RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF SOUTH "C" STREET AND WEST SIXTH STREET, BEING PROJECT NO. 23, MEMORANDUM OF AGREEMENT, MAJOR CITY STREETS, AND AUTHORIZ- ING AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. WHEREAS, it is the intention of the City Council of the City of Tustin to make cemtain improvements on South ':C" Street and West Sixth StPeet; and ,. WHEREAS, the City Engineer has presented plans and speci- fications for the proposed improvement of South "C" Street and West Sixth Street. NOW THEREFORE, be it resolved that the plans and specifi- cations presented by the City Engineer be and are hereby approved as the plans and specifications for the improvement of South "C" Street and West .Sixth Street. BE IT FURTMER' RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids er proposals for the doing of the work specified in the aforesaid plans and specifications, which said advertisement shall be substantially in the following words and ftgure s, to-wi t: "NOTICE INVITING SEALED PROPOSALS" , In pursuance of a resolution of the City Council of the City of Tustin, Orange County, California, adopted directing this notice, NOTICE IS HEREBY GIVEN that 'the said City Council will receive at the office of the City Clerk in the City Hall of the City of Tustin, on or before the hour of 7:30.o'clock p. m., on the l~th. day of September, 1956 sealed bids o~ proposals for the improvement of South "C~ Street and West Sixth Street, in the City of Tustin, California. Bids must be made on a form provided for the purpose, addressed to the City Council, Tustin, California, marked "Bid for the Improvement of South"C" Street and ~est Sixth Street." Notice is hereby given bidders that in accordance with the provisions of Section 1770 of the Labor Code, the City Council of the City of Tustin has' ascertained the prevailing rate of per diem wages for each craft o~ type of workman or mechanic needed to execute the contract which will be awarded the sucessful bidder to be as follows: CLASSIFICATION RATE PER HOUR Motor Patrol Operator, including any type of power blade-- $3.06 Skip Loader Operator--wheel type 2.77 Laborers, General or Construction 2.30 Truck Drivers - 12 yds. but less than 16 yds. water level Truck Drivers 8 yds. but less than 12 yds. water level 2.385 Truck D~ivers yds. but less than yds. water level 2.335 F1 agman 2.30 Asphaltic Spreading, Mechanical Tamping Finishing Machine Operato~ Rolle~ Ope~ato~ P~®umati¢ or Electric ~ool Operato~ $2.77 2.69 Overtime--one and one-half (1~}.~ times the above rates. Sundays and holidaY.s (except watchmen, guards and flagmen) one and one-half (l~) times the above rates. The foregoing prevailing wage 'schedules are based upon a working day of eight (8) hours, and in the event that laborers workmen or mechanics are employed less than eight (8) hours per day, the rate of per diem wages shall be deemed to be that multi- ple of the foregoing rates that the number of hours of employ- ment bears to eight (8). In accordance with the p~ovisions of Section 1777.5 of the Labor Code as amended by Chapter 971, Statutes of 1939, and in accordance with the regulations of the California Apprentice- ship Council, properly indentured apprentices may be employed in the prosecution of the work. The bidder must submit with his proposal a satisfactory check certified by a responsible bank and payable to the order of the City of Tustin, or a bidder's bond, for an amount not less than ten (10) percent of the aggregate sum of the bid, as a guaran- tee that the bidder will enter into the proposed contract if the same is awarded to him, and in event of failure to enter into such contract said check or bond shall become the property of the City. The amount of the bond to be given to secure a faithful performance of. the Contract for said work shall be fifty (50) percent of the contract price thereof, and an additional bond in an amount equal to fifty (50) percent of the contract price £or said work shall be given to secure the payment of claims for any materials or supplies furnished for the performance of the work contracted to be done by the Contractor, or any work or labor of any kind done the~and the Contractor will also be required to furnish a certificate that he carries compensation insurance covering his employees upon work to be done under contra~t which may be entered into between him and the said City for the construction of"' ~'aid work. No bid will be accepted from a Contractor who is not licensed in accordance with the provisions of the Contractors License Act, o~ to whom a proposal form has not been issued by the City Clerk. The work is to be done in accordance wi th the profiles, pIans and specifications of the city of Tustin on file in the office of the City Clerk, of the City Hall of Tustin, California. Copies of the plans and specifications will be furnished upon application to the City Clerk. The City Council of the City of Tustin reserves the right to reject any and all bids.
