HomeMy WebLinkAboutPC RES 3815 RESOLUTION NO. 3815 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN RECOMMENDING THAT THE CITY COUNCIL APPROVE TENTATIVE PARCEL MAP 2001-235 TO SUBDIVIDE AN EXISTING 0.50 ACRE PARCEL INTO TWO PARCELS LOCATED AT 12882 ELIZABETH WAY (APN NO. 501-081-19). The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as follows: A. That Tentative Parcel Map 2001-235 to subdivide an existing 0.50 acre parcel into two parcels to accommodate an existing single family home and construction of a new single family home was submitted by Lang Verst Homes, inc. for consideration. B. That a public hearing was duly called, noticed, and held for said map on December 10, 2001, by the Planning Commission. C. That the project is Categorically Exempt pursuant to Section 15315 (Class 15) of the California Environmental Quality Act. D. That, as conditioned, the proposed subdivision will conform with the Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map Act, and the City's Subdivision Code. E. That the site is physically suitable for the type of development proposed. F. That the site is physically suitable for the proposed density, of development. G. That the design of the subdivision is not likely to cause substantial environmental damage or substantially and avoidably injure'fish or wildlife in their habitat. H. That the design of the subdivision proposed is not likely to cause serious public health problems. Resolution No. 3815 Page 2 II. The Planning Commission hereby recommends that the City Council approve Tentative Parcel Map 2001-235 to subdivide an existing 0.50 acre parcel into two parcels, subject to the conditions contained in Exhibit A attached hereto. BINSACK Planning Commission Secretary GENERAL (1) 1.2 (1) 1.3 (1) 1.4 (1) 1.5 EXHIBIT A TENTATIVE PARCEL MAP 2001-235 RESOLUTION NO. 3815 CONDITIONS OF APPROVAL The proposed map shall substantially conform with the submitted plans for the project dated December 10, 2001, on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to the plans if such modifications are consistent with the provisions of the Tustin City Code. Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to recordation of the final map for the project, subject to review and approval of the Community Development Department and Public Works/Engineering Department. Approval of Tentative Parcel Map 2001-235 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval for this project. The subject project approval shall become null and void unless a final map is submitted for review and approval within twenty-four (24) months of the date of this Exhibit. Time extensions may be considered if a written request is received by the Community Development Department within thirty (30) days prior to expiration. SOURCE CODES (1). (1) 2.2 The applicant shall provide execution of a subdivision/monumentation agreement and furnish the monumentation bond as required by the City Engineer prior to recordation of the final map. (1) 2.3 In addition to the normal full-size plan submittal process, all final development plans including, but not limited to, tract maps, parcel maps, right-of-way maps, records of survey, public works improvements, private infrastructure improvements, final grading plans, and site plans are also required to be submitted to the Public Works Department/Engineering Division in computer aided design and drafting, (CADD) format. The standard file format is AutoCAD Release 13 or 14 having the extension DWG. Likewise, layering and line type conventions are AutoCAD-based (latest version available upon request from the Engineering Division). in order to interchangeably utilize the data contained in the infrastructure mapping system, CADD drawings must be in AutoCAD "DWG" format (i.e. produced using AtuoCAD Release 14). Drawings created in AutoCAD Release 13 or Release 12 are compatible and acceptable. The CADD files shall be submitted to the City at the time the plans are approved and updated CADD files reflecting "as built" conditions shall be submitted once all construction has been completed. The subdivision bonds will not be released until the "as built" CADD files have been submitted. ORANGE COUNTY FIRE AUTHORITY (5) 3.1 Prior to recordation of the Final Parcel Map, the applicant shall obtain all necessary approvals from the Orange County Fire Authority (OCFA). FEES (5) 4.1 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a CASHIER'S CHECK payable to the County Clerk in the amount of $43.00 (forty-three dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of Exhibit A Resolution No. 3815 Page 3 limitations for any interested party to Challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. (1) 4.2 The applicant shall pay Orange County Fire Authority Tentative Parcel Map plan review fee of $152.29 payable to the City of Tustin.
