HomeMy WebLinkAboutCC RES 322RESOLUTION NO. 322 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN DECLARING RESULTS OF THE SPECIAL MUNICIPAL RECALL ELECTION HELD NOVEMBER 4, 1952. WHEREAS, a special municipal election was held and conducted in the City of Tustin, California, on Tuesday, the 4th day of November, 1952, to determine whether or not the voters would recall J. Roy Teter, all pursuant to the laws of the State of California; and WHEREAS, it appears that notice of said election was duly and legally given; that voting precincts were prop- erly established; that election officers were appointed and election supplies furnished; and that in all respects said election was held and conducted and 'the votes cast thereat received and canvassed, and the returns thereof made and de- clared, in time, form and manner as required by the general laws of the State of California, governing special recall el- ections in cities of the sixth class; and ~EAS, the City Council of the City of Tustin met at the City Council Chamber in the City of Tustin on Monday, the 10th day of November, 1952, to canvass the returns of said election, as a result of which the said City Council finds the number of votes cast, the names of the person voted for, and other matters required by law, to be as here- inafter stated; NOW' THEREFORE, BE IT RESOLVED as follows: That said special municipal recall election was held and conducted in the City of Tustin, California, on Tues- day, the 4th day of November, 1952, in the time, form and manner required by law; That there were two Voting precincts established for the purpose of holding said election consisting of Tustin Number 1 and Tustin Number 2, being the regular election pre- cincts in said City established for holding State and County elections; That the whole number of votes cast in said election was Four hundred and Seventy-six (476); That the questions~ voted on, the numbe~ of votes given in each precinct thereon, together with the whole num- ber of votes for' each question voted on in ttie enti~'e special ~.. election was as follows: Question: "Shall J. Roy Teter be recalled from the office of City Councilman of the City of Tustin?" YES Precinct No. i - l~ Precinct No, 2 - ll8 Total - 262 NO Precinct No. I - 109 Precinct No. 2 - 105 Total - 21~ Question: "If the recall prevails shall the City Council fill the vacancy or vacancies by appointment, or c all a ,s, pecial election for t hat purpose? BY APPOINTMENT: Pr. No. 1 - 81 Pr. No. 2 - 63 Total - 144 B~ SPECIAL ELEC TI ON Pr. No. I- ll6 Pr. No. 2 - 109 Total- 225 That a majority of the votes cast favored the recall of J. Roy Teter as Councilman; that a majority of the votes cast favored filling the vacancy in the event that the recall was successful by election rather than by appointment. BE IT FURTHER RESOLVED that Councilman J. Roy Teter was recalled at the special municipal election held in the City of Tustin on the ~th day of November, 19%2, also that said vacancy shall be filled by a special election to be held for that purpose in the City of Tustin. PASSED AND ADOPTED by the City Council of the City of Tustin at a regular adjourned meeting held on the 10th day, of November, 1952. ATTEST
