HomeMy WebLinkAboutCC RES 405 RESOLUTION NO. 405 A RESOLUTION OF INTENTION TO ANNEX TERRITORY PURSUANT TO THE ANNEXATION OF UNININHABITED TERRITORY ACT OF 1959, DESCRIBING THE TERRITORY TO BE ANNEXED, DESIGNATING THE NAME OF THE ANNEXATION AS "HILLVIEW ANNEXATION TO TUSTIN,' SETTING FORTH THE REASONS FOR SAID ANNEXATION, AND SETTING A TIME AND PLACE FOR HEARING PROTESTS THERETO. The City Council of the City of Tustin does resolve as follows: Sectton.._l. That the City Council of the City of Tustin, on it' s own motion, does intend to annex pursuant to the Annexation of Uninhabited Territory Act of 1939, that contiguous territory described as follows: Beginning at an an~!~le point in the boundary line of the City of Tustin, as now established, said point being the intersection of a line parallel with and distant ~40.00 feet North of the center line of First Street with a line parallel with and distant ~0.00 feet East of the surveyed center line of Tustin Avenue; thence ~est 20.00 feet to the East line of Tustin Avenue (60 feet in width); thence Northerly along the said East line of Tustin Avenue 408.72 feet, a little more or less, to the Easterly prolongation of the Northerly line of Fourth Street (60 feet in width) as shown on a map of Tract No. 678, recorded in Book 32, page ll, Miscellaneous Maps, records of Orange County, California; thence Westerly along the said Easterly prolongation and the North line of Fourth Street, a distance of 270.00 feet to a point; thence Northerly, parallel to the center line of Tustin Avenue, as shown on said map of Tract No. 678, 1671.16 feet to the North line of Fruit Street (40 feet in width, formerly Depot Street) as shown on a map of "Maybury Tract" recorded in Book ~6, page 6~ of i¥Itscellaneous Records of Los Angeles County, California; thence Westerly along said North line of Fruit Street, 419.00 feet; thence Northerly parallel to the center line of Tusttn Avenue, 1207.66 feet to the South line of Lot 4 of said "Maybury Tract"', thence '~est, along the said South line of Lot 4, 799.60 feet, more or less, to the Southwest corner thereof; thence Northerly along the West line of said Lot 4 and along the West line of Lot I of said "Maybury Tract" 1264.~4 feet, to the Northwest corner of said Lot i of the "Maybury Tract", said Northwest. corner being 2~.00 feet South of the surveyed center line of Seven- teenth Street; thence Easterly along the ilorth line of said Lot l, a distance of 966.60 feet to the Southerly prolongation of the ~esterly line of Tustin St. (60 feet wide) as shown on a map of a Record of survey, recorded in Book l~, page 4, Record of Surveys, records of Orange County, California; thence Northerly along said Southerly prolongation and continuing al.ong the said west line 1346.9~ feet to the Westerly' prolongation of the North line of Lot 13, in Block "B" · ~ as shown on a map of A. B. Chapman Tract surveyed by Wrank Lecouvreur in 1870; thence Easterly along said ~esterly prolongation and alon~ the .North line of Said Lot 13,..Block "B", 13~1.9~ feet to the North- east corner of said Lot lS; thence Southerly along the East line of said Lot lS, Block"B" to the Northeast corner of Tract No. lOS1, re- corded in Book 3~, page 43, Miscellaneous Maps, Records of Orange County, California; thence Westerly along the North line of said Tract No. lO31 to the East line of Lot 9, as shown on said map of Tract No. lO3l; thence Southerly along the East line of Lots 6 and ~ of said Tract No. lOS1 to the South line of the North 130.00 feet of said Lot ~; thence Easterly along said South line to a property line being approximately lO.O0 feet Easterly, measured at right angles, from the West line of said Lot ~ and Lot 4 of said Tract No. lO3l; thence Southerly along said property line and it's Southerly prolongation to the South line of Seventeenth Street (6~ feet wide) as s~o.~ on said map of Tract No. lO31; Thence Westerly along said South line of Seventeenth Street, 399.~6 feet to a point ~0.00 feet Easterly from the surveyed center line of Tustin Avenue; thence Southerly, parallel with sai'd surveyed center line of Tustin Avenue, 74~.81 feet to a point; thence Westerly 20.00 feet to a point ~0.00 feet East, measured at right angles from the center line of Tustin Avenue (60 feet wide); thence Southerly along the Easterly line of Tustin Avenue (60 feet wide) ~178.78 feet to a point 271.28 feet Northerly from the Easterly prolonEation of the North line of Mou~th street, as shown on a map of said Tract No.~?8; thence Easterly parallel to the center line of First Street, 210.00 feet; thence Southerly, parallel to the center line of Tustin Avenue, 680.00 feet to the Northerly boundary line of the City of Tustin; thence Westerly along said boundary line 190.00 feet to the point of beginning. Section 2. That the City Council of the City of Tustin does find and determine that there are less than twelve voters entitled to vote in the territory and residing in said area hereinabove described. Section 3. That the reasons the City Council of the City..0f Tustin desires to annex said territory are as follows: 1. To provide better fire and police protection to the area to be annexed. 2. To establish city control over zoning, traffic and related'matters affec ting the territory which is deemed to be within the sphere of influence of the City of Tustin. .3. To protect the Tustin Elementary School District from encroachment by the City of Santa Ana and the Santa Ana School District. 4. To increase the sige of the City of Tustin. Section 4. That said proposed annexation shall be known and disginated as "Hillview Annexation to Tustin." Section ~.' The City Council of the City of Tustin will hear protests made by persons owning real property within the territory proposed to be annexed on December .31st, at ~:00 o'clock P. ~., in the City Chambers at the City Hall, 1)-I.~ West Third Street, Tustin, Califo2enia.
