HomeMy WebLinkAboutCC RES 531 RESOLUTION NO. 53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FOR THE PURCHASE OF SEWER LINE. The City Council of the City of Tustin does resolve as follows' WHE~tEAS, the public interest, convenience and. necessity require the construction, operation and maintenance of sanitary sewers within 'the City of Tustin as soon as reasonably feasible and possible; and WHEREAS, the hereinafter described district is one contiguous area, lying within the City Limits oF the City ~. of Tustin, and westerly of the Newport Freeway, upon which construction is about to commence, and. WHEREAS, the sewer line to serve said district can be constructed at a great savings of money if constructed prior to the construction of said Freeway; and .. WHEREAS, the owners and lessees of certain [.~roperty within the said. district are willing..and have offered, to construct said sewer line under and across said. Freeway prior to its construction, and to sell said line to the City of Tustin; and WHEREAS, the owners and lessees of said. property have offered, and are willing ton convey to the City of Tustin an easement across their said property in order that said line may be constructed so as to serve the other parcels of property in said district, BE IT RESOLVED, that the public interest, necessity and the best interests of the City of Tustin be that the City of Tustin enter into a contract with the owners and lessees of property adjoining the southwest corner of Tustin Avenue and First Streets in the City of Tustin, providing that the owners of said property ,shall construct a sewer line along and across the proposed. Newport Freeway, pursuant to the plans and. specifications to be provided by Lowrey & Associates, and that the City will purchase upon completion according to said plans and specifica- t ions said sewer li~ne from said owners for the sum of ~ii8,500.00, or for the total amount of cost of construction, plus fifteen percent (15~), whichever amount is the lesser, and that said owners and lessees of said property shall convey to the City of Tustin by Grant Deed an easement to the property described as' An easement for sanitary sewer purposes over the following described parcels of land, being portions of the East half of the North half of Lot "E" of the Stafford and Tustin Tract, as shown on a map recorded in Book 2, pages 618 and 619 of Miscellaneous Records of Los Angeles County, California. Parcel 1. The East 10 feet of the North half of said Lot "E" excepting therefrom the South 288 75 feet Parcel 2. Commencing at a point inothe .East line of said Lot "E" distant thereon, N 0 17' 30" E 288.75 feet from the Southeas~ corner of the North half of said Lot "E"; thence S'~89 28' 10" W. 3.5.5~ feet to the true ~oint of beginning of this description; thence N. 13 16' 30" E. 108.88 feet to a point in a line drawn parallel to and distant 10.00 feet West, as measured at right_a.ngles, of the East 1.~ne of said o 1~' E., Lot "E"; thence S. 0 30" 10%.76 feet along said parallel line to a line that bears N. 89$ 28' 10" W. 2%.55 feet to the true point of beginning. for an easement for sewer line purposes, it being understood between the City of Tustin and. said. owners and lessees and all other persons that upon the construct- ion of the remaining lines of the sewer system of the City of Tusti'n and assessment therefor, that said. owners and lessees shall be assessed for said lines in like manner as other property owners wi thin the City, without regard to the hereinabove mentioned contract. The Mayor and City Clerk of the City of Tustin are authorized to execute the aforesaid contract.
