The Planning Commission finds and determines as follows: : ? 8 A. That a proper application, Conditional Use Permit 00-003, was filed by the California Eye Clinic for Animals requesting authorization to establish a 9 specialty veterinary facility for the purpose of providing optometric and ~0 ophthalmologic procedures for small domestic *animals at 3025 Edinger Avenue, Building 3 of Planning Area B/D within the Jamboree Plaza ~ Planned Community. B. That a public hearing was duly called, noticed and held for said application ~3 on March 13, 2000 by the Planning CommiSsion. ~4 C. That the proposed project is in compliance with the Jamboree Plaza is Planned Community District Regulations and is in compliance with the Planned Community Commercial Business General Plan Land Use ~6 Designation. D. That establishment, maintenance, and operation of the use applied for will ~8 not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or ~9 working in the neighborhood of such proposed use, evidenced by the ~-0 following findings: 2~ a) The proposed facility, as conditioned, would not be .detrimental to, or have a negative effect on, surrounding properties in that the 22 proposed facility is located within a commercial business center 23 where sufficient parking is available. The maximum trip generation associated with the veterinary specialty office will not exceed 24 maximum trip capacity for Jamboree Plaza and-no impacts to 25 Edinger Avenue are anticipated. 26 b) All operations would be monitored by regulatory agencies including: Orange County Fire Authority, the Orange County Health Care 27 Agency, the Orange County Integrated Waste Management 28 Department, and the California' Department of Health Services. =9 c) The proposed use, as conditioned, will not be detrimental to the health, safety, morals, comfort and general welfare of persons residing or working in the neighborhood in that all activities would take place within the' building. In particular, animals would be ~ Resolution No. 3717 Page 2 2 confined to within the building. Storage of biohazardous, medical, 3 and sharps wastes would take place within the building in compliance with requirements of the applicable regulatory agency. 4 E. That this project is categorically exempt pursuant to Section 15303 (Class 5 3) of the California Environmental Quality Act. 6 II. The Planning Commission hereby approves CUP 00-003 to establish a specialty ? veterinary facility for the purpose of providing optometric and ophthalmologic procedures for small domestic animals at 3025 Edinger Avenue, Building 3 of Planning Area B/D within the Jamboree Plaza Planned Community. 9 PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting on the 13th day of March, 2000. ak ]4 -_I~B'E,H A. BINSAOK 2s Planning Commission Secretary 26 27 29 EXHIBIT A CONDITIONAL USE PERMIT 00-003 CONDITIONS OF APPROVAL RESOLUTION NO. 3717 GENERAL (1) 1.1 The proposed use shall substantially conform with the submitted plans for the project date stamped March 13, 2000 on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to plans during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with as specified or prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 The subject project approval shall become null and void unless permits are issued within twelve (12) months of the date of this Exhibit and substantial tenant improvements are underway. Time extensions may be granted if a written request. is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 Approval of Conditional Use Permit 00-003 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval for this project. PLAN SUBMITTAL (1)(5) 2.'1 At building plan check, the applicant shall submit tenant improvement plans, structural calculations and Title 24 energy calculations. Requirements of the Uniform Codes and State Handicap/Energy requirements shall be complied with as approved by the Building Official. (1) 2.4 Vehicle parking, primary entrance to the building, paths of travel, sanitary facilities, drinking fountains, and public telephones shall be accessible to persons with disabilities. Identify these on the plans. (3) 2.5 Access to two exits from the suite is required for any area-with occupant loads of thirty (30) persons or more. Show the exits and exit signage on the plans. (3) 2.6 All exit doors shall swing in the path of travel and be equipped with State Fire Marshal approved panic hardware. Identify these on the plans or provide a note on the plans confirming this. (3) 2.7' Identify the maximum occupant load for the suite on the plans. (3) 2.8 The plans submitted into plan check shall show restroom facilities for both sexes '- and shall indicate that toilet facilities in the restrooms shall be accessible to persons with disabilities. (1) 2.9 All signage shall be addressed under separate permits and shall comply with the requirements of the Tustin Sign Code and the Master Sign Program for Jamboree Plaza. (4) 2.10 In accordance with the Design Review for Jamboree Plaza (Condition 3.6 of Planning Commission Resolution No. 3557), please provide elevations identifying the cross-section view and location of all proposed roof-equipment and vents. All roof-mounted equipment and vents shall be located a minimum of six (6) inches below the top of the parapet or shall be located behind an architecturally compatible equipment screen. USE RESTRICTIONS *** 3.1 In accordance with the approved plans, the facility will require a total of thirteen (13) parking stalls. Any additional tenant improvements will require approval of an amended parking summary for Jamboree Plaza by the Community Development Director pdor to issuance of permits. Exhibit A - Conditions of Approval Cup 00-003 Page 3 *** 3.2 All biohazard and sharps waste shall be stored inside the enclosed building, in accordance with appropriate regulatory standar~ls, as set by the Orange County Fire Authority, Health Care Agency, and Integrated Waste Management .:.L Department, for disposal by a firm specializing in the handling of biohazardous, ~' sharps and medical wastes. *** 3.3 All animals shall be confined to within the building, except for movement to and from the owners' vehicles. *** 3.4 Boarding, grooming and the retail sale of pet products shall be prohibited. FEES (1)(5) 4.1 Prior to issuance of any building permits, payment shall be made of all applicable fees, including but not limited to the following. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. A. Building plan check and permit fees to the Community Development Department based on the most current schedule. B. Orange County Fire Authority plan-check and inspection fees to the Community Development Department based upon the most current schedule. (1) 4°2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community DevelopFnent Department, a cashiers check payable to the OOUNTY GLEi~K in the amount of $38.00 (thirty eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour pedod that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
