RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN APPROVING PLANS AND SPECIFICATIONS
FOR THE IMPROVEMENT OF 2ND STREET FROM
PACIFIC STREET TO "B" STREET AND MAIN STREET
FROM PACIFIC STREET TO CALIFORNIA STREET
AND CALIFORNIA STREET FROM MAIN STREET TO
THIRD STREET.
WHEREAS, it is the intention of the City Council of
the City of Tustin to make certain improvements on a portion
of Second Street, Main Street and California Street.
WHEREAS, the City Engineer has presented plans snd
specifications for the proposed improvement of a portion of
Second Street,~ Main Street and California Street.
NOW. THEREFORE, be it resolved that the plans and
specifications presented by the City Engineer be ~nd are
hereby approved as the plans and specifications for the improve-
ment of portions of Second Street, Main Street and California
Street. ~
BE IT FURTHER RESOLVED THAT the City Clerk is hereby
authorized and directed to advertise as required by law for
the receipt of sealed bids or proposals for the doing of the
work specified in the aforesaid plans and specifications,
which said advertisement shall be substantially in the.
following words and figures, to-wit:
"NOTICE INVITING SEALED PRO?0SALS"
In pursuance of a resolution of the City Council of the
City of Tustin, Orange County, California, adopted directing this
notice, NOTICE IS HEREBY GIVEN that the said City Council will
receive at the office of the City Clerk in tb.e City ~all of the
City of Tustin, on or before the hour of ?:30 o'clock P. M.,
on the ~th day of August, 19~8, sealed bids or proposals for
the improvement of portions of Second Street, Main Street and
California Street.
Bids must be made on a form provided for the purpose
addressed to the City Council, Tustin, California, marked
"Bid for the Improvement of Second Street, Main Street and
California Street."
Notice is hereby given bidders that in accordance
with the provisions of Section 1770 of the Labor Code, the
City Council of the City of Tustin has ascertained the prevailing
rate of per diem wages for each craft or type of workman or
mechanic needed to execute the contract which will be awarded
the successful bidder, to be as follows:

The mif'~imum wages paid to all skilled labor, for which rates
are not shown above, shall be not ].ess than ~2.50 per hour.
Overtime and holidays (except watchmen, guards and flagmen)
one and one-half (1-1/2) time the above rates. In addition
to Sundays, holidays shall be New Year' s Day, Memorial Day,
Fourth of July, Labor Day, 'Veteran's Day, Thanksgiving Day,
and Chri s tmas.
The foregoing prevailS, rig wage schedules are based upon a
working day of eight (8) hours, and in the event that
laborers, Workmen or mechanics are employed less than eight
(8) hours per day', the rate of per diem wages shall be
deemed to be that multiple of the foregoing rates that the
number of ho'mrs of employment bears to e~_ght (8).
In accordance with the provisions of Section 1777.5 of the
Labor Code as ~,mended by Chapter 971, Statutes of 1939, and
in accordance wi th the regulations of the California ...&ppren-
ticeship Council, properly indentured ;:-~pprentices may be
employed in the prosecution of the work. ~

The bidder must submit with his proposal a satisfactory
check certified by a responsible bank and payable to the order
of the City' of Tustin, or a bidder's bond, for an amount not
less than ten (10) per ce~t of the aggregate sum of the bid,
as a guarantee that the bidder will enter into the proposed
contract if the s~;,me is awarded to him, and in event of
failure to enter into such contract said check or boz~d shaI1
become the property of the City.
The amount of the bond to be given to secure a faithful
performance of the Contract for said work shall be fifty (~0)
per cent of the contract price thereof, and an additional bond
i.n an amount equal to fifty ()0) per cent of the contract price
for said work :shall be given to secure the payment of claims
for any materials or supplies 2urnished for the performance
of the work contracted to be done by the Contractor, or any
work or labor of any kind do'ne thereon and the Contractor
will also be required to furnish a certificate that l~e carries
compensation insurance covering bis employees upon work to be
done under contract which may be entered into between him
and the said City .for the construction of said work.
No bid will be accepted from a Contractor who is not
licensed in accordance with the prov.isions of the Contractors
License Act, or to whom a proposal form has not been issued
by the City Clerk.
The work is to be done in accordance with the profiles, plans
and specifications of the City of Tustin on file in the office
of the City Clerk, of the City I[all of Tustin, California.
Copies of the plans and specif..ica, ti°ns will be furnished upon
application to the City Clerk.'
The City Council of the City of Tustin reserves the right to
reject any and all bi. ds.

That the City Council of the City of Tustin has
ascertained and does hereby determine that the general prevailing
rate of per diem wage in the locality of the City of Tustin~
California, for each craft or type of workman needed to execute
the work hereinabove specified, is as set forth in the form Of
notice hereinabove set forth, and said notice shall contain
said schedule of per diem wages to be paid to the workmen
in said work.
