HomeMy WebLinkAboutCC RES 318RESOLUTION NO. 318 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CALLING A SPECIAL MUNICIPAL ELEC- TION FOR NOVEMBER 4, 1952, TO DETRMINE WHETHER OR NOT THE VOTERS WILL RECALL COUN- CILMAN J. ROY TETER, DESIGNATING VOTING PRE- CINCTS AND ELECTION OFFICERS FOR SAID ELECTION. The City Council of the City of Tustin does resolve as follows: WHEREAS, pursuant to the laws of t he State of Calif- ornia relating to municipalities of the Sixth Class, the City Council of the City of Tustin has been presented with a duly signed petition asking for the recall of Councilman J. Roy Teter, said petition having been examined by Arthur 0. Park,~ Deputy City Clerk, specially appointed to examinine said peti- tion, and the same having been found to contain the signatures of not less than sixty-five (65) registered voters in the City of Tustin, said amount being more than the amount necessary to qualify said petition for submission to the voters of the City of Tustin at a special election. NON, THEREFORE, BE IT RESOLVED: That a special municipal election be held in the City of Tustin, California, on Tuesday the ~th day of November, 1952, together with the General State Election held on said day for the purpose of determining .whether the voters of the City of Tustin will recall Councilman J. Roy Teter. The two regular election precincts in said City (Tustin) Precinct No. 1 and Tustin Precinct No. 2) established for hold- ing State and County elections shall be used for the purpose of holding said election, and said election shall be held at the same time and places of the General State Election to be held on Noven%ber ~, 1952. That the polling places of said precincts shall be as follows: Tustin Precinct No. 1 in the Advent Christian Church Social Hall located at 395 Pacific Street, Tustin, Calif- ornia, and Tustin Precinct No. 2 in the Council Chambers of the Tustin City Hall located at 145 Nest Third Street, Tustin, Calif- ornia, and the said polls shall be open between the hours of 7:00 o'clock A. M. and 7:00 o'clock P. M. on the ~th day of November, 1952. 209 That said election shall be held in accordance with the general election laws of the State of California insofar as the same shall have been made applicable to recall elections in municipalities of the Sixth Class. That the persons, residents and qualified electors in the City of Tustin designated as the election officers at the General State Election to be held on November 4, 19~2, shall be and are hereby designated and appointed to act as the elec- tion officers at said municipal recall election. There shall be printed on the ballot the following questions: "Shall J. Roy Teter be recalled from the office of City Counctlmm~ of the City of Tustin?" NO "If the recall prevails shall the City Council of the City of Tusttn fill the vacancy or vacancies by appointment,, or call a special election for that purpoSe?" BY APPOINTMENT BY SPEC IAL ELECTI ON ___ _ ..... , , ,, That the votes cast shall be canvassed on the Nonday , immediately following the date of election, to-wit, Novembe~ 10, 1952, and if it appears that a majority of those voting in the election voted in favor of the recall of the incumbent J. Roy Teter, the incumbent shall be deemed removed from office, and in the event of a tie, said recall shall be deemed to have failed to pass. That the City Clerk of the City of Tustin is hereby directed and required to give notice of said election as re- quired by law not earlier than the sixtieth day, nor later than the thirty-first day before the said election,, by publication in. a newspaper of general circulation , to-wit, The Tustin News, published and circulated in said City of Tustin, and that said notice shall be published at least once in said news- paper.
