HomeMy WebLinkAboutCC RES 401RESOLUTION NO. 401 RESOLUTION OF THE CITY OF TUSTIN OF INTENTION TO AMEND ORDINANCE NO. 71 OF THE CITY OF TUSTIN. WHEREAS, there is no special procedure set up for the zoning of property being annexed to the City of Tustin; and WHEREAS, the City Council deems that the best interests of the City of Tusttn will be served by establishing special procedure for the zoning and providing of building setback lines on property being annexed to the City of Tustin, NOW, THEREFORE, the City Council of the City of Tustin does resolve as follows: Section 1. The City Council of the City of Tustin does propose and intend to amend Ordinance No. 71 of the City of Tustin for the purpose of establishing special provisions for the handling of the annexation of property to the City of Tustin, which provisions will provide that during the pending of a hearing on annexation that the Planning Commission of the City of Tustin will report it's recommendations to use zoning, and building line setbacks so that the City Council of the City of Tustin shall, after the public hearing in connection with any annexation, and after the adoption of an ordinance relating to annexation made by seperate ordinance at the same time and place immediately after public hearing on annexation, fix and determine by ordinance the use zones and building line setbacks of any territory being approved for annexation to the City of Tustin. Section 2. That this resolution of intention to amend Ordinance No. 71 shall be referred to the Planning Commission of the City of Tustin by the City Clerk, and the Planning Commission of the City of Tustin shall hold a public hearing on said proposed amendment as provided by Section 18 C.1 of said Ordinance No. 71 and report back to the City Council with it's recommendations within thirty (30) days from the date of this Resolution.
