RESOLUTION NO. 236
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN REPEALING RESOLUTION NO.
235 AND AUTHORIZING CHANGE ORDERS IN
THAT CERTAIN AGREEMENT FOR CONSTRUCTION
OF CITY HALL BETWEEN THE CITY OF TUSTIN
AND SHERMAN E. SALTER, CONTRACTOR, AND
DIRECTING CERTAIN TERMS TO BE EMBODIED
IN SAID "AGREEMENT FOR CONSTRUCTION OF
CITY HALL."
WHEREAS, Resolutio.n No. 235 authorizing change orders
in the Plans and Specifications fo~ the construction of altera-
tions and addition for Tustin City Hall was found to be in error
and impractical of execution:
.NOW, THEREFORE, .BE IT RESOLVED .that Resolution No.
235 of the City Council of the City of Tustin, entitled "A Reso-'
lution of 'the City Council of the City of Tustin Authorizing
Change Orders to the C~ontract fo~ Construction of Alte~'ations
and. Addition for Tustin City Hall, Tustin, California," be and
hereby is repealed and made void and of~. no effect.
BE IT FURTHER RESOLVED that change orders reducing
the contract price from $19,628.57 to $1~6,116.18 are authorized
to be ordered and made effective by supplemental a~reement between
the City of Tustin and Sherman E. Salter, General Contractor,
and Mayor Vincent L. Humeston be and hereby is authorized to
execute said agreement on behalf of the City of Tustin. Said
change orders specified by the Architect Roland L. Russell are
attached hereto and marked "Exhibit A" and made a part hereof.
BE IT FURTHER RE~OLVED that Mayor Vincent L. Humeston
is directed and authorized to enter into.'a further agreement with
Sherman E. Salter, Contractor, with ref~erence to the "Agreement
for Construction of City Hall" whereby the'last $2,000.00 pay-
able to the Contractor on the contract price shall not be paid
before November 1, 1950, except at the option of the City of
Tustin, and further that if by further mutual agreement between
the City of Tustin and the Contractor Sherman E. Salter the
period is extended beyond November 1, 1950, that the aforesaid
last payment due under the contract in the amount of $2,000.00
shall bear interest at the rate of 5% per annum.
