A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN ACKNOWLEDGING RECEIPT OF A PETITION FOR THE
ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE
CITY OF TUSTIN DESIGNATING THE TERRITORY AS THE
"IRA L. MARCHANT ANNEXATION NO. 2; DESCRIBING THE
BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED,
AND GIVING NOTICE OF THE DAY, HOUR AND PLACE, WHERE
AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN
SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR
BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH
TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF TUSTIN.
WHEREAS, the City Council of the City of Tusttn
did, on the 6th day of April, 1959, receive a ~rltten petition
asking that certain ne~ territory described in said petition
be annexed to the City of Tustin; and
WHEREAS, before the filing of said petition,
the proposal for the annexation of 'the territory hereinafter
described to the City of Tustin was submitte~ to the Bound-
ary Commission of the County of Orange, State of California,
and reported upon by said Boundary Commission with respect
to the definiteness and certainty of the proposed bound-
aries; and
WHEREAS, said territory proposed to be annexed
to said City of Tusttn is situated in the County of Orange,
State of California, and is contiguous to the City of
Tustin and is uninhabited territory, and. said petition
contained a description of said territory in words and
figures as hereinafter in this Resolution described; and
WHEREAS, The City Council' finds, from evidence
and reports received, that at the time of the filing and
receipt of said petition, it was and now is signed by owners
of not less than one-fourth[l/4) of the land in the territory
by area and Dy ass6ssed value in the territory proposed.to
be annexed, according to the last preceding equalized county
assessment roll; and
WHEHEA~, the City Council finds from evidence
and reports receive~ and from said petition that at the time
of the filing and presentation of said petition that said
new territory proposed to be annexed to the said City of
Tustin did not form a part of any municipal corporation
and that said territory was infnhabited and is contiguous
to the City of Tustin; and
WHEREAS, the City Council finds from said petition
and evidence and reports received that the boundaries of
the territory so proposed to be annexed to the City of
Tustin are as follows, to wit'
Beginning at the Westerly prolongation of the
center line of Sixth Street, formerly Sycamore
Street (66 feet wide) with the Westerly line
of Tustin Avenue, formerly Newport Co. Road
(66 feet wide) all as shown on map of the
Stafford and Tustin Tract, recorded in Book 2,
Page 618, of Miscellaneous Records, in the
office of the County Recorder of Los Angeles
County, California. Thence Northerly along
said Westerly line of Tust'in Avenue 75.00 feet.
Thence Easterly ??.00 feet to an angle point
in the boundary line of the City of Tustln,
Thence South 71°03' 14"' East along Southwest- ~
erly boundary line of the City of Tustin,
714.76 feet to an angle point in said boundary.
Thence continuing along said city boundary
South 67° 32' 3~" East 158.85 feet to the
East line of that certain parcel of land con~-
veyed by Charles Ao Thorman and Martha J.
Thorman to State of California by deed recorded
April 14, 1953, in Book 2486, Page 76, Official
Records, Orange County, California. Thence
departing from said City boundary line and
running Southerly along property line, 144.240
feet to the Southeast corner of said parcel.
Thence Westerly, parallel to the center line
of Sixth Street, and along property line,
169.27 feet to the East line of Lot "0" of
said Stafford and Tustin Tract, also being the
Southwest corner of parcel conveyed by Charles
A. and Martha J. Thorman to the State of Calif-
ornia, by deed recorded in Book 2486, on page
76, Official Records of Orange County, California;
thence South 0° 48' 45" East· along the East
line of said Lot "0~' as delineated on Record of
SUrvey, recorded in Book 26, page 44, records
of Orange County, California, a distance of
391.00 feet, more or less to a point, distant
Northerly 395.03 feet~from· the Southeast corner
of said Lot "0" shown on said "Record of Survey";
thence South 898o5'00'' West, 729.55 feet along
a line parallel to the South line of said Lot
"0", and its Westerly extension thereof to
the West line of said Tustin Avenue, 66 feet wide;
thence Northerly along the West line of said
· Tustin Avenue (66 feet wide), 1150.78 feet to
the Westerly prolongation of the center line
of Sixth Street, and point of beginning.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
O.~F THE CITY OF TUSTIN'
That such proposed annexation be designated as
"IRA L. MARCHANT ANNEXATION N0. 2" to the City of Tustin,
and that notice of such proposed annexation be hereby given
as hereinafter provided.
BE IT FURTHER RESOLVED that the 18th day of
May, 1959, at the hour of 7'30 o'clock P. M., at the City
Council Chambers in the City Hall of the City of Tustin
be, and the same is hereby, fixed as the day, hour and place
when and where the City Council will hear protests made
by an owner or owners of real property within the terri-
tory proposed to ~e annexed; and that at any time before
the.~hour set for hearing objections, any owner of property
within said territory may file with the City Clerk a
written protest against the annexation. Said protest shall

be in writing and shall state the name'of the owner of the
property affected and the description' and area of the
property in. general terms.
BE IT FURTHER RESOLVED that .the City Clerk
be, and he is hereby, authorized and directed to cause a
copy of this Resolution to be published at least twice,
but not oftener than once a week, in a newspaper of general
circ~latiOn,;~, published in the ~ity, to wit: The Tustin
News of Tustin, Orange County, California, and also in a
newspaper of general circulation, published outside of the
City, but in the County of Orange, in which is located the
territory hereinabove proposed to be annexed to~ the City
of Tustin, to wit' Orange Daily News, Orange, California;
and that such publication shall be completed at least twenty
(20) days prior to the date of hearing hereinabove specified.
AND BE IT FURTHER RESOLVED'that the City Clerk
of the City of Tustin be, and he is hereby, authorized and
directed to cause written notice of such proposed annexation
to be mailed to each person to whom land within the territory
proposed to be annexed is assessed, in the last equalized
county assessment roll available, on the date the proceedings
were initiated, at the address shown on said assessment roll
or as known to said City Clerk, and to any person who has
filed his name and address and the designation of lands in
which he has any interest, either legal or equitable, with
said Clerk; and in the event that land within the territory
proposed to be annexed to the City of Tustin is owned by a
County, the City Clerk of the City of Tustin shall also
cause written notice of such proposed annexation to be
mailed to the Board of Supervisors of such County. The
foregoing notices shall be given not less' than twenty (20)
days before the first public hearing on the proposed annex-
ation.
PASSED AND ADOPTED by the City Council of
the City of Tustin, California, at a regular meeting hhereof
held on the 6th day of April, 1959.
