RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN APPROVING PLANS AND SPECIFICATIONS
FOR THE IMPROVEMENT OF SOUTH. "D" STREET, A
MAJOR CITY STREET, BETWEEN LAGUNA AVENUE -
US 101 AND FRONTAGE ROAD ALONG NORTHERLY
SIDE OF SANTA ANA FREEWAY, PROJECT NO. 22,
AND AUTHORIZING AND DIRECTING THE CITY CLERK
TO ADVERTISE FOR BIDS.
WHEREAS, it is the iniention of the City Council of
the City of Tustin to make certain improvements on South "D"
Street; and
WHEREAS, ~he City Engineer has presented plans and
specifications for the proposed improvement of. South "D" Street,
between Laguna Avenue (US 101) and frontage road. along Northerly
side of Santa Ana Freeway.
NOW, THEREFORE, BE IT RESOL~ that the plans and
specifications presented by the City Engineer be and are hereby
approved as the plans and specifications for the improvement of
South "D" Street, between Laguna Avenue (US 101) and frontage
road along Northerly ~ide of Santa Ana Freeway.
BE IT FURTHER RESOLVED thsh the City Clerk is hereby
authorized and directed to advertise as required by law for the
receipt of sealed bids or proposals for the doing of the work
specified in the aforesaid plans and specifications, which said
advertisement shall be substantially in the followin~ words and
figures, to wit:
"NOTICE INVITING SEALED PROPOSALS"
In purs~aance of a resolution of the City Council .of
the City of Tustin, Orange County, California, adopted direct-
ing this notice, NOTICE IS HEREBY GIVEN that the said City Coun-
cil will receive at the office of the City Clerk in the City
Hall of the City of Tustin, on or before the hour of 7:30 O,clock
P. M., on the llth day of April, 1955 sealed bids or proposals
for the improvement of South "D" Street, between Laguna Avenue
(US 101) and frontage road along Northerly side of Santa Aha
Freeway, in the City of Tustin, California.
Bids must be made on a form provided for the purpose,
addressed to the City Council, Tustin, Califsrnia, marked "Bid
for the improvement of South "D" Street."
Notice is hereby given bidders that in accordance with
the provisions of Section 1770 of the Labor Code, the City Coun-
cil of the City of Tustin has ascertained the prevailing rate
of per diem wages for each craft or type of workman or mechanic
needed to execute the contract which will be awarded the succes-
ful bidder, to be as follows:

Overtime - one and one-half (1 ~)gimes tho above rates.
Sundays and holidays (except watchmen, guards and flagmen)

The foregoing prevailing wage schedules are based upon a
working day of eight (8) hours, and in the event that laborers,
workmen or mechanics are employed less than eight (8) hours per
day, the rate of per diem wages shall be deemed to be that multi-
ple of the foregoing ~ates that the number' of hour's of employment
bears to eight (8).
In accordance with the provisions of Section 1777.~ of the
Labor Code as amended by Chapter 971, Statutes of 1939, and in
accordance with the regulations of the California Apprenticeship
Council, properly indentured apprentices may be employed in the
prosecution of the work.

The bidder must submit with his p~oposal a satisfactory
check certified by a responsible bank and payable to the order
of the City of Tustin, or a bidder, s bond, for an amount not
less than ten (10) per cent of the aggregate sum of the bid, as
a guarantee that the bidder will enter into the proposed con-
tract if the same is awarded to him, and in the event of failure
to enter into such contract said check or bond shall become the
property of the City.
The~.amount of the bond to be given to secure a faithful
performance of the contract for said work shall be fifty. (50)
per cent of the contract price thereof, and an additional bond
in an amognt equal to' fifty (%0) per cent of the contract price
for said work shall be given to secure the payment of claims
for any materials or supplies furnished for the performance of
the work 9ontracted to be done by the Contractor, or any work
or labor of any kind done thereon and the Contractor will also
be required to furnish a certificate that he carries compensation

insurance covering his employees upon work to be done under
contract which may be entered into between him and the said City
for the construction of said work.
No bid will be accepted from a Contractor who is not li-

censed in,accordance with the provisions of the Contractors
License A~t, or to whom a proposal form has not been issued by
the City ~lerk.
The worm is to be done in accordance with the profiles,
plans and specifications of the City of Tustin on file in the
office of the City Clerk, of the City Hall of Tustin, California.
Copies of the plans and specifications will be furnished upon
application to the City Clerk.
The City Council of the City of Tustin reserves the right
to reject any and' all bids.

That the City Council of the City of Tustin has ascertained
and does hereby determine that the general prevailing rate of
per diem wage in the locality of the City of Tustin, California,
for each craft or type of workman needed to execute the work
Sereinabove specified is as set forth in the form of notice
hereinabove set forth, and said notice shall contain said
schedule of per diem wages to be paid to the workmen in said
wol~k.
PASSED AND ADOPTED by the City Council of tho City of
Tus tin, California, this 14th day of March, 1955.
