RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN
INITIATED BY THE COUNCIL OF THE CITY OF TUSTIN
TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY
DESCRIBED HEREIN AND DESIGNATED "SEVENTEENTH STREET,
YORBA TO PROSPECT, ANNEXATION, AND GIVING NOTICE OF
THE PROPOSED ANNEXATION
BE 'IT RESOLVED BY THE COUNCIL OF THE CITy OF TUSTIN'
1. That, pursuant to the provisions of the Annexation
Of Uninhabited Territory Act of 1939, proceedings have'~been
initiated by the Council of the City of Tustin,~ on its own motion,
to annex to the City of Tustin all that uninhabited territory
situate in the County of Orange, State of California, hereby
designated as "Seventeenth Street, Yorba to Prospect, Annexa-
tion" and described as follows'
Beginning at an angle point on the existing city boundary of the
City of Tustin, California, recorded in Yorba Street Annexation
No. 2, adopted by Ordinance No. 139, dated September 6, 1960,
said angle point being 40 feet northerly of, as measured at
right angles to, the surveyed centerline of Seventeenth Street
and 20 feet westerly of, as measured at right an~les to, the
surveyed centerline of Yorba Street; thence S. i 24' 23" W.,
perpendicular to the surveyed centerline of said Seventeenth
Street, a distance of 90.00 feet, to a point on a line parallel
to and 50 feet southerly of the surveyed centerline of Seventeenth
Street; thence easterly along said parallel ~ine, the following
bearings and distances' S. 88° 35' 37" E. 21.67 feet; N. 89°
35' 38" E. 181.89 feet; N. 88° 56' 24" E. 1216.06 feet; N. 88°
45' 10" Eo 247.05 feet to a point on the southerly prolongation
of the west line of property conveyed to Trevor Carnes as per
deed recorded in Book 4948, page~ 146, Official Records, Orange
County, California; thence N. 0~ 02' 56" W., along said southerly
prolongation and the west line of said Boperty, a distance of
728.13 feet to the northwest corner of said property; thence S.
89° 49' 02" E., along the north line of said property, a distance
of 305.12 feet to a point on a line parallel to and~40 feet west-
erly of the surveyed centerline of Prospect Avenue; thence S. 3°
~ 30' 40" W., along said parallel line and the southern prolongation
thereof, a distance of 722.75 feet to a point on a line parallel
to and 50 feet southerly of the surveyed centerline of Seventeenth
Street; thence easterly, along said parallel line, the following
bearings and distances' N' 88o 45' 10" E. 43.95 feet; N. 88°
50' 02" E. 108.79 feet to a point on the east line of property
conveyed to Eddy Meredith as per deed recorded in Book 4441,
p~age 429 Official Records, Orange County, California; thence S.
0~ 14' l~" E., along said east line, a distance of 614.43 feet
to a point on the north line of Tract No. 2922 as shown on a
...map thereof, recorded in Book 101, pages 47 and 48, Miscellaneous
Maps, Records of Orange County, California; thence S. 89° 45' 50"
W., along said north line, a distance of 6211.65 feet to a point
on a line parallel to and 40 feet easterly of the surveyed center-
line of Prospect Avenue; thence N. 0° 14' 10" W., along said
parallel line, a distance of 97.11 feet to a point on the easterly
prolongation of the north line of Tract No, 2564 as shown on a map
thereof, recorded in Book 74, pages 23 and 24, Miscellaneous Maps,
Records of Orange County, California; thence S. 88° 56' 46" W.,
along said easterly prolongation and the north line of said tract,
a distance of 634.00 feet to the northwest corner of said tract;

