HomeMy WebLinkAboutCC RES 423RESOLUTION NO. 423 A RESOLUTION OF INTENTION TO ANNEX CERTAIN TERRITORY DESCRIBED HEREIN TO THE CITY OF TUSTIN PURSUANT TO THE ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939, AS AMENDED, DESCRIBING THE TERRITORY TO BE ANNEXED, DESIGNATING THE NAME OF THE ANNEXATION AS "SAMUEL TUSTIN ANNEXATION TO THE CITY OF TUSTIN" AND GIVING NOTICE OF A TIME AND PLACE FOR HEARING OF PROTESTS THERETO. WHEREAS, the re has been presented to the City Council of the City of Tustin a written petition requesting that the territory hereinafter described be annexed to the City of Tustin; and WHEREAS, the City Council of. the City of Tustin finds that said petition was duly signed in accordance with the Annexation of Uninhabited Territory Act of 1939, as amended, by the owners of more than one-fourth of the area and assessed valuation as shown on the last equalized assessment role of Orange County, and that there are less than twelve registered voters residing within the area hereinafter described, and in all other respects said petition conforms to the laws of the State of the State of California. NOW THEREFORE, the City Council of the City of Tustin does resolve as follows: Section 1. The City Council of the City of Tustin does intend to proceed with the annexation of territory hereinafter described under the provisions of the Annexation of Uninhabited' Territory Act of 1939, as amended. Section 2. The subject annexation shall be known .and designated as "Samuel Tusttn Annexation to the City of Tustin". Section 3. That the City Council of the City of Tustin will hear protests made by any person owning real property within the territory proposed to be annexed on the 28th day of October, 1957, at 6:30 P. N. in the Council Chambers in the Tustin City Hall at 14~ West Third Street, Tustin, California. At any time before said hour any owner of any of said · property may file w~itten protest against this proposed annexation. I - i Such p~otest should state the owner's name and in general terms. a description and the area of the property owned. Section 4- That the territory proposed to be annexed is described as follows: Beginning at the intersection of the Northwes'terly line of the Irvine Subdivision as shown on a map recorded in Miscellaneous Record Maps, Book l, page 88, Orange County, California, with the Easterly extension of the Northerly right of way line of Main Street (formerly Fourth Street) as shown on a map of Yorba's Subdivision, recorded in Book 28, page 10, Miscellaneous Records of Los Angeles County, California, said point of beginning being an angle point in the City of Tustin boundary line thence S 53o02' W 133.07 feet to the intersection of the South right of way line of Main Street (80 feet wide) with the North- westerly right of w.ay line of Newport Avenue (60 feet wide) thence South 40°00' West (record) along the Northwesterly line of Newport Avenue (60 feet in width) 1773.20 feet a little more or less, to an intersection with the Northeasterly line of Laguna Road and City of Tustin boundary line. Thence north- westerly, northerly, easterly northerly, easterly, northerly and easterly, following along City of Tustin boundary line, to the point of beginning. PASSED AND ADOPTED by the City Council of the City of Tustin, California, at a regular meeting thereof held on the 10th day of September, 1957.
