HomeMy WebLinkAboutCC RES 223RESOLUTION NO. 223 RESOLUTION OF THE CITY OF TUSTIN REPEALING RESOLUTION NO. 221 .AND REQUESTING ALLOCATION OF FUNDS FOR STREET IMPROVEMENT FROM COUNTY OF ORANGE OUT OF COUNTY'S APPOR- TIONMENT OF CALIFORNIA HIGHWAY USER'S TAX FUND. On motion of Councilman Miller, duly seconded and carried, the following Resolution was adopted: WHEREAS, the City of Tustin, a city of the Sixth Class, in the County of Orange~, desires to improve MAin Street, ~ '.,~ . :'~. . :".' .:... a sgre.et within .the incorporated limits of the City of..Tusttn, the nature and extent of the contemplated project bein~ ~ore described hereafter: WHEREAS, there is attached hereto, marked Exhibit "A". ,. and made a. part hereof, a ..sketch .showing the location of Main Street and its relationship to the principal highways of the County Qf Orange in said..area, .and WHEREAS, Section 2150 of the Streets and Highways Code authorizes a County, if it so de.si.res, to expend funds ap- portioned to it out of the California Highway User's Tax Fun~ for ~aid to cities in the improvement, construction or repair of..a street wi thin. a city, provided that the BOard of Super- visors of such Coun.t7 determines that the p~oJect ts in..the general Coun. ty interest NOW, .THEREFORE.,. BE IT RESOLVED AND ORDERED: ~.,That Resolution No. 221 concerning the same sub- ~'~Ject~.is hereby repealed, That. the City .of Tustin.hereby requests the County of Orange for a grant of a~id in the sum.of One ..Thousand Three Hundred and Thirty-five Dollars ($1,335.00) out of the County' s apportionment, of the California Highway User' s Tax Fund, the amount .requested to be used exclusively .for the fol- lowing ..purposes.: 1. · The improvement of Main. Street, situated as designated on Exhibi~t. "A" hereof.. ., .2.. The..nat~re','and..extent of the project and the e~tfmated co~t the~eo£ a~e ~ubstanttally ~ follows: ..... ~. 38 a. Patch the exdsttng surface ef Main Street with emulsified asphal.t or SC 4 ,.(plant mix) between Prospect Street on the East and Pacific Street on the West. Estimated cost Four Hundred and Thirty-five Dollars ($435.00). b. Resurface and add three (3). feet in width to Main Street between Pacific Street on the East and Tusttn Avenue on the West. Tht's' second phase of the project to be done in connection with the County of Orange, who has liability 'for the South'one-half of the aforesaid portion of 'Main Street, sometime dUring the fiscal year 1949-50. Estimated cost for city.' s por- tiOn of'above work, estimated t,o be Nine Hundred Dollars ($9oo.oo). BE IT FURTHER RESOLVED that the Board of Supervisors of the County of Orange be and is hereby requested to find that the 'improvement of Main Street in the manner aforesaid is in the general C°unty 'interest in that: It is the principal street South of U. S. Highway 101 paralleling'U. S. Highway 101. Main Street is more or less a continuation of Chestnut Street in the City of Santa.Aha:by reason of which it bears much of the traffic from the 'OitY of Santa Ana going toward San Diego and El' Toro Marine Base. Main . Street is also one of the prlncipal~ streets forming the busiest intersection in the City of Tustin and draws much of the traffic into the City from County areas West of the City. BE IT FURTHER RESOLVED that it is understood that the grant of the aid hereby ,requested is' contingent upon an in- dependent finding by the Board of Supervisors of the County of Orange that the purpose for which aid is hereby sought is in .. the 'general County interest. BE I~T FURTHER RESOLVED that 'it is Understood that upon the acceptance by the City of Tustin of any grant which may be made ,By'the County of Orange pursuant to this request, this Resolution, the Re~olutton of the Board of Supe~vis°~ of' the 'County' of orange specifying the terms ..and conditions . . of the grant, and any and al,.1 laws applicable shall constitute Tustin the agreement between the City o~and the County of Orange re- specting the grant. That the City of Tustin hereby requests the County of Orange for a grant of aid in the sum of One Thousand Three Hundred and Thirty-five Dollars (1,335.00) out of the County~s apportlon- went of the California Highway Users Tax Fund, the amount re- quested to be used exclusively for the following purposes: 1.
