A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, FINDING AND DETERMINING THAT
THE OWNERS OF MORE THAN ONE-HALF OF THE VALUE OF
THE PROPERTY DESIGNATED "SEVENTEENTH STREET, YORBA
TO PROSPECT, ANNEXATION" TO THE CITY OF TUSTIN, AS
SHOWN BY THE LAST EQUALIZED ASSESSMENT ROLL OF THE
COUNTY OF ORANGE, STATE OF CALIFORNIA, HAVE PRO-
TESTED SAID ANNEXATION, AND DETERMINING THAT THE
PROCEEDINGS FOR THE ANNEXATION OF SAID TERRITORY
BE TERMINATED.
WHEREAS the City Council of the City of Tustin did,
on the 6th day of March, 1961, on its own motj. on, in'itiate pro-
ceed:i..ngs for the annexati, on of certaJ..n uninhabited territory
designated as "SEVENTEENTH STREET, YORBA TO PROSPECT, ANNEXA-
TION" to the City of Tust.~.n; and
WHEREAS su'bsequently thereto proceed, ings were taken
pursuant to the provisions of the "Annexation of Uninhabited
· erritory Act of ].939"; and
WHEREAS the C.ity Council of the C.~.ty of Tusti. n
on March 6, 1961, pass and adopt Resol. ut.f~.on No. ~.~6, giving
notice of the proposal to annex the aforesaid uninhabited
territory, and affixing the boundaries of said territory; and
WI-{EREAS said Resolution No. 546 did conta~.n a notice
of the date, hour and place when and where the Council of the
City of Tustin would hear protests made by any person owning
real property within the terr~.tory to be annexed, the ti. me of
said hearing being no less than forty nor more than s~.xty days
from the passage of said Resolution; and
WI{EREAS on May 1, ].96]., at the hour of'?"30 P.M., in
the cou-n..ci]., chambers, in the City Hal..1 of the City of Tustin,
County of Orange, State of Cali. fornia, said time and place
bei.'ng the day, hour and place fixed in Resolut.~.on No. 5~6
for hearing protests to the sa.i.d annexation, said C~ty
Counc.~.l did hear and pass upon a].~! i~rotests to the proposed
annexation, and 'the Cf~ty Clerk of the City of Tustin certified
to the C~.'ty Council of the City of Tustin that protests were
filed by the owners of more tha~ one-half of the value of the
territory designated as "Seventeenth Street~ Yorba to Prospect
Annexation" to 'the City of Tustin, as shown upon the last
equalized assessment roll of the Gounty of Orange, State of
California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Tustin, California, that it is found and. determined
by' the City Council of the City of Tustin that valid protests
were filed by the owners of more than one-half of the value of
the territory designated as "Seventeenth Street, Yorba to Pros~ct,
Annexation" to the City of Tustin, as shown by the last equalized
assessment roll. of the County of Orange, State of California, and
that further proceedings for the annexation of said territory
shall not be taken.
BE IT FURTHEH RESOLVED that the proceedings for the
annexation of the territor'y designated as "Seventeenth Street,
Yorba to Prospect, Annexation" to the City of Tustin be and
they hereby are terminated.
PASSED AND ADOPTED by the City Council of the City
of Tustin at a regular meeting thereof held. on the first day
of May, 1961
