HomeMy WebLinkAboutCC RES 397RESOLUTION NO. 397 RESOLUTION OF INTENTION TO ANNEX TERRITORY PURSUANT TO ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939, DESCRIBING THE TERRITORY TO BE ANNEXED, DESIGNATING THE NAME OF THE ANNEXATION · AND SETTING THE TIME AND PLACE FOR HEARING PROTESTS THERETO. . WHEREAS, there has been presented to the City Council of the City of Tustin a written petition requesting that territory hereinafter described be annexed to the City of Tustin; and WHEREAS, the City Council of the City of Tustin finds that said petition was duly signed in accordance with the Annexation of Uninhabited Territory Law by owners of more than 1/4th of the land in the area hereinafter described; and WHEREAS, it appears that the Boundary Commission of the County of 0ramge has approved' said description; and WHEREAS, in all other respects said pet'itton conforms to the laws of the State of California, NOW, THEREFORE, the City Council of the City of Tustin does resolve as follows: Section 1. That the City Council of the City of Tustin does intend to proceed with the annexation of territory hereinafter described under the provisions of the Annexation of Uninhabited Territory Act of 1939. Section 2. The subject annexation shall be known and designed as "ANDREW R. M'0RRIS ANNEXATION TO TUSTIN." Section 3. That the City Council of the City of Tustin will hear protests made by any person owning real property within the territory proposed to be annexed on SEPTEMBER 24th, 1956, at 7:45 P.M. in the Council Chambers at the City Hall, 145 West Third Street, Tustin, California. Section 4. That the territory poposed to be annexed is described as follows: Beginning at the intersection of the center lines of Second Street and Glen Avenue (also known as Tustin Avenue.) as shown on a map of Block "B", Bundy's Addition to Tusttn, recorded in Book ~,'page 5, Miscellaneous Maps, Records of Orange County, California, said intersection being an angle point in the boundary line of the City of Tustin; thence Northerly along the center line of Tustin Ave., (66 feet in width) and the Northerly prolongation thereof to an inter- section with the North line of First Street (80 feet in width); thence Westerly along the Northerly line of First Street to the beginning of a c~r~e t~ngent, concave Northeasterly; thence Northwesterly along said tangent curve, having a radius of 50.00 feet, through an angle of 52' 15", an arc distance of 78.~2 feet to an tangent line, said line being parallel with and 50.00 feet Easterly, measured at right angles from the center line of Tustin Avenue; thence Northerly along said parallel line 450.11 feet to a p.oint; thence Easterly, parallel with the center line of First Street 537.96 feet to an intersection with the East line of that certain Southwest 19.00 Acre parcel shown on a map of Felipe Yorba. Tract. recorded in Book 4, page 206. Miscellaneous Records of Los Angeles County, California: thence South 00~14' 15" East along the east line of. the above' mentioned 19.00 acre parcel 80.46 feet to an iron pipe marking the Southwest corner of the land described as Parcel I in the deed to M. Gladys Watson recorded August 10, 1945, in Book 1323, page 442 of Official Records of Orange County; thence SoUth 89o~i.'~2, 45" East along the South line of M. Gladys Watson Parcel I above mentioned 430.20 feet to a point, said point being 158.00 feet Westerly from the East line of said Feltpe Yorba Tract; thence South 0'~0' 30" East, parallel to the East line of said'Felipe Yorba Tract, 101.60 feet to a point; thence North 895 51' 45" East, parallel to the center line of First Street, 178.00 feet to an intersection with the center line of'Yorba Stree.t (50 feet in width, formerly 40 feet in width) as shown on. a map of Tract No. 3P6, recorded in Book 16 page 10, Miscellaneous Maps, records of Orange County, California said center line of Yorba Street being the boundaz,y line of the City of Tustin; thence Southerly, Westerly, Southerly and Westerly, following the Boundary line of the City of Tustin to the point of beginning. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 13th day of August, 1956. MAYOR Attest: CITY CLERK
