A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN APPROVING PLANS AND SPECIFICATIONS
FOR THE IMPROVEMENT OF PORTIONS OF CERTAIN
PUBLIC STREETS, AS FOLLOWS: MYRTLE STREET
BETWEEN CENTER LINE OF MAIN STREET TO THIRTY
FEET NORTH OF THE NORTH LINE OF SECOND STREET,
PASADENA AVENUE BETWEEN CENTER LINE OF MAIN
STREET TO THIRTY FEET NORTH OF THE NORTH LINE
OF SECOND STREET AND SECOND STREET BETWEEN
PASADENA AVENUE AND MYRTLE STREET
~ ~EtEREAS, it is the intention of the City Council of
the City ~f Tustin to make certain improvements On Myrtle Street,
Pasadena Avenue and Second Street; and
WHEREAS, the City Engineer has~ pre'sented plans and
specifications fo~ the p~oposed improvement of M~tle Street,
Pasadena Avenue and Second Street;
NOW, THEREFORE, be it resolved that the plans and
specifications presented by the~ City Engineer be and they are
hereby approved as the plans and specifications for the improve-
ment of Myrtle Street, Pasadena Avenue and Second Street.
BE IT FURTHER R$SOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for the
~ceipt of sealed bids or proposals for thedoing of the work
specified in the aforesaid plans and specifications, which said
advertisement shall be substantially in the following wo~ds and
fi gure s, to-wit:
"NOTICE INVITING SEALED PROPOSALS"
In pursuance of a resolution of the City Council of
the City of Tustin, 'Orange County, California, adopted direct-
ing this notice, NOTICE IS HEREBY GIVEN that the said City Coun-
cil will receive at the office of t he City Clerk in the City
Hall of the City of Tustin, on o~ before the hour of 7:30
o'clock P. M., on the 22nd day of June, 1953, sealed bids or
proposals for the improvement of Myrtle Street, Pasadena Avenue
a~d Second Street.
Bids ~ust be made on a form p~ovided for the purpose,

addressed to the City Council, Tustin, California, marked Bid
for the Improvement of Myrtle Street, Pasadena Avenue and Second
Street".
Notice is hereby given bidders that in accordance with
the provisions of Section 1770 of the Labor Code, the City Coun-
cil of the City of Tustin has ascertained the prevailing rate of
per diem wages for each craft or type of workman or mechanic
needed to execute the contract which will be awarded the suc-
cessful bidder, to be as follows:

Overtime- one and one-half (1~) times the above
Sundays and holi_days (except watchmen, guards and
flagmen) one and one-half (lmA) times the above ~ates.
The foregoing prevailing wage schedules are based
upon a working day of eight (8) hours, and in the event that
laborers, workmen or mechanics are employed less than eight (8)
hours per day, the rate of per diem wages shall be deemed to be
that multiple of the foregoing rates that the number of hours
of employment bears to eight (8).
In accordance with the provisions of Section 1777.5
of the Labor Code as amended by Chapter 971, Statutes of 1939,
and in accordance with the regulations of the California Appren~
ticeship Council, properl3~ indentured apprentices may be em-
pl.yed in the prosecUtion of the. work.
The bidder must submit with his proposal a satis-
factory check certified by a responsible bank and payable to
the order of the City of Tustin, or a bidder's bond, for an
amount not less than ten (10) per cent of the aggregate sum
of the bid, as a guarantee that the bidder will enter into the
proposed contract if the .same is awarded to him, and in event
of failure to enter into such contract said check or bond shall
become the property of the City.
The amomnt of the bond to be given to secure a
faithful performance of the Contract fo~ said work shall be
fifty (50) per cent of the contract price thereof, and an ad-
ditional bond in an amount equal to fifty (50) per cent of the
contract price for.said work shall, be given to secure the pay-
ment of claims for any materials or supplies furnished for the
performance of the work contracted to be done by the Contractor,
or any work or labor of any kind done thereon and the Contractor
will :also be required to furnish a certificate that .he carries
compensation insurance covering his employees upon work to be
done under contract'which may be entered into ~etween him and
the said City for the construction of said work.
No bid will be ..accepted from a Contractor who is
not iicensed in accordance with 'the provisions of the Contrac-
tors Eicense Act, or to whom a proposal form has not beem is-
sued by the City Clerk.
The work is to be dome in accordance with the pro-
files, plans and specifications of the City of Tustin on file
in the office of the City Clerk, of the City Hall of Tustin,
California. Copies of the plans and sPecifications will be fur-
nished upon application to the City Clerk.
The City Council of the City of Tustin reserves the
right ot reject any and all bids.

That the City Council of the City of Tustin has

ascertained and does hereby determine that the general prevail-
ing rage of per diem wage in the locality~ of' the Cit:7 of Tus-
tin, California, for each craft or type of workman needed to
execute the work hereinabove specified is as set forth in the
form of notice hereinabove set forth, and said notice shall con-
rain said schedule of per diem wages to be paid to the workmen
in said work.
PASSED AND ADOPTED by the City Council of the City
of Tustin, California, this 1st day of June, 1953.
