the C:ity of Tus-tin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustln, and show cause why such uninhabited territory should not be so annexed to said City of Tustln. Such protest must ~be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the names or name of the owner or owners of property affected, and the description and area of such property, in general terms. 398 6. The City Clerk of the City oof Tustin is hereby authorized and directed to 'cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in the Tustin News, a newspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange Daily News, Orange, California, a newspaper of general cir~culation published outside the City of Tustin, but' in the County of Orange, California, the county in which is located the territory proposed to be annexed to the City 'of Tustin, 'said publication to be complete at least twenty (20). days prior to the date set for hearing.. 7. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed 'in the last e~alized county assessment roll available on the date the above, said proceedings were initiated, at the addresses shown on said assessment roll . or known to the Clerk, and to any person who.has filed his name. and address and the designation, of the lands in which he. has an interest, either legal or eqditab.le, with the Clerk,~such notice, to be given not less than twenty (20) days before the first public hearing on the proposed annexation. ~m 8 ' In the event any land within the terri- tory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of.Supervisors of the County, such notice to be given not less than twenty(20) days before 399 the first public hearing on the proposed annexation. 9. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, ~uch notice to be sent not. less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner ~equired by law.
