RESOLUTION NO. 538
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, DECLARING THAT PRO-
CEEDINGS HAVE BEEN INITIATED BY THE CITY
COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
TO ANNEX TO SAID CITY CERTAIN UNINHABITED
TERRITORY DESCRIBED HEREIN AND DESIGNATED
AS "SOUTH TUSTIN AVENUE ANNEXATION NO. 2",
AND GIVING NOTICE OF THE PROPOSED ANNEXATION.
BE IT RESOLVED by the Council of the City of Tustin,
California, as follows' ~
1. That pursuant to the provisions of the Annexation
of Uninhabited Territor~ Act of 1939, proceedings have been initiated
and are hereby .initiat~ed by the Council of the City of Tustin, Cal-
ifornia, on its own motion, to annex to the City of Tustin, Calif-
ornia, all that uninhabited territory situated in the County of Orange,
State of California, h..ereby designated as "SoUth Tustin Avenue Annexa-
tion No. 2" and described as follows'
A portion of the F. W. Koll Allotment of the Rancho
Santiago de Santa Ana,, described as follows'
Beginning at the intersection of the Northeasterly right
of way line ~of the A. T. & S. F. Railroad, said railroad being
fifty (50) feet in width, with the Westerly right of way line of Tustin
Ave ..nue, said Tustin Avenue being fifty (50) feet inwidth, said point
of beginning being a common angle point in the boundaryalines of the
City of Tustin and the. city of Santa Ana; thence, S. 50~ ll' 05" E.,
along the city boundary of the City of Tustin, said city boundary a12o
being the Northeasterly right of way line of the said A. T. & S. F.
Railroad, a distance of 221.06 feet~::to.:~the Northwesterly right of way
line of Newport Avenue, said right of way line being t'hi'rty (30) feet
Northwesterly of, as measured at right angles to the surveyed center
line of said Newport Avenue; thence, S. 39~ 48' ~5" W., along said
right of way line ~f said Newport Avenue and its Southwesterly
prolongation, a distance of 267.92 feet, to the Westerly right of way
line of Tustin Avenue, said right of way line being 25 feet Westerly of
as measured at right angles to, the surveyed center line of said
Tustin Avenue; thence N. 0° 19' 45~ E., along said right ~.~of way
line of said Tustin Avenue, ~a distance of 64.27 feet to the
Southerly property line of property conveyed to the Santa Ana
Lumber Company as recorded in Book 5308, Page 243, Official Records
of Orange County, California, and as shown on Records of Survey
Book 47, Page 26, Records of Orange County, California; thence, S.
89° 51] 49" W., along said Southerly prbperty line, a distance
of 111.63 feet to a point being 290 feet Southwesterly of, as
measured at right angles to, the existing city boundary of the
City of Tustin; thence, N. 50°ll' 05" W. a distance of 43.06 feet
to the Easter.ly right of way line of the Newport FreewaX as laid
out by the California Highway Commission; thence, N. 19U 37' 31" E.
along said Easterly right of way line, a distance of 255.71 feet
to an angle point in said Easterly right of way. line, Said angle
point also being the Southwesterly right of way line of ~the A,. T.
& S. F. Railroad, said railroad being fifty (50) feet in width;
thence,~ N. 39~ 48' 55" E., along said Easterly right of way line of
said Newport Freeway, a distance of fifty (50) feet to an angle
point in said Easterly right of way line of said Newport Freeway,
said angle point also being the Northeasterly right of way line of
said A. T....& S. F. Railroad and said angle point also_being of the
city boundary of the City of Santa Ana; thence, $. 50° ll' 05" E.,
along said city boundary of the City of Santa Ana, said city
boundary also being the Northeasterly right of way line of said
A. T. & S. F. Railroad, a distance of 36.70 feet to the point of
beginning.
1. That the Council of the City of Tustin, California,
desires to annex said uninhabited territory to the City of Tustin
for the following reasons; The annexation of the hereinabove
described territory will contribute to the orderly growth of the
Tustin Avenue, said right of way line being 25 feet Westerly of,
as measured at right anglesotO, the surveyed center line of said
~ustin Avenue; thence, N. 0 19' 45" E., along said rfght'~ of way

line of said Tustin Avenue, a distance of 64. 27 feet to the
Southerly property line of property conveyed to the Santa Ana

