HomeMy WebLinkAboutCC RES 437RESOLUTION NO. 437 A RESOLUTION' OF THE CITY COUNCIL OF THE CITY OF TUSTIN CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF INHABITED TERRITORY TO THE CITY OF TUSTIN. WHEREAS, ROBERT L. STEVENS, JOHN A. SIEGEL, HENRY V. EASTMAN, HAZEL J. EASTMAN, ALBERT E. FARNSWORTH, W. R. NELSON, WALTER W. PERSHALL, HARRY LOUIS HANSON JR., ARNOLD V. IVERS, Ai{LEY E. BEESON, HAROLD D. CARSON, ROGER A. WILLIAMS, EUGENE E. JACOBSON, HAROLD H. JACOBSON, MRS. CLIFF EVERMAN, D. W. TUBBS, NORMAN M. VEEH, WILBUR S. VAUGHAN, DONALD E. BROWN, and HAROLD R. BRUCE have filed with the City Council a written request, requesting the consent of the City Council of the City of Tustin to the commencement of proceedings for the annexation of the herein- after described territory and. is contiguous to the City of Tus tin; and WHEREAS, the City Council does find and determine that it would be to the advantage and benefit of the City of Tustin; and to the qualified electors residing within said territory, to permit the above named proponents to commence proceedings for the annexation of said territory to the City . of Tustin, upon the conditions hereinafter set forth; and WHEREAS, the City Council does find and determine that the design of subdivisions and. the construction of build- ings and public improvements within said territory are not inferior to standards required by ordinances and regulations of the City of Tustin, and WHEREAS, said request has been referred, to the City Planning Commission and its report and recommendations received recommending the gra.nting of consent to commence proceedings for annexation of said territory to the City of Tustin. NOW, THEREFORE, BE IT RESOLVED by the City Council of i ' the City of Tustin that the consent of the City Council be and it is hereby given to said proponents to commence proceedings for the annexation of the hereinafter described territory to the City of Tustin, upon the following conditions- First' That the proposal for annexation of said territory to the City of Tustin shall be submitted to and reported upon to the proponents by the Boundary Commission of the County of Orange, with respect to the definiteness and certainty of the proposed boundaries. S~.pond- That no petition be circulated for the annexation of said territory until after notice of intention to circulate such petition has been published as required by law, and a copy of such notice and an affidavit of publication has been filed with the City Clerk of the City of Tustin within ten (10) days after the date of publication of said. notice, and a resolution has been adopted by the City Council of the City of Tustin acknowledging receipt of said notice and. approving the circulation of said petition. Thir___~d' That the circulation of any petition for the annexation of said territory to the City of Tustin shall not be commenced until twenty-one (21) days after the publication of said notice of intention to circulate the same. The boundaries of the territory for which proceedings are proposed to be commenced for the annexation thereof to the City of Tustin are marked Exhitit "A" attached hereto and incorporated in this resolution as though fully set forth at this place.
