SUMMARY
Tentative Parcel Map 2001-147 is a request to combine two parcels at 13270 Newport
Avenue into one 4.7-acre parcel for development of a new retail market with drive-through
pharmacy. On December 10, 2001, the Planning Commission approved the architecture
and site amenities and recommended that the City Council approve the Tentative Parcel
Map 2001-147 with conditions to ensure compliance with the Subdivision Map Act.

RECOMMENDATION
That the City Council adopt Resolution 02-04 approving Tentative Parcel Map 2001-147.
FISCAL IMPACT
The proposed Tentative Tract Map is an applicant-initiated project. The applicant has paid
applicable fees for the processing of this map.
DISCUSSION
The applicant is proposing to merge two (2) parcels to create one 4.7-acre parcel to
accommodate: 1) demolition of the existing 32,963 square foot Albertsons/vacant retail
shops and 3,619 square foot vacant office building; and, 2) construction of a 50,275
square foot retail market with a drive-through pharmacy and site amenities at 13270
Newport Avenue (Attachment A- Location Map). The two (2) existing parcels are Parcels
2 and 3 of Tract Map 8603.
These two parcels will be combined (Attachment B- Tentative Parcel Map 2001-147) and
the new building will be located in approximately the same location as the existing
Albertsons. Access to the site would continue to be provided by the existing driveway
approaches on First Street and Newport Avenue. The main driveway is currently
signalized and will be widened to be the fourth leg of the Newport Avenue and Holt
Avenue intersection.

On December 10, 2001, the Planning Commission approved the architecture and site
amenities and adopted Resolution No. 3812 recommending that the City Council approve
Tentative Parcel Map 2001-147. The map is generally in compliance with State and City
requirements. Conditions of approval contained in Exhibit A of Resolution No. 02-04
(Attachment C) are included to ensure compliance with the Subdivision Map Act and the
City of Tustin Subdivision Manual.
ENVIRONMENTAL
A Mitigated Negative Declaration was prepared for development of the project and
approved by the Planning Commission on December 10, 2001. The proposed parcel map
to merge the two existing parcels is Categorically Exempt pursuant to Section 15315
(Class 15) of the California Environmental Quality Act.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
APPROVING TENTATIVE PARCEL MAP 2001-147 TO COMBINE
TWO EXISTING PARCELS TO CREATE A NEW 4.7 ACRE PARCEL
LOCATED AT 13270 NEWPORT AVENUE FOR THE PURPOSE OF
DEVELOPING A RETAIL MARKET WITH DRIVE-THROUGH
PHARMACY AND SITE AMENITIES.
The City Council of the City of Tustin does hereby resolve as follows:
The City Council finds and determines as follows:
A,
That Tentative Parcel Map 2001-147 to combine two existing parcels to
create a new 4.7 acre parcel located at 13270 Newport Avenue for the
purpose of developing a 50,275 square foot retail market and drive-
through pharmacy was submitted by Albertsons Inc. for consideration;
B,
That on December 10, 2001, the Planning Commission approved Design
Review 01-018 and Conditional Use Permit 01-014 for development of a
50,275 square foot retail market with drive-through pharmacy and site
amenities and recommended that the City Council approve Tentative
Parcel Map 2001-147;
C,
That a public hearing was duly called, noticed, and held for said map on
January 7, 2002, by the City Council;
D,
That the proposed subdivision involves the combination of less than four
(4) parcels and is Categorically Exempt pursuant to Section 15315
(Class 15) of the California Environmental Quality Act (CEQA);

As conditioned, the proposed subdivision will be in conformance with the
Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map
Act, and the City's Subdivision Code;

The City Council hereby approves Tentative Parcel Map 2001-147 to combine
two existing parcels to create a new 4.7 acre parcel located at 13270 Newport
Avenue for the purpose of developing a 50,275 square foot retail market and
drive-through pharmacy with site amenities, subject to the conditions contained
in Planning Commission Resolution No. 3812 attached hereto as Exhibit A.

The Planning Commission hereby recommends that the City Council approve
Tentative Parcel Map 2001-147 to create a 4.703 acre parcel for.development
of a 50,275 square foot retail market and pharmacy building and the site
amenities, subject to the conditions contained in Exhibit A attached hereto.

CONDITIONS OF APPROVAL
Within 24 months from tentative map approval, the subdivider shall
record with appropriate agencies a final map prepared in accordance
with subdivision requirements of the Tustin Municipal.Code, the State
Subdivision Map Act, and applicable conditions contained herein unless
an extension is granted pursuant to Section 9323f of the Tustin Municipal
Code. .
The subdivider shall conform to all applicable requirements of the State
Subdivision Map Act, the City's Subdivision Ordinance, and the City's
zoning regulations.
The subdivider shall' be required to execute 'Subdivision/Monumentation
Agreements and provide improvement/monumentation bonds to the City
prior to recordation of the final map.
Preparation and recordation of a final subdivision map is required prior
to issuance of building permits, unless otherwise provided for in
Condition No. '1.7 of Resolution No. 3813..
Prior to final map approval, the subdivider shall submit:

A current title report; and,
A duplicate mylar of the Final Map, or 8% inch by 11 inch
transparency of each map sheet prior to final map approval and
"as built" grading, landscape, and improvement plans prior to
Certificate of Acceptance.
The applicant shall hold harmless and defend the City of Tustin from all
claims and. liabilities arising out of a challenge of the City's approval of
this project.
For development of the project described in Design Review 01-018 and
Conditional Use Permit 01-014, all conditions of approval shall, be

complied 'with as shown on Exhibit A attached to Resolution No. 3813
and incorporated herein by reference.

FNGINEERING
(1) 2.1
In addition to the normal full-size plan submittal process, all final
development plans including, but not limited to, parcel maps, right-of-
way maps, records of survey, public works improvements',, private
infrastructure' improvements, final grading plans, and site plans are also
required to be submitted to the Public Works Department/Engineering
Division in computer aided design and drafting (CADD) format. The
standard file format is AutoCAD Release 13 or 14 having the extension
DWG. Likewise, layering and-linetype conventions are AutoCAD-based
(latest version available upon request from the Engineering Division). In
order to interchangeably utilize the data contained in the infrastructure
mapping system, CADD drawings must be in AutoCAD "DWG" format
(i.e. produced using AutoCAD or AutoCAD compatible CADD
software). The most current, version of AutoCAD is Release 14.
Drawings created in AutoCAD Release 13 or Release 12 are
compatible and acceptable.
The CADD files shall be submitted to the City at the time the plans are
approved and Updated CADD files reflecting.'~as built" conditions shall
be submitted once all construction has been completed. The
subdivision bonds will not be released until' the "as built" CADD files
have been submitted.

Within forty-eight (48) hours of approval of the subject project, the
applicant shall deliver to the Community Development Department, a
cashier's check payable to the COUNTY CLERK in the amount of fo'rty-
three dollars ($43.00) to enable the City to file the appropriate
environmental .documentation for tho project. If within such forty-eight
(48) hour period 'the applicant has not delivered to the Community
Development Department the above-noted check, the statute of
limitations for any interested party to challenge the. environmental
determination under the provisions of the California Environmental
Quality Act could be significantly lengthened.
