HomeMy WebLinkAboutCC RES 473 RESOLUTION NO. 473 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING MAIN AND FIRST STREET'S TO BE ADDED TO THE SYSTEM OF MAJOR CITY STREETS, AND REMOVING PORTIONS OF "B" STREET, "C" STREET AND SIXTH STREET AND REQUESTING APPROVAL THEREOF BY THE DEPARTMENT OF PUBLIC WORK, DIVISION OF HIGHWAYS, OF THE STATE OF CALIFORNIA WHEREAS, under the terms and provisions of Section _]..94 and 195 and Sections 2050 t~'~rough 2055 inclusive of the Streets ana Highways Come oi' the ~sase of Californi8., it is incumbent upon the ~'City Council of the City of Tustin to determine, select and desig- hate those streets which form a part of a system of major city streets, on the basis of the greatest general city importance, and · to remove certain streets from the system of major city streets when t'ney are no longer of sufficient general city importance, subject to the approval of the Department of Public Works, Division of Highways, State of California, for the purpose of allocation thereto and expenditure thereon of the per gallon tax on motor vehicle fuel to be paid to the City of Tustin for use upon major city streets within the said City in accordance with the Streets and. Highways Code of the State of California; NOW, THEREFORE, BE IT RESOLVED' Section 1. That the City Council of the City of Tustin does hereby determine, select and designate the following streets a.s major city streets to be added to the system of major city streets of the City of Tustin, subject to the approval, which approval is hereby requested, of the Department of Public Works, Division of Highways of the State of California' (a) All that portion of West Main Street in the City of Tustin, J. nclud, ed in the "Griset Annexation'" to the City of Tustin, by Ordinance No. 100 of the City of Tustin, passed and adopted by the Ci. ty Council on April 23, ]-956, described as follows' "A strip of land. 40 feet in width, being the South one-b~alf of Main Street (80 feet in width), extending from the Westerly City limits as described in Ordinance No. 100 of the City of Tustin approving said 'Griset Ann.exation' and. extending Easterly 0.191 miles to the original, boundary line of the City of Tustin"; the said Main Street is a secondary highway in the Orange County Master Plan of Highways. (b) ~11 that portion of First Street in the City of Tustin described as follows' "Beginning at a point in the surveyed center line of First Street, distant 265.80 feet.~Westerly, measured along said center line from the surveyed center line of Tustin Avenue as it exists Northerl. y from First Street; Thence Easterly along said center line of First Street 1.185 miles to the Northwesterly line of Irvine's Subdivision, also being the Southeasterly boundary line of the City of Tustin, excepting therefrom .061 miles between the East line of "D" Street and the center line of Prospect Avenue heretofore declared a Major City Street; Also excepting therefrom that portion of the Westerly 189.20 feet of the above First Street, 66 feet in width lying Southerly of common bound.~:~ry line between City of Tustln and City of Santa Aha; Also, excepting therefrom that portion of First Street, 66 feet in width, lying Northerly of city boundary, from center line of Prospect Avenue to point .308 miles Easterly to where city boundary line crosses First Street; The above described portion of First Street is a pri~'~ary highway in the Orange County Master Plan of Highways and is proposed, in the future, to be 100 feet in width. Section 2. That the City Council of the City of Tustin does hereby determine that by reason of the growth of the City of Tustin and the addition of other major city streets, the following streets are no longer of sufficient, general city importance to be classified as major city streets in the system of major city streets · (a) "B" Street from the South side of F.~rst Street to the Southerly City limits of the City of Tustin, being 0.51 miles i.n length. (b) "C" Street from the South line of First Street to the center line of Sixth Street, being 66 feet wide and 0.~93 miles in length. (c) East Sixth Street from the East line of "B" Street to the West line of "D" Street, being 66 feet i.n width and 0.126 miles in length. Section 3. The City Council of the City of Tustin does hereby request the approval of the Department of Public Works, Division of Highways, of the State of California, for the addition of the above described portions of Main and First Streets as major City Streets, and the removal of the above described portions of 124- "B" Street, "C" Street and East Sixth Street from the system of major City streets in the City of Tustin, California. Section ~. It is ~the intent and purpose of the City Council of the City of Tustin to use part of the net proceeds of the Highway User's Tax Fund, under the provisions of Sections 19a to 202 inclusive of the Streets and H~ghways Code of the State of California, on said major city streets designated and approved by the Department of Public Works, Division of Highways~ State of California. This resolution shall take effect immediately u~on its pas sage, approval and adoption.
