HomeMy WebLinkAboutCC RES 520RESOLUTION NO. 520 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF TUSTIN, DESIGNATING THE TERRITORY AS THE YORBA STREET ANNEXATION NO. 2; DESCRIBING THE BOUNDARIES OF THE TERRI- TORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRI- TORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF TUSTIN. WHE[iEAS, the City Council of the Ci.t~.~ of Tustin did, on the ? day of July, 1960, receive a written petition asking that certain new terri, tory described in said petition be annexed to the City of Tustin; and WHiEttEAS, before the Filing of said petition 'the proposal for the annexation of the territory' hereinafter described to the City of Tustin was smbm.~tted to the Boundary Commission of the County of Orange, State of Cal.'[fornia, and. reported u.pon by said Boundary Commission with respect to the definiteness a.~.~d certainty of the proposed boundaries; and .. WHEREAS, said territory ~.~roposed to be annexed to said City of Tustin is situated in 'the County of Orange, State of Ca!i- fornia, and. is contiguous to the City of ~.Iius't.~n and is uni. nhabited territory, and said petition contained a. description of said terri- 'tory in wo..rds and f'igures as hereinafter i.n th.is Resolution described.; arid ~HE!tEAo, the City Council finds from evidence and. reports received that at the time of the filing a.nd receipt of said petition it was and now is signed by owners of not less than one-fourth (~.) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding ,. equali, zed county assessment roll; and WHEREAS, the City Council finds from evidence and re- ports received and from said petition that at the time of the filing and presentati, on of sa.~.d petition that said new territory' proposed to be annexed to sai. d City of Tustin did not form a part of any muniCipal corporati, on and that said territory was uninhabited and. is contiguous to the City of Tustin; and 247 WHEREAS, the City Council finds f.rom said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Tustin are as follows, to-wit' Beginning at a point on the city boundary of the City of Tustin, said point being 205 feet easterly of, and measured at right angles to, the west line of the east half of Lot 14., Block "B" of the A. B. Chapman Tract as shown on a map recorded in Book 102, Page 15, Miscellaneous maps, records of Orange County, Califor'nia, said point also being forty (40) feet Northerly of, and measured at right angles · to, the surveyed center line of Seventeenth Street; thence, Easterly, along a line parallel to and forty (40) feet Northerly of, measured at right angles to, the surveyed center line of .Seventeenth Street, a distance of 436.04 feet, more or less, to the Westerly right of way line of Yorba Street, being forty (40) feet wide; thence, northerly, along said right of way line of Yorba Street, a distance of 1,313.24 feet to the North line of Lot 114, Block "B" of said A. B. Chapman Tract; thence, easterly, along the North line of said Lot 14, a. distance of twenty (20) feet, more or less, to the North- east corner of said Lot 14, said corner also being the So~thwest corner of Lot 10, Block "B" of said A. B. Chapman Tract; thence, S. 89© 49' 08" E. a distance of 1321.66 feet, along the South line of said Lot 10, to the Southeast corner of said Lot 10, said corner also being the Southeast corner' of Tract No. 3465 as shown on a map thereof recorded in Book 120, Pa~'.,'eso~ 14 and 15, Miscellaneous Maps,. records of Orange County, California; thence, N. 0° 01' 00" W. A distance of 594.37 feet, along the east line of said Tract No. 3465, to the Northwest corner of Tract No. 1900 as shown on a map thereof recorded in Book 53, Pages 15 and 16, Miscellaneous Maps, records of Orange County, California; thence, N. 89° 53' 30" W. a distance of 0.75 feet, along the East line of said Tract No. 3465, to the Southwest corner of Tract 'No. 2708 as shown on a map Pa;~e 25 Miscellaneous Maps, records thereof recorded in Book 90, ... , , N 0° of Orange County, California; thence, . 04' 30" W. a distance of 383.14 feet, along the East line of said. NOW THE~tEFORE, BE IT RESOLVED BY THE CITY COUNC.][L OF THE CITY OF TUSTIN' That such proposed annexation be designs, ted as YOttBA STHE'f~T ANNEXATION NO. 2, and that notice of such proposed annexa- tion be hereby given as hereinafter provided. BE IT FUHTHEtt RESOLVED that the 18th day of August, 1960, at the hour of 7'30 'o'clock P.M., at the City Council Chambers, in the City Hall of the City of Tustin be, and the same is hereby fixed as the day, h. our.and place when and where the City Council will hear protests made by any owner or owners of real property within the territory proposed to be annexed', and that at any time 'before the hour set for hearing o'bjections any owner of property within said territory may File with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the prot.~erty in general terms. BE IT FU!tTHER RLo0LVED that the City Clerk be, and. she is hereby authorized, and directed, to cause a copy of this tteso].u.t~_on to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to-wit' The Tustin News, of Tustin, Oran. ge County, California, and. also in a. newspaper of general circulation, pu'bl.i, shed outside o£ the City, 250 but in the County of Oran~;,oe, in whi. ch ].s located the territory hereinabove proposed to be annexed to the City of Tustin, to-wit' The ~.teglster of Santa Aha, Orange County, Californ_~a; and. that such publication shall be completed at least twenty (2(.)) days pri[or to the date o.f hearing hereinabove s~.~ec~ed.
