SUBJECT: SET A PUBLIC HEARING FOR JUNE 2, 2009 PURSUANT TO THE
REQUIREMENTS OF PROPOSITION 218 TO CONSIDER THE
ESTABLISHMENT OF SOLID WASTE RATES FOR FY 09-10
SUMMARY
Pursuant to Proposition 218, a public protest hearing is required to set solid waste rates.
Staff is requesting the City Council set a public hearing on June 2, 2009 at 7:00 P.M. to
consider the residential and commercial rate adjustments.
RECOMMENDATION
Staff recommends that the City Council set a public hearing for June 2, 2009 at 7:00 P.M.
to consider rate adjustments for FY 09/10.
FISCAL IMPACT
Public noticing for this hearing will cost approximately $10,000 for preparation of the notice,
property owner data and mailing.
BACKGROUND
1996's Proposition 218 requires the City to conduct a formal protest hearing so that all
property owners will have the opportunity to comment or dissent on residential and
commercial solid waste rates.
CR&R's current rate structure was adopted by the City Council in June 2007 and was part of
the new contract proposal. CR&R's contract and rates went into effect on October 1, 2007.
The 2007-2008 tax year was the final year that single family rates were placed on the
property tax roll and direct customer billing was implemented by CR&R by July 1, 2008.
This proposed adjustment is the first allowed by the current contract and Staff is requesting
the City Council to set a public hearing for June 2, 2009 at 7:00 P.M. Upon the City Council
approval of this item, staff will immediately send the attached notice to all property owners.