City of Santa Ana; thence, S. 50° ll' 05" E,, along said city
boundary of the C~ty of Santa Ana, said city boundary also being
the Northeasterly right .of way line of said A. T. & S. F. Railroad
a distance of 36.70 feet to the point of beginning.
2. That the Council of the City of Tustin, California,
des ires to annex said uninhabited territory to the City of Tustin
.~ for the following reasons' The annexation of the hereinabove
descriDed territory ~will contribute to. the orderly growth of the
· . City, prov. ide the proper control of st. reet lay-out, drainage,
sanitary sewer design, and insure the .proper use of the land in
conformity with the over-all zoning plan of. the City.
3.' That t~he Boundary Commission of the Cqunty of Orange,
State of Californi2 did, in s~ss.~ion duly assembled on November
21, 1960, approve the proposed annexation boundaries of said
"South Tustin Avenue Annexation No. 2", as above described, and
as submitted to the said Commission by the Council of the City Of
Tustin, California.
4. That January 16, .1960, at the hour of 7'30 P. M., in
the Council Chambers ,in the City Hall, City of Tustin, County
of Orange, State of California, are hereby fixed as the time and
place where any person own'ing real property within the uninhabited
territory hereinabove described and proposed to be annexed to the
~City of Tustin, California, and having any objections to the
proposed'annexation, may appear before the City Council of ~he
City of Tustin, California, and show cause why such uninhabited
territory shall not be so annexed to the City of Tustin. Such
protests must be in writing, may be filed at any time before the
hour set f,,.Or he~.ring objections to the proposed annexation, and
~ shall 'set forth the name of the owner or owners of the property
affected,., and the description and area of said property, in
general t'arms.
5. The City Clerk of ~the City of ~ustin is hereby auth-
orized and directed to cause a copy of t'his Resolution to be
published at least twice, but not oftener, than Once a week, in the
Tustin News, a newspaper of general circulation, published in t'he
City of Tustin, County of Orange, State of California, the City
to which it is proposed to annex the aforesaid territory, and also
in the Orange Dai~y News, a newspaper of general circulation,
~publishSd outside the City of Tustin, California, but in the County
of Orange, State of Califron.'.ia, the County in which is located the

territory proposed to.be annexed to the City of Tustin, said.
publication to be completed at least twenty days prior to the
date set for hearing~
6. The City Cler~ is further authorized and directed
...to cause written notice of such proposed annexation to be mailed
to each person to whom land within the territory proposed to be
annexed was assessed in the last Equalized County Assessment
Roll available on the date the above proceedings w~re initiated,
at the addresses shown on said '..ssessment Roll, or known to the
Clerk, and to any person who has filed his name and address and
the designation of the lands in which he has an interest, either
legal or equita~le, with the Clerk, such notice to be~given not
less than twenty (20) days before the first public hearing on
the:' proposed annexat ion.
7. The City Clerk is directed to cause written notice
of such proposed annexation to be mailed to the Board of Sup-
ervisors of the County of Orange, State of California, such
notice to be given not less than twenty (20) days before the
first public hearing on the proposed annexation,
8. In the event there is, upon the land proposed to
be annexed, a structural improvement known, being acqui':red.~or
leased by a county fire Protection District, the City Clerk
is directed to cause written notice of the proposed annexation
to be mailed to governing body of such District, such notice
to be sent not less than ten(10) days before the first pub~i~
hearing on the proposed annexation.
9. The City Clerk is directed to cause said notice
to be given to the governing body of the school district in
whi'ch is located the territory proposed to be annexed, and such
notice is to be given not less than twenty (20) days before the
first public hearing on the proposed annexation,
10. The City Clerk is directed to cause written notice
to be given to such other persons as may be legally entitled
thereto, in the manner required by law.
PASSED AND ADOPTED by the City Council of the City
of Tustin, California, at a regular meeting held November 21st
1960.
