RESOLUTION NO. 444
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, DETERMINING USE ZONING AND
BUILDING LINE SETBACK REQUIREMENTS TO BE ESTABLISHED
WITHIN THE TERRITORY DESIGNATED "GREATER TUSTIN
ANNEXATION" TO THE CITY OF TUSTIN, WHICH ZONING
AND BUILDING LINE REQUIREMENTS SHALL BE CONTINGENT
UPON FINAL ANNEXATION OF SAID TERRITORY TO THE CITY
OF TUSTIN AND THE ADOPTION OF AN ORDINANCE FIXING
AND DETERMINING SAID REQUIREMENTS.
WHEREAS, Ordinance No. 105 of the City of Tustin requires
that the City Council of the City of Tust~[n make a determination
concerning t~e zoning and building line setback requirements of
territory .proposed. to be annexed to the City of Tustin, contingent
upon final annexation of such territory to the: City; ~-.~nd
WHEREAS, the Planning Commission of the City of Tustin
duly held a public }~earing on the 14th d~.:~y of July, 19~8, regarding
the ase zoning and building line setback requirements to be
established witiiin the "Greater T~s6in Anne.×ation" to the City of
Tust~_n, after notice of said hearing had been duly given all in
accorda, nce wi th Ordinance No. 105 of the City of Tustin, and the
applicable statutes of the State of California; and
WHEREAS, the report, recommendations, and.. maps attached
thereto, of the Planning Commission of t.he City of Tustin concern-
the use zoning and building line setback requirements For the
"Greater Tustin Anne.xation" to the City of Tusti. n were duly
received by the City Council of the City o£ Tustin on the 15th
day of July', 1958; and
WHE]tEAS, the City Council of the City of Tustin, after
notice duly given in ~.~.~ccordance wit}'~ the requirements of Ordinance
No. 105 of the City of Tustin and the s.pp!icable statutes of the
State of California, duly held a public b. earing on July 21, 1958,
For the purpose of determining use zoning and build.~.ng line setback
requirements to be established in the territory designated
"Greater Tust~.~ Annexation" to the City' of Tustin, which territory

~.s more particularly described in Resolution No. 4~2 of the :.City
Cot:ncil of the City of Tustin, a copy of which is attached hereto,
marked Exhibit "A", and made a part hereof by reference; and
WHEREAS, the City' Council has considered all of the
foregoing and £ind. s and determines that public necessity, con-
ve~.~ience, general welfare, and good zoning pract.ice require a
determination that should., the property described as "Greater Tustin
Annexation" to the City of Tustin be annexed to the City of Tustin,
that the use zoning and building line setback requirements to be
established 'within said territory be those recomn~ended ?~y the
Planning Commission of the City' of Tustin by letter from the Planning
Commission dated July 15, 1958, and in accordance with the maps
attached to said letter designated "Zoning Map, Greater Tustin
Annexation to the City of Tustin", dated July 10, 1958, and
District Bldg. Line Map, Greater Tustin Annexation to the City
of Tustin", dated July 10, 1958, except that the uses permitted in
"Estate Zone" under Ordinance No 113 of the ~.ty of Tustin be
amended to conform to the uses permitted under the "E-~ Zone" under
the County Land Use Ordina~ce presently in effect, if the uses
permitted under the County "E-4 Zone" are more restrictive than
those permitted under the "Estate Zone" ~.~s defined in Ordinance
No. 113 of the City of Tustin.
NOW, THEREFORE, be it resolved as follows'
That in the event the territory described hereinabove
as "Greater Tustin Annexation" to the City of Tustin, be finally
annexed to the City of Tustin, the use zoning and building line
setback requirements to be established in said territory sha.].l be
those recommended by the Planning Commission of the City of
Tustin by letter of July 15, 1958, and in accordance with the map
attached to said. letter designated "Zoning Map, Greater Tustin
Annexation to the City of Tustin", and District Bldg. Line Map,
Greater Tustin Annexation to the C_~.ty of Tustin", a copy of said
letter of the Planning Commission and copies of the maps designated
"Zoning Map, Greater Tustin Annexation to the City of T~stin" and

"District B1U. g. Line Map, Greater Tustin Annexation to the City of
Tustin" are attached hereto, marked Exhibit "B", and. made a part
hereof as fully as if they were set out herein in full, except that
· the uses permitted in "Estate Zone" under Ordinance No. 113 of the
City of Tustin be amended to conform to the uses permitted under
the "E-~ Zone" under the County Land Use Ord~.nance presently in
effect', if the uses permitted under the County "E-4 Zone" are
more restrictive than those permitted, under the "Estate Zone" as
defined in Ordinance No. 113 of the City of Tustin.
That if the election required in the proceedings
under the "Annexation Act of 1913" as it pertains to the "Greater
Tustin Annexation" to the City of Tust~n is favorable, the City
Council of the City of Tustin shall by Or~i~ance set forth and
describe the zoning requirements here~n contained, and a map
thereof, and the bull. dims line setback requirements contained
herein, and a map thereof.
PASSED AND ADOPTED by the City Council of the City of
Tustin a.t ~ regular meeting thereof held on the 21st day of
July, 1958.