thence S. 0° 14' 10" E., aleng the west line of said tract, a
distance of 462.89 feet to the southeast corner of property con-
veyed to Ethel F. Doty as per deed recorded in Book 1944, pages
461 and 462 Official Records of Orange County, California; thence
S. 88° 56' ~6" W-, along the south line of said property, a distance
of 622.38 feet to the southwest corner of said property, said corner
also being a point on the existing city boundary of the City of
Tustin, California; thence, along the existing city boundary of
the Cityof Tustin, the following bearings and distances, N. 0o
14' 10" W. 281.72 feet to an angle point; thence N. 88° 52' 33"
W: 564.30 feet to an angle point; thence N. 0° 06' 55" W. 689.51
feet to an angle point; thence N. 88° 35' 37" W. 72.76 feet to an
angle point; thence N. 0° 12' !3" E. 85.03 feet to an angle point;
thence S. 88° 35' 37" E. 435.95 feet to the poin't of beginning.
All bearings used herein are based on the centerline of Prospect
Avenue (N. 0° 14' 10" W.) as shown on a n~p of Tract No. 1418, re-
corded in Book 46, page 22, Miscellaneous Maps, Records of Orange
County, California.
2. That the Council of the Cityof Tustin desires to
annex said uninhabited territory to the Cityof Tustin for the
following reasons' The territory is contiguous to the City of
Tustin, and its proposed annexation will contribute to and facili-
tate the 'orderly growth anti'development of both the City anti'the
territory proposed to be annexed; will facilitate and contribute to
the 'proper and orderly layout, design and construction of streets,
gutters, sidewalks, sanitary and storm water sewers and drainage
facilities, both within the City and within the territory proposed
to be annexed; and will provide and f~.ciiitate proper overal~

planning and zoning Of' lancla, and subdivision of' lands in sai~
City and said uninhabited territory, in a manner most conducive
to the welfare of said City and said uninhabited territory.
That the County Boundary Commission of Orange County,
California, did in session duly assembled on Monday, February 20,

1961, approve the proposed annexation boundaries of said "Seven-
teenth.Street, Yorba to Prospect, Annexation" as above described,
and as submitted to said Commission by the Council of the City
of Tust in.
4. That Mon~{ay, May l, 1961, at the hour of 7'30 p.m.,

in t'he Council Chambers in the City Hall in the City of Tustin,
County of Orange, California, ~is hereby' fixed as the time and.
place when and where any person owning real property within the
uninhabited territory above described and proposed to be annexed
to the City of Tustin, and having any objections to the proposed

annexation, may appear before the Council of the City of
Tustin and show cause why such uninhabited territory should
not be so annexed to the City of Tustin. Such protest must
be in writing, may be filed at any time before the hour' set
for hearing objections,to the proposed annexation, and shall
state the name or names of the owner or owners of property af-
fected, and the description and area of such property, in
general terms.
5. The City Clerk of the City of Tustin is hereby
authorized and directed to cause a copy of this resolution to be
published at least twice, but not oftener than once a week, in
The Tustin News, Orange County, California, a newspaper of
general circulation published in said City of Tustin, the city
to which it is proposed to annex the aforesaid territory, and
also in the Orange Daily News, Orange County, California, a
newspaper of general circulation published outside the City of
Tustin, but in the County of Orange, California, the county in
which is located the territory proposed to be annexed to the
City of Tustin, said pUblication to be complete at least twenty
(20) days prior to the date set for hearing.
6. The City Clerk is further authorized and directed
to cause written notice of such proposed annexation to be mailed
to each person to .whom land within the territory proposed to be
annexed is assessed in the l~st eq. ualized county assessment roll
available on the date the above said proceedings were initiated,
at the addresses shown on said assessment roll or known to the
Clerk, and to any person who has filed his name and address and
the designation of the lands in which he has an interest, either
legal or equitable, with the Clerk, such notice to be given not
less than twenty (20) days before the first public hearing on
the proposed annexation.
7. In the event any land within the territory proposed
to be annexed is owned by a county, the City Clerk is directed to
cause written notice of such proposed annexation to be mailed to
the Board of Supervisors of the county, such notice to be given

not less than t~enty (20) days before the first public hearing
on the proposed annexation.
8. In. the event there is, upon the land proposed to be
annexed, a structural improvement owned, being acquired or leased
by a county fire protection district, the said Clerk is directed
to cause written notice of such proposed annexation to be mailed
to the governing bo~y of such district, such notice to be sent
not less than ten (10) days before the first public hearing upon
such proposed annexation.
9. The City Clerk is directed to cause written notice
to be given to such other persons as may be legally entitled
thereto, in the manner required by law.
PASSED AND ADOPTED at a meeting of the City Council of
the City of Tustin, held on March 6, 1961,
