HomeMy WebLinkAboutCC RES 406RESOLUTION NO. 406 RESOLUTION OF INTENTION TO ANNEX TERRITORY PURSUANT TO THE ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939, DESCRBING THE TERRITORY TO BE ANNEXED, DESIGNATING THE NAME OF THE ANNEXATION AS "REVERE ANNEXATION TO TUSTIN" SETTING FORTH THE REASONS FOR SAID ANNEXATION AND SETTING A TIME AND PLACE FOR HEARING OF PROTESTS THERETO. The City Council of the City of Tusttn does resolve as follows: Section 1. That the City Council of the City of Tustin on it's own motion, does intend to annex pursuant to the annexation of "Uninhabited Territory Act of 1959" that contiguous territory described as follows: 2eginning at a point in the West line of Tustin Avenue (65 feet wide) bearing N. 0° 17' 30" '~est 288.7~ feet from the Southeast corner of the North one-half of Lot "E" as shown on a map of the Stafford and Tustin Tract, recorded in Miscellaneous Records, Book 2, pages 618 and 619, records of Los Angeles County, California, said Southeast corner being in the West li~e of Tustin Avenue (66 feet wide); thence S. 89 28' 10" West, parallel to the center_line of First Street, 170.98 feet; thence N. 0°09'00'' '~'~Jest 396.~0 feet to the North line' of First Street (66 feet wide); thence West along the North line of First Street to a point which is distant Westerly 23~.80 feet from the West line of Tustin Avenue (60 feet wide) as it exists North of First Street; thence North 200 feet; thence East 51~.80 feet to the Westerly boundary line of the City of Tustin; thence Southerly, Southeasterly and Southerly along said boundary line of the City of Tustin to the Easterly prolongation of the South line of the said North one-half of Lot "E" of the Stafford and Tustin Tract; thence West ~3 feet to the West line of Tustin Avenue; (thence Northerly along the West line of Tustin Avenue to the point of beginning. SECTION 2. That the City Council of the City of Tustin does find and determine that there are less then twelve voters entitled to vote in the territory and residing in said area hereinabove described. SECTION 3. That the hereinabove described territory has been approved as to descripti, on by the Boundary Commission of the County of Orange. · SECTION 4. That the reasons the City Council of the City of Tustin desires to annex said territory are as follows: 1. To provide better fire and police protection to the area to be annexed. 2. To establish city control over zonin£~, traffic and related matters affecting the territory which is de~med to be within the sphere of influence of the City of Tustin. 3. To protect the Tustin Elementary School District from encroachment by the City of Santa Ana and the Santa Ana School District. 4. To increase the size of the City of Tustin. S]~!iCTION ~. That said proposed annexation shall be known and designated as "REVERE ANNEXATION TO TUSTIN." SECTION6. The City Council of the City of Tusttn will hear protests made by persons owning real property within the territory proposed to be annexed on January 14, 19~?, at 8:00 o'clock ?. M. in the City Council Chambers of the City Hall, 14~ '~est Third Street, Tustin, Califor'nia.
