HomeMy WebLinkAboutCC RES 458RESOLUTION NO. 458 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF TUSTIN, DESIGNATING THE TERRITORY AS THE "IRA L. MARCHANT ANNEXATION"; DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED, AND GIVING NOTICE OF THE DAY, HOUR AND PLACE, WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF TUSTIN. WHEREAS, the City Council of the City of Tustin did on the 2nd day of February, 1959, receive a written petition asking that certain new territory described in said petition be annexed to the City of Tustin; and WHEREAS, before the filing of said petition, the proposal for the annexation of the territory hereinafter described to the City of Tustin was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, SAID TERRITORY PROPOSED to be annexed to.: said City of Tustin is situated in the County of Orange, State of California, and is contiguous to the City of Tustin and is uninhabited territory, and said petition containad a description of said territory in words and figures as here- inafter in this Resolution described; and '~, ~ the City Council finds from evidence ~.?.HEHEAS, and reports received that at the time of the filing and receipt of said petition, it was and now is signed by owners of not less than one fourth (1/4) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and WHEREAS, the City Council finds from evidence and reports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to the said City of Tustin did not form a part of any municipal corporation and that said territory was uninhabited and is contiguous to the to the City of Tustin; and WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Tustin are as follows, to wit' Beginning at the intersection of the center lines of Tustin Avenue, 66 feet wide, formerly known as Newport County ~oad, and Main Street, 80 feet wide, as shown on a Map of Stafford and Tustin Tract, recorded in Book 2, pages 618 and 619, Miscellaneous Records of Los Angeles County, California, said intersection being an angle point in the boundary of the City of Tustin; thence following along the Southerly and Southwesterly boundary lines of the City of Tustin, the following courses and distances: thence Easterly 44.00 feet to an angle point; thence South 00° o4' 5~" East 666.72 feet to an angle point; thence South ?1 03' 14" East ?14.76 feet to an angle point; thence South 67°32' 34" East 364.07 feet to the East line of that certain parcel of land conveyed by James A. and Ida McCalla, husband and wife, to the State of California, by deed recorded in Book 2515 on page 128, Official Records of Orange County, California, said intersection being an angle point in the City boundary line; thence departing from said City boundary line and running Southerly along property line, 65.25 feet, a little more or less, to the Southeast corner of said parcel; thence Westerly, parallel to the center line of Sixth Street, and along property lines 358.62 feet to the East line of Lot "0" of said Stafford and Tustin Tract, also being the Southwest corner of parcel conveyed by Charles A. and Martha J. Thorman to the State of California, by deed recorded in Book 2486 on page 76, Official Records of Orange County, California; thence South 0° 48' 45" East along the East line of said Lot "0" as delineated on Record of Survey, record ed in Book 26, page ¥4, records of Orange County Calif- ornia, a distance of 391.00 feet, more or less to a Point, distant Northerly 395.03 feet from the Southeast corner of said Lot "0", shown on said "Record of Survey"; thence South 89° 0~' 00" West, 729.55 feet along a line parallel to the South line of said Lot "), and its Westerly extension thereof to the West line of said Tustin Avenue, 66 feet wide; thence Northerly along West line of said Tustin Avenue 562.32 feet, more or less to the most Southerly corner of land described in "Final Order of Condemnation of Parcel 10, "recorded August 11, 1954, in Action No. 61400 Superior Court of Orange County, California, a certified copy of which was recorded August 16, 19~, in Book 2?93, page ~23, of Official Records, Orange County, California; thence Northwesterly following along the Southwesterly right of way line of the Santa Ana Freeway, the following courses and distances of Parcel 10, above ~entioned, North 24 01' 49~ West 104.25 feet, South 89 55' 05" West 230.66 feet, North 40°04' 45" West 174.10 feet to the Northerly line of the South one half of Lot "F" said Stafford and Tustin Tract, also being the Northwest corner of Parcel 10 said Final Order of Condemnation; thence continuing Northwesterly along said Santa Aha Freeway ri_ght of way line, the following courses; thence North 14~ 39' 35" West 185.60 feet; thence North 45°05' 10" West 162.31 feet; thence North 62° 20' 54" West 276.14 feet; thence North 68o27' 40" West 597.40 feet, to a point in a line drawn parallel with and distant 50.00 feet Southerly, measured at right angles from a point on the center line of Main Street, said Stafford and Tustin Tract, said point bears South O0° 29' 35" East 50.00 feet from a point i~ the center line of Main Street, which bears North 89 30' 25" East 373.60 feet from the intersection of the center lines of Williams Street and Main Street; thence depa~,t- from the Southwesterly right of way line of Santa Ana Freeway and running thence North 89° 30' 25" East parallel to center line of ~ain Street; 39.90 feet, more or less to the ~outherly prolongation of the 2e~t line of Lot "D" of said Stafford and Tustin Tract; thence Northerly along said Southerly prolongation and continuing along said West. line of Lot "D", 206.90 feet, more or less to an angle point in the Northeasterly right of way li'ne~':of Santa Aha Freeway as established by deed from Clara E. Paul, a widow, to the State of California, recorded in Book 3285, .page 542, Official Records of Orange County, California; thence South 68© 41' 16" East along said right of way 240.96 feet a little more or less to an angle point; thence South ~6° 36' 15" East along said right of way ~12.25 feet to a point in the North line of ~ain Street, said point being 40.00 feet Northerly measured at right angles from the center line of ~iain Street; thence Easterly along the North line of Main Street and its Easterly prolongation to the center line of Tustin Avenue, also being in the Westerly boundary of the City of Tustin; thence Southerly along said city boundary .40.00 feet to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN' . That such proposed annexation be designated as "IRA L. MARCHANT ANNEXATION" to the City of Tusti~ and that notice of such proposed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that the 16th day of March, 1959, at the hour of 7' 30 o'clock P. M., at the City Council chambers in the City Hall of the City of Tustin be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests in made by any owner or owners of real property with the said ,. ,, territory proposed to be annexed; and that at any time before the hour set for hearing objections, any owner of property within said territory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the nan~of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby, authorized and directed to cause a copy of this ~esolution to be published at least twice~ but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit; The Tustin News of Tustin~ Orange County~ California, and also in a newspaper of general circulation~ published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Tustin, to wit: ~range Daily News, Orange, California; and that such publication shall be completed at least ~wenty (20) days prior to the date of hearing hereinabove specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Tustin be, and he is hereby, autho~ ized~ and directed to cause written notice of such propos~ed annexation to be mailed to each person to whom land with- in the territory proposed to be annexed is assessed, in'the last equalized county assessment roll available, on the date the proceeedings were initiated, at the address sh~n on said assessment roll or as known to said City Clerk, and to 'any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the terri- tory proposed to be annexed to the City of Tustin is owned by a County, the City Clerk of the City of Tustin shall also c~use written notice of such proposed annexation to be mailed to the Board of Supervisors of such County. The foregoing notices shall be given not less then twen~ (~0) days before the first public hearing on the proposed annexation.
